PROMOTION TERMS & CONDITIONS
Please read these terms & conditions (“Terms”) carefully.  By entering the Promotion (as defined below), you are agreeing to be bound these Terms.  You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering this Promotion.
1.   Subject to the provisions of paragraph 4 below, this promotion (“Promotion") is open to all persons over eighteen (18) years of age and who are resident in Poland.
2.   This Promotion is being organised and operated by Monster Energy Europe Limited Spółka z Ograniczoną Odpowiedzialnością Oddział w Polsce”, C/o TMF Poland Sp. z o.o., Pl. Piłsudskiego 1, 00-078 Warszawa Poland (“Monster Energy”).
3.   The Promotion is being conducted through the website at www.monsterenergy.com (the “Website”) and promoted through the Monster Energy official facebook page.
4.   No employee or family member of an employee of Monster Energy, its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion.
5.   By entering this Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms.  No correspondence will be entered into.
6.   All times and dates set out in these Terms refer to the times and dates in Poland.  
7.   Proof of purchase of at least one (1) item of any Monster Energy product regardless of its price is required for entry into this Promotion which may include a copy of the till receipt obtained on purchase.
8.   Entrants may enter by submitting their details as directed on the Website and answering the following two (2) questions ‘Ile razy Valentino Rossi wywalczył tytuł mistrza świata w Motocyklowych Mistrzostwach Świata w klasie MotoGP startując na motocyklu Yamaha?’ (“Question 1”) and ‘Jakie zmiany zaproponowałbyś, aby uatrakcyjnić wyścigi MotoGP?’ (“Question 2”) ( together the “Questions”).
9.   Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry or any individual to the Promotion who submits or attempts to submit more than one (1) entry.
10.   Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it has reasonable reasons to believe have been made using any automated entry techniques.  
11.   Each entrant that validly submits their entry will be entered into the Selection Process (as defined below) for the following prizes (each  a “Prize”):
11.1.   The first entry selected pursuant to clause 19 (each a “Prize Winner”) will each win two (2) tickets to the MotoGP Le Mans, France for 18 May 2013 and 19 May 2013 (“Event”) .  Each ticket shall be worth the estimated value of two thousand, six hundred (2,600.00) PLN and shall grant the holder the right to the following:
11.1.1.   one (1) economy direct air bus return ticket from Poland to an airport selected by Monster Energy (“Destination Airport”);
11.1.2.   three (3) night stay in twin room accommodation of no less than a two (2) star rating hotel to be selected by Monster Energy in its absolute discretion (“Hotel”);
11.1.3.   return transfers from Destination Airport to Hotel and from Hotel to each day of the Event as determined by Monster Energy in its absolute discretion ("Transfers"); and
11.1.4.   selected meals as determined by Monster Energy in its absolute discretion throughout the Event (each a “Meal”).
11.2.   The Prize Winner will be awarded an additional amount of the value of 520 PLN, for the purpose of their personal income tax on the Prize under art. 30 item 1 point 2 on the personal income tax (Law of  26 July 1991; consolidated text J/L from 2000 No. 14, item 176, as amended).
12.   The commencement date of the promotion is 00:00 on 16 March 2013 (“Commencement Date”) and the closing date for the promotion is 23:59 on 16 April 2013 (“Closing Date”).  
13.   Entries made outside the Commencement Date and Closing Date will not be valid.
14.   Only the Prize Winner and one (1) person as chosen by Prize Winner, (each an “Elected Person”) may enjoy the benefits of the Prize.  Each Elected Person must be approved by Monster Energy, be over the age of eighteen (18) and be resident in Poland.  
15.   Before being declared an official winner (each a “Winner”), a potential winner will be required to prove eligibility, including, without limitation, proof of purchase, proof of age, residence and identity, which may include but not limited to submitting a copy of the till receipt obtained on purchase, a driver’s license, proof of residence, passport or similar government issued identification.  Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy shall result in a potential winner forfeiting the Prize and another qualifying entry being drawn as soon as reasonably possible thereafter.
16.   The Winner will be required to sign a written confirmation of eligibility and waiver of liability before the Prize can be released to a Winner.  Copies of the applicable confirmation and waiver can be obtained upon request to mateusz@monsterenergyweb.com.
17.   For the avoidance of doubt, all other costs associated with the Prize, including without limitation, tax, insurance, transportation, sustenance and any entertainment not specifically included and outlined in the definition of the Prize at paragraph 11 above will be borne solely by the Winner.  It is the responsibility of the Winner to be available for the dates of the Prize and to provide any required documentation, tax, insurance, passport and any other legal requirements for the Prize and/or documentation required by Monster Energy.
18.   There will be a total of one (1) Winner and the total value of the Prize as set out in paragraph 11 above shall be worth the estimated value of 5200 PLN.  
