Monster Energy Company (“Monster”) is offering the “Monster Energy® Chance to Win a Dominoes Prize Package Sweepstakes (AOM)” (the “Sweepstakes”). The Sweepstakes is subject to these official rules (the “Official Rules”), and by entering, entrant (“Entrant”) agrees to be bound by them and the decisions of Monster, which are final and binding in all respects. This Sweepstakes begins at 12:01 AM US Pacific Time on January 1, 2023 and ends at 11:59 PM US Pacific Time on February 28, 2023 (the “Entry Period”). Monster’s computer is the official timekeeping device for entry in the Sweepstakes. All entries must be received by 11:59 PM PST on March 3, 2023.

1. Eligibility: The Sweepstakes is open to persons who are legal residents of, and physically located within, the state of Florida, who are eighteen (18) years of age or older at the time of entry. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Employees, officers and representatives and members of the immediate families (i.e., parents, spouses, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of Monster, Orbit Fulfillment (the “Administrator”), and their respective affiliated companies, parent companies, subsidiaries, participating promotional partners, retailers, distributors, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution, production, or fulfillment of the Sweepstakes (the “Sweepstakes Entities”) are not eligible. All entries submitted in compliance with these Official Rules and not disqualified or void are considered “Eligible Entries”. All entries are the property of Monster.

2. How To Enter: There are two (2) methods of Sweepstakes entry:

Entry by Purchase: Purchase any two (2) 16/15.5 fl. oz. single cans of Monster Energy® product from a participating retailer in a single transaction during the Entry Period and save your purchase receipt. Scan the QR code located on the point of sale display at the participating retailer or visit www.monsterenergy.com/dominoes, upload a photo of your receipt and complete the official online entry form during the Entry Period to receive one (1) Sweepstakes entry. You will only receive one (1) Sweepstakes entry regardless of the number of cans of Monster Energy® product purchased in excess of two (2) cans in a single transaction and per valid receipt. Save original purchase receipt in the event you are a winner.

MAIL-IN: To enter without purchase. To obtain an entry by mail, Entrants must hand print their first and last name, residence address, telephone number, e-mail address, date of birth, and your signature to certify your eligibility to participate in the program, consent to and compliance with these Official Rules and all applicable regulations, on a 3”x5” card, place the card in an envelope with proper first-class postage affixed, and mail the envelope to “Monster Energy Chance to Win a Dominoes Prize Package Sweepstakes (AOM)” c/o Orbit Fulfillment PO Box 291944, Nashville, TN 37229. Mailed entries must be postmarked between 12:01 a.m. US Pacific Time on January 1, 2023, and 11:59 p.m. US Pacific Time on February 28, 2023, and received by 11:59 p.m. US Pacific Time on March 3, 2023. There is a limit of one (1) 3”x5” card per mailing envelope. A mailed entry submitted in accordance with these Official Rules will result in the Entrant obtaining one (1) entry in the Sweepstakes.

General Entry Terms and Conditions. There is no limit on the number Eligible Entries Entrants may submit during the Promotional Period, regardless of entry method. For purposes of this Sweepstakes, a “day” begins at 12:01 a.m. US Pacific Time and ends at 11:59 p.m. US Pacific Time. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Monster’s sole and absolute discretion. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information or otherwise may be disqualified. The Sweepstakes Entities are not responsible for technical failures of any kind, including, but not limited to, the malfunctioning of any wireless network, telephone, computer, computer network, hardware or software or the unavailability or inaccessibility of any service. The Sweepstakes Entities are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's handset to receive messages. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Monster may be disqualified. All materials submitted become the property of Monster and will not be returned. Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Normal time rates, if any, charged by the Entrants’ Internet service or mobile provider will apply.

The odds of winning depend on the total number of Eligible Entries received within the Entry Period.

3. Prizes: Thirty (30) prizes are available to be won.

Grand Prize: Five (5) Grand Prizes are available. Each “Grand Prize” is one (1) Monster Energy® domino table and one (1) Monster Energy® double nine dominoes set. ARV of the Grand Prize is $224.00. ARV of all Grand Prizes is $1,120.00.

First Prize: Twenty-Five (25) First Prizes are available. Each “First Prize” is one (1) Monster Energy® guayabera shirt. ARV of each First Prize is $30.00. ARV of all First Prizes is $750.00.

