OFFICIAL RULES

 

1.    Eligibility:

The Monster Energy Under the Tab 2022 Collect and Redeem Promotion and the VIP Festival Access Sweepstakes (the “Promotion” and “Sweepstakes”) are open to persons who are legal residents of, and physically located within, Canada, and are over the age of majority in the province or territory in which they reside, at the time of entry or claim, except employees, representatives and agents, and members of their immediate families (i.e., parents, spouses, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of Monster Energy Canada Ltd. (“Monster” or “Sponsor”),  the Promotional administrator and SMS provider: GOcxm Corp (“GOcxm”), the Fulfillment administrator: LPi Group Inc., (collectively, the “Promotion Entities”), Live Nation Canada, Inc. (“Live Nation”), YouTube, a subsidiary of Google LLC (“YouTube”), and their respective affiliated companies, parent companies, subsidiaries, participating promotional partners, retailers, distributors, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution, production, or fulfillment of the Collect and Redeem items or prizes.

 

 

2.    Sponsor:  Monster Energy Canada Ltd.; Promotional Administrator:  GOcxm

 

3.    Agreement to Official Rules

By participating in the Promotion, participant fully and unconditionally agrees to, and accepts, these official rules (the “Official Rules”) and the decisions of the Sponsor and Administrator, which are final and binding in all matters related to the Promotion. 

 

4.    Promotion Period

The Promotion will begin on June 1, 2022 at 12:00:01 AM Eastern Time (“ET”) and will end at 11:59:59 PM ET on August 31, 2022 (the “Promotion Period”).

 

5.    Promotion Cans

Monster Energy® 473mL products with the silver promotional tabs in the flavours listed below in Appendix A, while supplies last, will be produced for this Promotion (“Participating Product”).

SECTION 1: COLLECT AND REDEEM TERMS AND CONDITIONS

(SWEEPSTAKES OFFICIAL RULES WILL FOLLOW IN SECTION 2)

 

How to Participate and Claim Collect and Redeem Items

6.    Purchase Monster Energy® products in Canada during the promotion period and collect the CODES under the silver tabs. Participating Products may not be available in all locations and markets at all times during the Promotion Period. No copies, reproductions, or can tabs, from other products will be honored. Monster reserves the right to verify identity of individual submitting the order.

7.    To redeem CODES, scan QR code appearing on pack or POS. You will be redirected to complete your account set up (your cell number, name, address, date of birth, and email address). Enter your CODE(s). Each CODE will automatically give you one (1) entry in the Sweepstakes (see Section 2). You will be provided options to redeem for a Collect and Redeem item or accumulate CODES for higher tier items. You may come back multiple times to enter CODES, your cell number is the account number. Once you have collected enough CODES to redeem for a desired item, select the item, and you will be directed to complete the claim form. The deadline to enter CODES is the promotion period end of August 31, and last date to claim items is October 31, 2022.

8.    Regular text messaging rates, airtime, data, and carrier charges may apply, OR scan the QR code printed on point-of-sale materials found in stores. Only one (1) mobile phone number may be used by any one person to participate in this Promotion. Any personal information submitted will be used for the purposes of administering this Promotion only.

9.    Please allow approximately four (4) weeks for delivery on gift card and subscription items or for further communication on festival, concert tickets or experience-based items after your order is placed. Collect and Redeem experiences will be fulfilled in 2023, except the Miami experience which may be fulfilled near the end of 2022 unless circumstances beyond the Sponsor’s control arise.

10. Bonus CODES and Bonus Sweepstake Entries – 5 bonus CODES and 5 bonus sweepstake entries will be allocated in the following circumstances: (a) upon signing up to receive a notification when the program launches from May 1, 2022, at 12:01 am ET to May 31, 2022, at 11:59 pm ET. Scan the QR code found on participating cans to access the portal to sign up. Fill in your Full Name, Phone Number, and check the notifications box to participate; (b) for returning customers upon registration in the program between June 1, 2022, at 12:01 am ET and  August 31, 2022, at 11:59 pm ET. Use the QR code found on participating cans to access the portal to register in the program. Click on the register button and enter your First Name, Last Name, Email Address, Phone Number, Date of Birth and Postal Code. For this program, “returning customers” are users who participated in the 2021 Monster Energy Live Nation program.  

 

Limit to one set of Bonus CODES and Bonus Sweepstake Entries per user.

