Promotion Rules

MONSTER ENERGY PROMOTION - UNLOCK THE GEAR TERMS AND CONDITIONS 1. Participation in this Monster Energy Unlock the Gear promotion (Promotion) is deemed acceptance of these and any other applicable terms and conditions (Terms and Conditions). For reasons beyond the Promoter’s reasonable control, it may be necessary for the Promoter to amend or include additional terms and conditions. Any amendments or additional terms and conditions will be posted at PROMOTION 2. The Promoter of this Promotion is Coca-Cola Europacific Partners New Zealand Limited, The Oasis, Mt Wellington, Auckland (“CCEP”) (Promoter). 3. Monster Energy AU Pty Ltd. is not the promoter of the Promotion. The Monster Energy brand names, logos and/or materials are used for the purposes of promotion and/or prize descriptions only and such use is not intended to suggest or imply Monster Energy AU Pty Ltd’s sponsorship of this Promotion. 4. Information regarding redemption products and how to enter the Promotion forms part of these Terms and Conditions. 5. You must be living in New Zealand and aged 18 years or older to participate. 6. Employees of the Promoter and any agency associated with the Promotion, and the immediate families of such employees, are ineligible to enter. The Promoter’s decision as to eligibility will be final. HOW TO ENTER 7. The Promotion begins at 12.00am (NZST) on 03 July 2023 and ends at 11:59pm (NZDT) on 01 October 2023 (Promotion Period) or while stocks last. No redemptions will be accepted outside the Promotion Period. 8. Buy any 305ml or 500ml can of Monster Energy (all variants) that has the distinctive Monster Claw marked can opening tab (Can Tab) from a participating store displaying the promotional material (Participating Store) during the Promotion Period and collect the Can Tab. Collect ten (10) Can Tabs in order to receive one pair of Monster Energy socks, collect ten (10) Can Tabs in order to receive one Monster Energy beanie and collect fifteen (15) Can Tabs in order to receive one Monster Energy cap (the Redemption Products). For a list of all Participating Stores see 9. Once you have collected the required number of Can Tabs to redeem a Redemption Product, simply return the Can Tabs to a Participating Store during the Promotion Period to claim your Redemption Product. 10. A person may redeem Can Tabs for Redemption Products multiple times across Participating Stores, subject to a maximum number of two Redemption Products per person per Participating Store, providing they have a requisite number of Can Tabs and redeem during the Promotion Period. 11. Each Participating Store will have an allocation of Redemption Products available. Once Participating Stores run out of allocated Redemption Products, the Promotion will end in the specific stores. REDEMPTION PRODUCT DETAILS 12. There will be 49,038 Redemption Products available across 1000 Participating Stores nationwide. 13. Redemption Products Breakdown; a. 8,310 Monster Energy beanies (one size), estimated value per item, $30NZD. b. 25,728 Monster Energy socks (one size), estimated value per item, $30NZD. c. 15,000 Monster Energy caps (one size), estimated value per item, $60NZD. 14. Estimated total value NZD $1,921,140. Redemption Products are unavailable for retail purchase, so these values are estimates only. REDEMPTION CONDITIONS 15. Participants have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill. These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Redemption Products as part of this Promotion and will not be responsible for breach of such representations or warranties. 16. Redemption Products must not be sold, used, donated or given away as part of another promotion. Redemption Products are not exchangeable and cannot be redeemed as cash. 17. If the Redemption Products are unavailable for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute products, with a substitute product of equal or greater value. 18. Participants may be required to show proof of age to verify eligibility. GENERAL 19. Participants must comply with all requirements of the Promoter including requirements specified in the Terms and Conditions. If a participant takes part in or attempts to take part in the Promotion in a manner, which in the Promoter’s opinion, is contrary to these Terms and Conditions, does or could damage the goodwill or reputation of the Promotion and/or Promoter, or is fraudulent or unjust to other participants (such as hacking, cheating, deception, or any other unfair practices), the Participating Store may refuse to redeem the participant’s Can Tabs in its sole and reasonable discretion. 20. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures, governmental restraint, order or regulation or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right, in its sole reasonable discretion, to cancel, terminate, modify or suspend the Promotion. Any cancellation, termination, modification or suspension of the Promotion will be notified at 21. The Promoter (including its officers, employees and agents) excludes all liability (including negligence) for claims, losses (including loss of opportunity), damages, injuries, costs and/or expenses, whether direct, indirect, special or consequential, suffered, sustained or incurred as a result of, or arising in any way out of, or in any way connected with, the Promotion or any Redemption Products, except for any liability that cannot be excluded by law (in which case that liability is limited to the greatest extent allowed by law). 22.