4. Winner Selection and Notification: On or about March 10, 2023, the potential “Winners” will be determined via a random drawing, from all Eligible Entries received. Entrants need not to be present for the drawing to win. Each potential Winner will be notified within three (3) business days of the drawing. Each potential Winner will be notified by email (at the email address provided with the entry) and will be required to confirm his/her e-mail address. Potential Winners who entered through the entry by purchase method must provide the original copy of the winning purchase receipt. A prize won by an Entrant will be awarded to the authorized account holder of the e-mail address submitted with the entry regardless of the individual who submitted the winning entry. If a potential Winner cannot be reached after a reasonable effort has been exerted or fails to respond within three (3) days of the date of notification, or if a prize or prize notification is returned as undeliverable, the potential Winner forfeits the prize, and an alternate potential Winner will be randomly drawn from all remaining Eligible Entries. If the alternate potential Winner is unable to accept the prize, the prize is forfeited and another alternate potential Winner will be randomly drawn from all remaining Eligible Entries. This Winner selection and notification process shall be continued until a Winner is confirmed for each prize.

5. Winner Verification: Within three (3) days of being notified of being a potential Winner, each potential Winner may be required to complete, sign, and return documentation required by Monster — including a notarized Affidavit of Eligibility, release of liability, and a publicity release form (except where prohibited). Provided that a potential Winner is in compliance with the Official Rules and after having successfully proven eligibility and provided any documentation required by Monster, the potential Winner will be determined to be a Winner. Monster expressly reserves the right to delay the announcement of the Winners for any reason it deems necessary. In addition, Monster reserves the right to select alternate Winners in the event that any potential Winner fails to comply with these Official Rules.

If, for any reason, more bona fide winners come forward seeking to claim a prize in excess of the five (5) Grand Prizes and twenty-five (25) First Prizes available as set forth in these Official Rules, the Winner of the prize(s) available may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. The Sweepstakes Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected or unsuccessful efforts to notify the potential Winners.

6. Liability Release and Indemnity: By entering the Sweepstakes, Entrant agrees that Monster, any other Sweepstakes Entities, and each of their respective parents, subsidiaries, affiliated companies, employees, officers, directors, shareholders, agents, retailers, distributors and representatives are indemnified, released and will be held harmless by Entrant from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of a prize. Each prize is offered and provided “as is” with no warranty or guarantee by Monster, either express or implied. Any and all warranties and/or guarantees on the prizes (if any) are subject to the manufacturer’s terms therefore, and winner agrees to look solely to such manufacturer(s) for any such warranty and/or guarantee. By participating in the Sweepstakes, each Winner acknowledges that the Sweepstakes Entities have not and will not obtain or provide insurance of any kind relating to the prizes.

Entrants agree to indemnify, defend, and hold harmless the Sweepstakes Entities from any and all liability arising out of or relating in any way to Entrant’s participation in the Sweepstakes and to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities arising out of participation in the Sweepstakes, use of the Sweepstakes website(s), or receipt or use of any prize, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property (including to any computer systems resulting from participation in or accessing or downloading information in connection with the Sweepstakes), which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use of any prize. Entrants assume all liability for an injury or damage caused, or claimed to be caused, by participation in this Sweepstakes, the use of any Sweepstake website(s), or the acceptance, receipt, or use of any prize or prize component. Entrants further agree that in any cause of action, the Sweepstakes Entities’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Entities be liable for attorney’s fees.

The Sweepstakes Entities assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, altered, tampered with, unauthorized, fraudulent, damaged, destroyed, delayed, misdirected, not delivered, not received, or that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in Sweepstakes, or by any human, mechanical or electronic error that may occur in the processing of the entries in Sweepstakes, or other errors appearing within the Official Rules or in any Sweepstakes related advertisements. The Sweepstakes Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Sweepstakes, errors in processing entries, identifying the Winners, in the announcement of the prizes and Winners, the delivery of the prizes, any problems or technical malfunction of any telephone network or lines, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any website, or any combination thereof, including, without limitation, any injury or damage to Entrant’s or any other person’s computer system or software related to or resulting from participation in, uploading any materials or downloading any materials in the Sweepstakes. Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void. Monster reserves the right in its sole discretion to disqualify any person it suspects or finds: (i) to have tampered with the entry process or the operation of the Sweepstakes; (ii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring such Winner or the Sweepstakes Entities into disgrace (e.g., including but not limited to, a person committing acts of moral turpitude, and/or allegations or convictions of any crime); (iv) to have provided inaccurate information on any legal documents submitted in connection with the Sweepstakes; or (v) to be acting in violation of these Official Rules. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.