 

You can also earn 5 bonus CODES and bonus sweepstake entries when you refer an individual with whom you have a family or personal relationship to the program, provided that individual then registers in the program. For these purposes a “family relationship means the relationship between you and the individual to whom you are sending the message is sent if you and the individual to whom you are sending the message are related to one another through a marriage, common-law partnership or any legal parent-child relationship and those individuals have had direct, voluntary, two-way communication; and

 

A “personal relationship” means a relationship between the sender and the referred individual, where those individuals have had direct, voluntary, two-way communication and it would be reasonable to conclude that they have a personal relationship. The GIC Regulations set out a non-exhaustive list of factors that should be used to determine whether there is a personal relationship (e.g. the sharing of interests, experiences, opinions and information evidenced in the communications; the frequency of the communication, etc.).

 

Upon registration, the referred individual will earn five (5) bonus CODES and five (5) bonus sweepstake entries. To obtain this bonus, share the unique referral URL found within "my profile" by logging into the program. The referral URL can be shared with individuals with whom you have a family or personal relationship you think would be interested in learning about this program and would not consider this to be spam. When your friend clicks on the unique URL and registers to the program, you will each receive five (5) bonus CODES and five (5) bonus sweepstake entries. If you share this unique URL through social channels, please ensure that you are compliant with all applicable Terms of Use.  Any share of this unique URL through social channels must include #contest/sweepstakes as part of your post.

*For all ticket items:

Tickets are subject to program availability, venue capacity, age, and artist restrictions. Tickets to a particular concert or festival (as applicable) are not guaranteed. Selection of ticket type and/or concert seat location (if applicable) is solely within Live Nation’s discretion. Parking, travel, and accommodations are not included and are the sole responsibility of the claimant and guest. Claimant and guest must abide by all concert/festival and venue policies. Live Nation reserves the right to revoke full or partial ticket related item from any claimant and guest who it and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any concert/festival or venue policy or law, and/or may bring Live Nation Canada or Sponsor into disrepute. Claimant must select concert or festival (as applicable) at least thirty (30) days in advance of the concert/festival date or forfeits the item. No refund or compensation will be made in the event of the cancellation or delay.  By claiming tickets, you agree to Live Nation’s Terms of Use and to abide by the health and safety measures in effect at the time of your event, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should the event be cancelled, you will be notified as soon as reasonably possible. Resale tickets is prohibited. 

 

For concert tickets item:

A list of participating Live Nation produced and promoted concerts will be provided for the claimant to select one (1) concert. Claimant must select the concert prior to October 31, 2022.

 

For festival tickets items:

A list of participating Live Nation produced and promoted festivals will be provided for the claimant to select one (1) festival. Claimant must select the festival prior to October 31, 2022.

 

 

*1 “General Admission Festival Experience” includes two (2) GA tickets to one (1) festival as described above; and spending money of $1000.00 CAD will be awarded by the Sponsor. The ARV of each General Admission Festival Experience item is: $1,600.00 CAD.

 

*2 “VIP Festival Experience” is a trip for two (2) to attend a participating festival in Canada of claimant’s choice as described above. Trip to be completed no later than December 31, 2023, or as determined by the Sponsor. The trip includes: (a) round-trip, economy class airfare tickets for the claimant and their one (1) guest from a major airport near the claimant’s residence in Canada (as selected by Sponsor in its sole discretion) to a Canadian city; (b) four (4) nights’ standard hotel accommodations (based on double occupancy); (c) two (2) VIP tickets (see Live Nation terms in Rule 10 under Appendix B); and (d) one thousand Canadian dollars in spending money ($1000.00 CAD). The approximate retail value (“ARV”) of each VIP Festival Experience is: $3,500 CAD maximum. The ARV of the trip may vary depending on the claimant's residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Sponsor is not responsible for, and the claimant will not receive, the difference between the actual value of the trip at the time of award and the stated ARV in these Official Rules or in any promotion-related correspondence or materials. Specific travel arrangements and all trip details not specified herein will be made and determined in Sponsor’s sole discretion. Travel must originate from and end at the same airport. It is the claimant’s and guest’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification (including passport) at the time of travel. Flight schedules are subject to change without notice. Sponsor is not liable for any missed trip events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Should the trip claimant live within 400km of their chosen city, they will be given $500.00 CAD in lieu of flights, to assist in covering their own ground transportation. Claimant will be required to provide a credit card at time of accommodation check-in to cover incidentals. Claimant’s guest must be age of majority in their province or territory of residence or older at time of item redemption Sweepstakes draw. Any claimant that is only eighteen (18) travelling to a province/territory that has an age of majority of nineteen (19) must choose a guest who is at least 19 years of age.

