Official Rules

This “Hang with Rossi at the MotoGP of Motegi Campaign” (this “Campaign”) will be conducted by Monster Energy Company (“Monster”) strictly in accordance with these Official Rules. Please read these Official Rules carefully in entering this Campaign, and refrain from participating if you cannot agree to be bound by the same. Upon entering, all participants will be deemed to have agreed to the terms and conditions of these Official Rules (in cases where participants are under 20 years old, upon entering, they will be deemed to have agreed to the terms and conditions of these Official Rules after obtaining their parents’ consent).

No purchases of any services or products is necessary to enter or win this Campaign.
This Campaign will be conducted fairly among all participants. Purchases of services or products will not improve your chances of winning.

1. Prize:

Grand Prize (5 winners): Each winner receive two tickets to 2012 FIM MotoGP World Championship Series 15th Round - Air Asia Japan Grand Prix at Twin Ring Motegi (“MotoGP of Motegi”) and a Meet and Greet with Valentino Rossi

* MotoGP of Motegi will be held at Twin Ring Motegi from October 12th to 14th of 2012. The Valentino Rossi Meet and Greet will be held on October 12, 13, or 14, at a location to be determined.

First Prize (5 winners): Each winner receive two tickets to the film “FASTEST” Premier Preview and a Meet and Greet with members of the Yamaha Tech 3 Team

* The film “FASTEST” Premier Preview will be held at Twin Ring Motegi on October 13, 2012. The Yamaha Tech 3 Team Meet and Greet will be held on October 12, 13, or 14, at a location to be determined.

2. Eligibility: Participants must be residents in Japan and at least 18 years of age as of the entry date.

Provided, however, that employees of Monster, its affiliates and partner organizations and their respective parents and subsidiaries (collectively, “Sponsor”), and their immediate families (parents, legal guardians, siblings, and children) and those living in the household of the same are not eligible to participate. Those who are under 20 years old are not eligible to participate unless they have their parents read these Official Rules and obtain their parents’ consent. In addition, entries shall be limited to one (1) entry per participant.

3. Entry dates: 12:01 am on Saturday, September 1, 2012 to 11:59 pm on Friday, September 28, 2012 (JST).

4. Entry method: Participants may enter via the Monster Energy Japanese website (http://www.monsterenergy.com/jp/ja/home/) (“Entry Site”). Please provide required information on the form provided on the Entry Site. Submission of the completed form will be deemed as one (1) entry in this Campaign.

The Sponsor, internet server and access provider(s), and each of their respective affiliates, parent corporations, subsidiaries, advertising and promotional agencies and the officers, directors, shareholders, employees, and agents of the same (collectively, “Releasees”) are not responsible for the following: incorrect information or inaccurate entry of information; human errors; technical malfunctions or failures of telecommunications networks; any damages to computer online system, computer equipment, servers, providers, software, or computers owned by participants or other persons incurred in connection with entry into this Campaign; inability to access the Entry Site; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; technical difficulties that may occur on any internet connection lines and web site(s) (including the Entry Site); issues in connection with or arising out of typographical errors or printing.

Illegible, incomplete, or duplicate entries, regardless of intent or negligence, will be disqualified. All entries will be placed under the strict control of Monster, and will not be returned to the participant. False or fraudulent entries will be disqualified. Any wrongful operation of any entry by use of equipment or software is prohibited. Only entries from the Entry Site will be deemed eligible, and all entries from websites, mail addresses, etc., other than the Entry Site will be deemed ineligible.

By entering into this Campaign, participants will be deemed to have agreed to waive any rights to bring a claim regarding any matters in connection with or arising out of this Campaign or these Official Rules, and to be bound by these Official Rules.

5. Winner Selection: The winner will be selected in a random drawing of all eligible entries by Monster on or around September 29, 2012, whose decision will be final and binding. The winner will be notified via email by October 1, 2012. The winner must submit required information and documents necessary for arrangement for the prize by October 5, 2012. Failure to provide all required information and documents within the specified time period may result in disqualification. If a prize notification or prize is returned as undeliverable for any reason, the prize will be awarded to an alternate winner in a subsequent random drawing. Monster reserves the right to substitute another item for a prize in its sole discretion in the event an advertized prize is unavailable. The winner may not transfer its rights or obligations in connection with the prize to third parties, or use the same as collateral.