7. Prize Terms: Total ARV of all prizes offered in the Sweepstakes will not exceed $1,870.00 U.S.D. The ARV is subject to change based upon current market conditions at the time of prize fulfillment. Any difference between the ARV and the actual value, if any, will not be awarded. Limit one (1) prize per Winner. All prize details not specified in these Official Rules will be determined in Monster’s sole discretion. The date for fulfillment of the prizes is anticipated to be on or around June 30, 2023; but all subject to change in Monster’s sole discretion. If for any reason a prize is unavailable or any prize or related event is delayed, cancelled or postponed, or for any other reason, Monster reserves the right to modify the Sweepstakes in its sole discretion and award a substitute prize, or portion of a prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of a prize, or any portion thereof, is permitted by a Winner. The Sweepstakes Entities shall have no responsibility or obligation to a Winner who is unable or unavailable to, or who does not for any reason, accept or utilize a prize. In the event a potential Winner cannot accept a prize, an alternate Winner will be randomly drawn from all remaining Eligible Entries. Each prize is provided “as is”. Entrants acknowledge that the Sweepstakes Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including any express warranties provided by any prize supplier that are sent along with a prize and any implied warranty of merchantability of fitness for a particular purpose. Any prize pictured in online, television and print advertising, promotional packaging and other Sweepstakes materials are for illustrative purposes only.

The value of a prize will be taxable to the Winner as income. An IRS Form 1099 and W9 will be issued in the name of the Winner for the actual value of the prize awarded. All U.S. federal, state and local tax liability, and any other costs and expenses associated with acceptance or use of a prize not specifically provided for in these Official Rules are solely the Winner’s responsibility.

8. Grant of Rights. By entering, Entrant irrevocably consents to the use of his or her name, image, photograph, likeness, biographical information, and any video footage related to the prize, for Monster’s advertising, promotional or other commercial purposes in all media now or hereafter known, worldwide and in perpetuity without additional compensation, unless prohibited by law.

General Terms. By entering the Sweepstakes, Entrants: (a) agree to be bound by these Official Rules and by the interpretation of these Official Rules by Monster and by the decisions of Monster, which are final and binding in all respects; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (d) agree to release and hold harmless the Sweepstakes Entities from and against any claims, injury or damages arising out of or relating to participation in the Sweepstakes and/or the use, misuse or redemption of a prize, and for any claim including claims based upon defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property-related cause of action arising from or related to the Sweepstakes, the prizes, or Monster’s advertising and marketing related to the Sweepstakes, Entrants or the Winners. Winning a prize is contingent upon fulfilling all requirements set forth herein.

The Sweepstakes Entities are not responsible if the Sweepstakes cannot take place or is delayed, or if any Prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, government mandated lockdowns, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, other force majeure events or other events outside of the reasonable control of the Sweepstakes Entities. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sweepstakes Entities, which, in Monster’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Monster reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes or any part of the Sweepstakes. If the Sweepstakes or any part of the Sweepstakes is terminated or modified prior to the closing date of the Sweepstakes, notice will be posted on www.monsterenergy.com if time permits and the prizes will be awarded to a potential Winners to be selected in a random drawing from among all of the remaining uncorrupted Eligible Entries received prior to any such event outside of the reasonable control of Monster. Monster reserves the right to modify, withdraw and replace or amend these Official Rules from time to time during the Sweepstakes or thereafter including to modify and amend the Entry Period and/or the manner, timing and number of draw of lots.

The Sponsor and the Administrator will not be responsible or liable for failure to receive entries due to transmission failures or technical failures of any kind, including without limitation, electronic malfunction of any network, hardware or software. Proof of submission does not constitute proof of entry. The Sponsor and the Administrator reserve the right in their sole discretion to cancel or suspend the Sweepstakes should viruses, bugs or other causes beyond its control corrupt the administration, security or proper play of the Sweepstakes. In the event of cancellation of any Sweepstakes, the prizes (or a portion thereof, as determined by Monster in its sole discretion) will be awarded in a random drawing from eligible entries received prior to cancellation.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, MONSTER RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Monster’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on a website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Monster’s sole and absolute discretion.