 

 

*3 “VIP Miami Experience” is a trip for two to Miami, Florida to attend the Coi LeRay performance. The trip includes: (a) round-trip, economy class airfare tickets for the VIP Miami Experience claimant and their one (1) guest from a major airport near the claimant’s residence in Canada (as selected by Sponsor in its sole discretion) to Miami, Florida; (b) three (3) nights’ standard hotel accommodations (based on double occupancy); (c) two (2) VIP tickets to Coi LeRay performance in Miami, FL scheduled to take place on December 2, 2022; and (d) one thousand Canadian dollars in spending money ($1000.00 CAD). The approximate retail value (“ARV”) of the VIP Miami Experience is: $3,500 CAD maximum. The ARV of the VIP Miami Experience may vary depending on the claimant’s residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Sponsor is not responsible for, and the claimant will not receive, the difference between the actual value of the trip at the time of award and the stated ARV in these Official Rules or in any promotion-related correspondence or materials. Specific travel arrangements and all trip details not specified herein will be made and determined in Sponsor’s sole discretion. Travel must originate from and end at the same airport. It is the claimant’s and guest’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification (including passport) at the time of travel. Collect and Redeem experiences will be fulfilled in 2023, except the Miami experience which may be fulfilled near the end of 2022 unless circumstances beyond the Sponsor’s control arise.

 

The approximate retail values set out above are based on approximate values in Canada at the time of printing these Official Rules. All characteristics and features of the items, except as otherwise explicitly outlined above, will be determined by Sponsor in its sole and absolute discretion. Collect and Redeem items are while supplies last.

 

12. Collect and Redeem item suppliers are independent parties over which Sponsor does not exercise any control. Sponsor is not responsible for the acts or omissions of these suppliers nor does it assume responsibility for any warranty, claims, losses, damages, costs, expenses, delays or loss of enjoyment to any participant.

13. Each item must be accepted as awarded, and may not be assigned, substituted or redeemed for cash value. In case of the unavailability of any Collect and Redeem item, Sponsor reserves the right to substitute an item of equal or greater value. 

14. All claimed CODEs become the property of the Sponsor and will not be returned.

 

 

SECTION 2: SWEEPSTAKES OFFICIAL RULES

Text to Enter for a VIP Festival Access Trip

 

BY SUBMITTING AN ENTRY TO THIS SWEEPSTAKES DURING THE SWEEPSTAKES ENTRY PERIOD, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. AMONG OTHER THINGS, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU TO THE PROMOTION ENTITIES, A LIMITATION OF YOUR RIGHTS AND REMEDIES, AND REQUIREMENT TO ARBITRATE ALL DISPUTES.

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN A PRIZE.

 

A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID OUTSIDE CANADA, AND WHERE PROHIBITED OR RESTRICTED BY LAW.

 

 

15. How to Enter the Sweepstakes

There are two (2) methods of Sweepstakes entry:

 

(i) No Purchase Necessary. To receive one (1) entry without a purchase, during the Promotion Period, submit an original hand-written essay by sending an email with a scan or legible photo of the essay to [email protected] that includes: (a) The email subject line: “Why I want to win the VIP Festival Access trip”; (b) a three hundred (300) word or more, unique and original hand-written essay on “Why I want to win the VIP Festival Access trip” (an “Essay”); and (c) your first name, last name, telephone number, complete mailing address, and date of birth. Each Sweepstakes entrant who submits an approved Essay submission will be emailed one (1) alphanumeric CODE, while supplies last. Follow Step 2 below to enter and be eligible for winning a Grand Prize. No photocopies of a previously submitted Essay with hand-edits or computer-made will be accepted. Each Essay must be an original and submitted as above. Any Essays judged to be copies or are fraudulent in any way will disqualify all entries into the Sweepstakes by that person. Sponsor’s decisions are final.

 

(ii) Entering the Sweepstakes: To enter, complete the following steps:

Step 1: Purchase any 473 mL Monster Energy® product with a silver tab (see Appendix A);

Step 2: Scan QR code on pack or printed on point-of-sale materials found in stores and follow these steps, or go to the contest link @: monsterenergycontests.com/qr;

Step 3: Register by filling in the required fields and accept the GOcxm terms and conditions, or log in. Regular text messaging rates, airtime, data, and carrier charges may apply, OR scan the QR. Participants will be required to consent to receiving electronic messages, and the collection, use, storage, and disclosure, of their personal information by Sponsor and GOcxm for the purposes of the Sweepstakes via text message to complete their entry;

Step 4: Enter the alphanumeric CODE from under the participating silver tab (or in the case of entry without purchase, the alphanumeric CODE provided for an approved Essay);

Step 5: Each unique CODE entered automatically receives one (1) entry into the Sweepstakes. There is no limit to entering the Sweepstakes multiple times per day, by either method, as long as each entry is original.