19.   All qualifying entries shall be entered into the following selection process to determine the Winner of the Prize(“Selection Process”).  The Selection Process shall commence on 17 April 2013.  A panel consisting of two (2) employees of Monster Energy, one (1) Employee of Coca Cola HBC Polska Sp. z o.o., Szymon Fałkowski, ul. Annopol 20, 03-236 Warszawa and one (1) independent lawyer (which makes up the “Panel”) will collaborate and choose the Winner for the Prize based on the Panel’s assessment of all qualifying entries who best meet the following criteria: the answer to the Question 1 must be correctly answered and the answer to Question 2 will need to demonstrate the most creative and original response, ingenuity, the best understanding of the Monster Energy brand and best use of vocabulary and writing style (“Selection Criteria”).  The Panel shall ensure that the entries are valid in accordance with these Terms, judge the valid entries on the Selection Criteria, assign the Prize to Winner and running claim proceedings.  
20.   The selected Winner shall be notified telephonically and by email via the telephone number and the email address provided to enter the Promotion within five (5) days of the Selection Process (“Notification Date”).  Upon Notification the Winners shall be required to confirm their entry into the Promotion and provide relevant personal details for confirmation of their entry and the delivery of their Prize.
21.   The date and details of delivery (including details of the flights, Destination Airport, all Hotels, Meals and Transfers for the Prize) shall be determined by Monster Energy, in its complete discretion, and  Winner shall be informed of the details at Notification Date.  
22.   In the event that Monster Energy cannot contact a potential winner telephonically within three (3) days of the Notification Date and/or a potential winner and Elected Person are unavailable to attend the Prize or claim the Prize for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall draw another qualifying entry as soon as reasonably possible thereafter.
23.   No entry shall be able to provide alternative contact information to that provided to enter the draw for any reason.
24.   All entries are deemed to have been received at the time of entry into the Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant.  
25.   Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received.  Monster Energy accepts no responsibility for entries that are incorrectly completed.
26.   The Prize is as described and is not transferable, not exchangeable and no cash alternative will be offered in the event that a potential winner is unable to claim the Prize for any reason whatsoever.  In the event of unforeseen circumstances, Monster Energy reserves the right to replace the entire Prize or prize components with prizes of equal or greater value.
27.   All Prizes shall be taxed in accordance with Polish law.
28.   The Winner agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and Winner consents to Monster Energy using their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion.
29.   The Winner’s names and Prize’s shall be announced on the Website after Notification.
30.   The Panel shall create a report of the Selection Process for this Promotion which shall be available to Winner upon request.
31.   The Winner’s name will be available on written request for two months after the Closing Date.
32.   Unsuccessful entrants will not be notified.
33.   Any personal information which you, the data subject, provide voluntary to Monster Energy in connection with the Promotion (“Data”) will be treated in accordance with the Polish Personal Data Protection Act of 29 August 1997.  Monster Energy acting as a data controller will only use this Data for the following purposes: to enter the qualifying entries into the prize draw and for contacting the potential winner.  Monster Energy will not use Data for direct marketing purposes. .  On your request, Monster Energy will supply copies to you of your Data which you may have supplied in connection with this Promotion  If you discover that Monster Energy hold inaccurate Data about you, you can request that Monster Energy correct that Data.  If you wish to request a deletion, you would generally be expected to identify some contravention of data protection law in the manner in which Monster Energy processes the data concerned.  If you wish to obtain such copies of your Data, request for correction or request deletion of your Data, you must write to either Monster Energy at the address above or e-mail Monster Energy at mateusz@monsterenergyweb.com. Your request will be dealt with as soon as possible and will take not more than thirty (30) days to process.  
34.   To the fullest extent permissible by law, neither Monster Energy nor any of its affiliate companies, employees, directors, employees, agents, assigns or sub-contractors accepts any responsibility or liability for any damage, loss, injury or disappointment suffered by any entrant accessing the Website, entering the Promotion competition or as a result of accepting any Prize.  Proof of sending is not accepted as proof of receipt.  . Nothing shall exclude Monster Energy’s liability for fraudulent misrepresentation, death or personal injury as a result of such entity’s negligence or any other liability that cannot be excluded or restricted by law.
35.   Events may occur that render the prize draw itself or the awarding of any Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
36.   Monster Energy reserves the right to:
36.1.   change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant;
36.2.   refuse entry of any individual to the Promotion or future events organised by Monster Energy;
36.3.   where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part;
36.4.   where an entrant has been disqualified from any Monster Energy competition/ promotion or other prize draw within twelve (12) months of the Commencement date;
36.5.   where Monster Energy reasonably believes such individual has not complied with these Terms; or
36.6.   where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
37.   Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant.  The Winner will be liable for any tax chargeable in relation to the Prize.  
38.   It is advised that all entrants retain a copy of these terms and conditions for future reference.
39.   The Promotion and these Terms are governed by the law of England and Wales and any disputes (contractual or non-contractual) arising under or in connection with the Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts of England and Wales.