10. Privacy: All information submitted by Entrants and collected by Monster in connection with Entrant’s entry will be subject to and will be treated in a manner consistent with Monster’s web site Terms of Use accessible at: https://www.monsterenergy.com/terms-of-use and Monster’s privacy policy available at: https://www.monsterenergy.com/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree that Monster may collect and use their personal information submitted with the entry. Among other things, the information you provide may be used to send you company updates and announcements from Monster concerning products and promotions that may be of interest to you. By participating in the Sweepstakes, Entrants hereby agree that Monster may share their personal information submitted with the entry for the purposes of winner selection and fulfillment.

11. BINDING ARBITRATION: EXCEPT WHERE PROHIBITED BY LAW, ENTRANT AGREES: (1) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE SWEEPSTAKES OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE SWEEPSTAKES OR ANY PRIZE AWARDED SHALL BE RESOLVED BY BINDING ARBITRATION CONDUCTED BY JAMS IN ACCORDANCE WITH JAMS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES (THE “JAMS RULES”); (3) ANY ARBITRATION SHALL BE HEARD BY ONE ARBITRATOR TO BE SELECTED IN ACCORDANCE WITH THE JAMS RULES, IN ORANGE COUNTY, CALIFORNIA; (4) JUDGMENT UPON ANY AWARD RENDERED MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF; AND (5) ANY AWARD OR JUDGMENT SHALL BE SUBJECT TO ALL LIMITATIONS AND RELEASES SET FORTH IN THESE OFFICIAL RULES AND BE LIMITED TO ACTUAL OUT OF POCKET DAMAGES, AND SHALL NOT, IN ANY EVENT, INCLUDE ANY PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ATTORNEYS’ FEES OR COSTS OF BRINGING A CLAIM, OR ANY INJUNCTIVE OR OTHER EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

12. Governing Law: All federal, state and local laws and regulations apply. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Monster in connection with the Sweepstakes, shall be governed by, and construed in accordance with, California law without giving effect to any choice of law or conflict of laws rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.

13. Request for Names of Winners and Official Rules: All requests for a copy of the Official Rules and for the name of the Winners must be made by February 28, 2023. For the name of the Winner and/or Official Rules: (i) send a self-addressed, stamped envelope postmarked to Monster Energy Chance to Win a Dominoes Prize Package Sweepstakes (AOM), PO Box 290904, Nashville, TN 37229; and (ii) write “Winners Names” and/or “Official Rules” on the lower left hand corner of the envelope.

Monster Energy Company («Monster») ofrece el «Sorteo de Monster Energy® para optar a ganar un lote de premios de dominó (AOM)» (el «Sorteo»). El Sorteo está sujeto a estas normas oficiales (las «Normas oficiales») y mediante su inscripción, el participante («Participante») acepta quedar vinculado por estas y las decisiones de Monster, que son definitivas y vinculantes en todos los aspectos. Este Sorteo comienza a las 00:01 h. (Hora estándar del Pacífico o PST) del 1 de enero de 2023 y finaliza a las 23:59 h. (Hora estándar del Pacífico) del 28 de febrero de 2023 (el «Período de participación»). La computadora de Monster es el dispositivo que lleva la hora oficial para la participación en el Sorteo. Todas las inscripciones deben haberse recibido antes de las 23:59 h. PST del 3 de marzo de 2023.

1. Requisitos para la participación: el Sorteo está abierto a las personas mayores de dieciocho (18) años en el momento de la inscripción, que sean residentes y se encuentren físicamente en el estado de Florida. No cumplen los requisitos para participar en el Sorteo los empleados, encargados, representantes y los familiares directos de Monster (p. ej.: padres, cónyuges, hermanos, hijos, abuelos, padrastros, hijastros y hermanastros y sus respectivos cónyuges y las demás personas que vivan en la misma unidad familiar, tanto si existe parentesco como si no), Orbit Fulfillment (el «Administrador») y sus respectivas empresas filiales, matrices, subsidiarias, socios promocionales, minoristas, distribuidores, agencias de publicidad y promoción, administradores web y cualquier otra empresa involucrada en la creación, diseño, realización, producción o ejecución del sorteo (las «Entidades del sorteo»). Todas las inscripciones presentadas que cumplan estas Normas oficiales y no estén descalificadas o sean nulas se consideran «Inscripciones válidas». Todas las inscripciones son propiedad de Monster.