 

16. Regular text messaging rates, airtime, data, and carrier charges may apply; no other costs or other obligation will be incurred, by entering the Sweepstakes. These official rules can be found at: https://monsterenergyrules.com/summermusic

17. All entries must be received during the Promotion Period. Entries which are incomplete, late, lost, irregular in any way or sent by an unauthorized method are void and will not be eligible or accepted at the time of the draw. Only one (1) mobile phone number may be used by any one person to participate in this Sweepstakes. Any personal information submitted will be used for the purposes of administering this Sweepstakes only.

18. Entries will only be accepted as described herein and will not be accepted by any other means. The potential winner will be identified as the authorized account holder of the phone number used to enter the Sweepstakes.

 

19. Grand Prize Descriptions

Grand Prize trips: There are three (3) “Canadian Grand Prizes” and one (1) “Miami Grand Prize”, a total of four (4) Grand Prize trips available to be won.

 

“Canadian Grand Prize” description: Each Canadian Grand Prize is a trip to a Canadian city to attend a music festival of winner’s choice. Trip to be completed by December 2023, or as determined by the Sponsor. The trip includes: (a) round-trip, economy class airfare tickets for the Grand Prize Winner and their one (1) guest from a major airport near the Grand Prize Winner's residence in Canada (as selected by Sponsor in its sole discretion) to a Canadian city; (b) four (4) nights’ standard hotel accommodations (based on double occupancy); (c) two (2) VIP tickets to a participating Canadian music festival as chosen by winner and as described above (see Live Nation terms in Rule 10 under Appendix B); and (d) one thousand Canadian dollars in spending money ($1000.00 CAD). Should any Canadian Grand Prize winner live within 400km of their chosen city, they will be given $500.00 CAD in lieu of flights, to assist in covering their own ground transportation. Any Canadian Grand Prize winner that is only eighteen (18) travelling to a province/territory that has an age of majority of nineteen (19) must choose a guest who is at least 19 years of age.

 

“Miami Grand Prize” description: The Miami Grand Prize is a trip for two to Miami, Florida to attend the Coi LeRay performance. Trip to be completed by December 31, 2022, or as determined by the Sponsor. The trip includes: (a) round-trip, economy class airfare tickets for the Miami Grand Prize winner and their one (1) guest from a major airport near the winner’s residence in Canada (as selected by Sponsor in its sole discretion) to Miami, Florida; (b) three (3) nights’ standard hotel accommodations (based on double occupancy); (c) two (2) VIP tickets to Coi LeRay performance in Miami, FL scheduled to take place on December 2, 2022; and (d) one thousand Canadian dollars in spending money ($1000.00 CAD). In the event the Miami Grand Prize winner is under the age of twenty-one (21) years of age they will not be awarded the trip. As the event venue has an age restriction and is only open to people who are at least 21, they will be awarded the prize value of $3500.00 CAD in lieu of the trip, or a Canadian Grand Prize of the same ARV.

20. From time to time herein, the Prizes may be individually referred to as a “Prize” and collectively the “Prizes”.

21. Prize suppliers are independent parties over which Monster does not exercise any control. Monster is not responsible for the acts or omissions of these suppliers nor does it assume responsibility for any warranty, claims, losses, damages, costs, expenses, delays or loss of enjoyment to any prize winner.

22. Each Prize must be accepted as awarded, and may not be assigned, substituted or redeemed for cash value. In case of the unavailability of any prize, Monster reserves the right to substitute a prize of equal or greater value.

 

Prize Draws

23. A random draw from all eligible entries will be made by Sponsor’s SMS provider, GOcxm, on September 10, 2022. The draw will take place at GOcxm, 670 Caledonia Rd., 2nd Floor, Toronto, ON M6E 4V9, at approximately 3:00 PM ET, to select four (4) potential Grand Prize winners. 

 

Odds

24. The odds of winning a Grand Prize in this Sweepstakes depends on the total number of valid entries received during the Promotion Period. Limit of one (1) Grand Prize per household.

 

Requirements of Potential Winners

25. To be declared a potential Grand Prize winner, the selected entrant who is eligible for such Prize will be required to correctly answer unaided (mechanical or otherwise), a time-limited mathematical skill-testing question at a predetermined mutually convenient time. Following the draw described herein, the selected entrant will be contacted by email or by phone at the telephone number provided by the entrant. If the selected entrant cannot be reached personally without leaving a message by telephone within two (2) business days of the first phone call made and after a minimum of two (2) attempts by a Sponsor representative, and if such selected entrant fails to execute and return a declaration and release form within five (5) business days from the date of receipt thereof, or if they do not otherwise comply with these Official Rules, his or her entry will be forfeited and the next selected entrant drawn will be contacted on the third (3rd) day and such process may be repeated at the discretion of the Sponsor.