Acceptance of the prize constitutes permission from the relevant winner for Monster to use the winner’s information (name, likeness, voice, occupation, comments, etc.) for marketing, promotional, publicity purposes without compensation.

The odds of winning will depend on the number of eligible entries received, but in any event, the selection will be conducted strictly and fairly. If there is any difficulty in determining the identity of a participant, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder shall mean the natural person who is assigned to the relevant e-mail account by an internet access provider, service provider, or other online organization that is responsible for assigning e-mail accounts for the domain associated with the submitted e-mail account. A potential winner may be requested to provide Monster with proof that such potential winner is the authorized account holder of the e-mail account associated with the winning entry and that all eligibility requirements have been met.

6. Invitation: All persons under 20 years of age must obtain parental consent to visit Twin Ring Motegi and attend the Valentino Rossi or Yamaha Tech 3 Team Meet and Great. All costs and expenses other than the costs for tickets to MotoGP of Motegi and the Valentino Rossi Meet and Great or tickets to the film “FASTEST” Premier Preview and the Yamaha Tech 3 Team Meet and Great shall be borne by the winner. Such costs and expenses shall include, without limitation, travel expenses to and from Twin Ring Motegi. Winners may be asked to cooperate by providing comments regarding the prize in the form of a questionnaire, and the contents of such questionnaire may be disclosed on websites.

7. Treatment of personal information: Personal information entered will be used by Monster and/or individuals or entities entrusted by Monster to confirm eligibility, to notify the winner, to ship prizes, to make arrangements for prizes, and for marketing purposes to provide information regarding products and services of Monster. Further, the personal information will be used in conformance with the privacy policies you can see on the Entry Site (http://www.monsterenergy.com/jp/ja/home/#!/pages%3Aprivacy).

8. Limitation of Liability: Releasees shall not be liable to winner for any reason. Without limiting the generality of the foregoing, Releasees shall not be liable to winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s) or request(s) from any governmental or quasi-governmental entities (regardless of whether such actions or requests are later deemed invalid) or any other circumstances beyond control of Monster (including, without limitation, circumstances of Valentino Rossi or Yamaha Tech 3 Team). In addition, Releasees shall not be liable to winner as a result of failures of equipment used for entry, terrorist acts, earthquake, war, fire, flood, explosion, severe weather, hurricane, labor disputes, and labor strikes (whether legal or illegal), labor or material shortage, transportation interruption, work slow-down, civil disturbance, insurrection, riot, and any other events.

9. General: Participants agree to release and waive any claims they may have in connection with this Campaign and these Official Rules, but in any event, this Campaign and these Official Rules shall be governed by the laws of Japan, and the Tokyo District Court shall have jurisdiction over any matters related to or arising out of this Campaign or these Official Rules.

Participants shall waive the right to file complaints or claims against Releasees. Specifically, without limitation, participants agree to waive any claims they may have against Releasees for any damages and costs (including attorney’s fees) that may arise in participating in this Campaign, and damages, losses, costs or expenses related to the prizes.

If the Entry Site and other related websites become corrupted or experience technical difficulties related to computer viruses, bugs, tampering, unauthorized intervention, action, fraud, and other technical failures, if this Campaign cannot be conducted in conformance with the Official Rules, if the administration, security, fairness, integrity of this Campaign becomes compromised, or if other circumstances beyond the control of Monster should arise, Monster reserves the right to cancel, terminate, modify or suspend this Campaign in its sole discretion, and to disqualify any individual implicated in the foregoing. If this Campaign is terminated, Monster will conduct a random drawing from all eligible, non-suspect entries received prior to the time of termination to award the prize. If such cancellation, termination, modification, or suspension occurs, participants will be notified via the Entry Site.

Any attempt by an entrant or any other individual to damage or destroy any website (including the Entry Site) or interfere with the conduct of this Campaign is prohibited by law, and should such an attempt be made, Monster reserves the right to seek damages from the relevant person making any such attempt.