2. Cómo participar: hay dos (2) formas de participar en el Sorteo:

Mediante compra: compre dos (2) latas de 15/16.6 onzas líquidas de un producto de Monster Energy® en un minorista participante en una sola transacción durante el Periodo de participación y guarde el comprobante de compra. Escanee el código QR que se muestra en la pantalla del punto de venta del minorista participante o visite www.monsterenergy.com/dominoes, cargue una foto del justificante y rellene el formulario de inscripción oficial en línea durante el Periodo de participación para recibir una (1) inscripción en el Sorteo. Solo recibirá una (1) inscripción en el Sorteo con independencia de si ha comprado más de dos (2) latas de un producto de Monster Energy en una sola transacción y por justificante válido. Guarde el justificante de compra original en caso de que gane uno de los premios.

Para participar por correo postal, los participantes deben escribir en mayúsculas su nombre y apellidos, la dirección postal de su domicilio, el número de teléfono, la dirección de correo electrónico, la fecha de nacimiento y la firma en una tarjeta de 3” x 5” para certificar que cumplen los requisitos para participar en el programa, dan su consentimiento y cumplen con estas Normas oficiales y todas las normativas vigentes; colocar la tarjeta en un sobre con el franqueo correcto correspondiente y enviarlo a «Sorteo de Monster Energy para optar a ganar un lote de premios de dominó (AOM)», a la atención de Orbit Fulfillment, Apartado postal 291944, Nashville, TN, 37229. Las inscripciones enviadas por correo postal deben tener una fecha de franqueo entre las 00:01 h. PST del 1 de enero de 2023 y las 23:59 h. PST del 28 de febrero de 2023 y deben haberse recibido antes de las 23:59 h. PST del 3 de marzo de 2023. Solo se podrá incluir una tarjeta de 3”x5” por sobre enviado. Con una inscripción enviada de conformidad con estas Normas oficiales el Participante obtendrá una (1) inscripción en el Sorteo.

Condiciones generales para la participación. El número de inscripciones que los participantes pueden presentar durante el Periodo de la promoción es ilimitado, independientemente del método usado. Para fines de este Sorteo, un «día» comienza a las 00:01 h. PST y termina a las 23:59 h. PST. Las inscripciones que superen los límites establecidos, sean incompletas o ilegibles, estén dañadas, se hayan alterado, destruido, falsificado, perdido, lleguen tarde o se hayan enviado a la dirección incorrecta, sean engañosas o no cumplan de algún otro modo las Normas oficiales pueden quedar descalificadas del Sorteo a discreción absoluta de Monster. Las inscripciones generadas por un script, programa informático o macro, estén programadas, automatizadas robóticamente o generadas por algún otro medio automático serán nulas y podrán descalificarse. Podrán descalificarse los intentos posteriores de presentar varias inscripciones mediante el uso de datos de contacto múltiples o falsos realizados por la misma persona. Las Entidades del sorteo no se responsabilizan de los fallos técnicos de ningún tipo que incluyen, entre otros, el mal funcionamiento de la red inalámbrica, el teléfono, la computadora, la red informática, el hardware o software o la falta de disponibilidad o inaccesibilidad de todo servicio. Las Entidades del sorteo no se responsabilizan de las comunicaciones electrónicas que no puedan entregarse debido a cualquier forma de filtrado activo o pasivo o a que el participante no tenga espacio suficiente en el terminal para recibir mensajes. Podrán quedar descalificados todos los participantes que no sigan las instrucciones, no proporcionen la información solicitada en su formulario de inscripción o no cumplan estas Normas oficiales u otras instrucciones de Monster. Todos los materiales proporcionados pasan a ser propiedad de Monster y no se devolverán. Las inscripciones ilegibles o incompletas y las presentadas por participantes que no cumplan los requisitos (incluidos los relativos a la edad y residencia) serán nulas. Se aplicarán las tarifas horarias normales, de haberlas, que cobre el proveedor de telefonía celular o servicios de Internet del participante.