26. As a condition of winning and accepting receipt of a Grand Prize, winners and their guest must sign a declaration and release (waiver), in the form requested by Monster, confirming compliance with the Sweepstakes Official Rules, acceptance of the prize as awarded, and releasing Monster, Live Nation, and all the Promotion Entities.

General Rules

30. By participating and/or entering this Promotion and Sweepstakes, entrants agree to comply with these Official Rules and with the decisions of Sponsor and the Administrator as they relate thereto.

31. By entering the Sweepstakes, the Grand Prize winners agree to sign a waiver, as described above. In addition, Grand Prize winners agree to the use of their name, place of residence and image in any publicity carried out by Sponsor without compensation.

32. By accepting any prize in connection with this Sweepstakes, winners agree to release, remise and forever discharge Sponsor, Promotion Entities, Live Nation, participating prize providers, promotional agencies, franchisees, retailers, distributors, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution, production, or fulfillment of this Promotion, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively “Released Parties”), from and against any and all liability claims, costs, injuries, losses or damages of any kind incurred in connection with the delivery, installation, use and consumption of any Prize.

33. Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete entries, CODEs, codes and release documents or for any problems or failures. Sponsor is not responsible for any incorrect or inaccurate information, or by any technical or human error, which may occur in the processing of entries in the Sweepstakes, or in claiming of Collect and Redeem items. If, for any reason, the Promotion is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion or cause it to not comply with any applicable law having jurisdiction over Sponsor, then, subject to regulatory approval when required, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion without notice.

34. Sponsor reserves the right to disqualify any entrant who it finds to be in violation of these Official Rules or tampering with the Promotion process. Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Any attempt by anyone to deliberately undermine the legitimate operation of this Promotion is in violation of criminal and civil laws and Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.

35. All decisions of Sponsor in connection with this Promotion are final and binding in all respects. Each Prize must be accepted as awarded. Each Prize is non-transferable.

36. All entries become the property of Monster Energy Canada Ltd. and will not be returned.

37. This Promotion and the terms and conditions contained in these Official Rules, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein.

38. This Promotion is subject to all applicable federal, provincial and municipal laws and is void where prohibited.

40. Quebec Residents only (regarding the Sweepstakes): Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping parties reach a settlement.

41. For residents of all provinces, excepting Quebec: All disputes, disagreements, controversies, questions or claims arising out of or relating to this Promotion, including, without limitation, with respect to its execution, validity, application, interpretation, performance, breach, termination or enforcement (“Disputes”), shall be (a) resolved individually, without resort to any form of class action, and (b) shall be determined by a sole Arbitrator (the “Arbitrator”) under the Arbitration Act, 1991 (Ontario) (the “Act”). The resolution of Disputes pursuant to this section shall be final and binding upon the parties, and there shall be no appeal therefrom, including, without limitation, any appeal to a court on a question of law, a question of fact or a question of mixed fact and law. In addition: (a) section 7(2) of the Act will not apply to the arbitration; (b) unless the parties otherwise agree, the Arbitrator will be appointed by a judge of the Superior Court of Justice of Ontario on the application of any party on notice to all the other parties. No individual shall be appointed as Arbitrator unless they agree in writing to be bound by the provisions of this Article; (c) the arbitration shall take place in the City of Toronto unless otherwise agreed in writing by the parties; (d) subject to the Act, the Arbitrator may conduct the arbitration in the manner the Arbitrator considers appropriate; (e) the language to be used in the arbitration shall be English; (f) within seven (7) calendar days after appointment the arbitrator shall set the hearing date, which shall be within ninety (90) calendar days after the filing date of the demand for arbitration unless a later date is required for a good cause shown. The parties agree to a mutual exchange of relevant documents and the taking of up to a maximum of five (5) depositions by each party to last no more than two (2) calendar days in aggregate for each party; (g) the parties desire that any Dispute should be conducted in strict confidence and that there shall be no disclosure to any person of the existence of the Dispute or any aspect of the Dispute except as is necessary for the resolution of the Dispute; and (h) the Arbitrator shall have the right to determine all questions of law and jurisdiction, including questions as to whether a claim is arbitral, and shall have the right to grant legal and equitable relief including injunctive relief and the right to grant permanent and interim injunctive relief, and final and interim damages awards. The Arbitrator shall also have the discretion to award costs, including reasonable legal fees and expenses, reasonable expert's fees and expenses, reasonable witnesses' fees and expenses pre-award and post-award interest and costs of the arbitration.