La probabilidad de ganar dependerá del número total de Inscripciones válidas recibidas durante el Periodo de participación.

3. Premios: Se pueden ganar treinta (30) premios.

Gran premio: hay cinco (5) grandes premios. Cada «Gran premio» es una (1) mesa de dominó de Monster Energy® y un (1) juego de dominó cubano (o doble nueve) de Monster Energy®. El PVP aproximado del Gran premio es de 224.00 $. El PVP aproximado de todos los Grandes premios es de 1.120.00 $.

Primer premio: hay veinticinco (25) primeros premios. Cada «Primer premio» es una (1) guayabera de Monster Energy®. El PVP aproximado de cada Primer premio es de 30.00 $. El PVP aproximado de todos los Primeros premios es de 750.00 $.

4. Selección y notificación de los ganadores: el o alrededor del 10 de marzo de 2023 se determinarán los posibles «Ganadores» mediante un sorteo aleatorio de entre todas las Inscripciones recibidas que cumplan los requisitos. Los participantes no tienen que estar presentes en el sorteo para ganar. Se notificará a cada posible Ganador en el plazo de tres (3) días hábiles a partir del sorteo. Los posibles Ganadores recibirán la notificación por correo electrónico (en la dirección de correo electrónico proporcionada con la inscripción) y tendrán que confirmar su dirección. Los posibles Ganadores que hayan participado mediante el método de compra deben proporcionar el justificante original de la compra ganadora. El premio que haya ganado un participante se otorgará al titular autorizado de la cuenta de la dirección de correo electrónico proporcionada con la inscripción independientemente de la persona que haya presentado la inscripción ganadora. Si no se puede establecer contacto con un posible Ganador tras hacer un esfuerzo razonable o este no responde en el plazo de tres (3) días a partir de la fecha de notificación, o bien si la notificación o el premio se devuelve porque no se ha podido entregar, el posible Ganador perderá el premio y se elegirá otro posible Ganador alternativo de entre todas las demás Inscripciones que cumplan los requisitos. Si el posible Ganador alternativo no puede aceptar el premio, lo perderá y se elegirá otro posible Ganador alternativo de forma aleatoria de entre las Inscripciones restantes que cumplan los requisitos. El proceso de selección y notificación de los ganadores continuará hasta que se confirme un Ganador para cada premio.

5. Verificación de los ganadores: en el plazo de tres (3) días a partir de la notificación como posible Ganador, cada posible Ganador deberá rellenar, firmar y devolver la documentación requerida por Monster, incluida una declaración jurada ante notario de cumplimiento de los requisitos, exención de responsabilidad y formulario de cesión de derechos de imagen (excepto cuando esté prohibido). Siempre que un posible Ganador cumpla con las Normas oficiales y tras haber demostrado el cumplimiento de los requisitos y proporcionado la documentación requerida por Monster, se declarará que el posible Ganador es uno de los Ganadores. Monster se reserva expresamente el derecho a retrasar el anuncio de los Ganadores por cualquier motivo que considere necesario. Asimismo, Monster se reserva el derecho a seleccionar Ganadores alternativos en caso de que ninguno de los posibles Ganadores cumpla con estas Normas oficiales.

Si, por cualquier motivo, se presentan más ganadores de buena fe para reclamar un premio que superen los cinco (5) Grandes premios y los veinticinco (25) Primeros premios disponibles según lo establecido en estas Normas oficiales, el Ganador del / de los premio(s) disponibles se elegirá por sorteo aleatorio de entre todas las personas que hayan reclamado tal(es) premio(s) de forma supuestamente válida. En tales circunstancias, la inclusión en tal sorteo será el único y exclusivo recurso para cada participante. Las Entidades del sorteo no se responsabilizan de los intentos de notificación a los posibles Ganadores retrasados, perdidos, dañados, interceptados o enviados a una dirección errónea.

6. Exención de responsabilidad y compensación: al participar en el Sorteo, el Participante acepta indemnizar, liberar y exonerar de toda responsabilidad a Monster y cualquier otra Entidad del sorteo así como cada una de sus respectivas empresas matrices, subsidiarias o filiales, empleados, encargados, directores, accionistas, agentes, minoristas, distribuidores y representantes, por los daños, lesiones o pérdidas de cualquier tipo a la(s) persona(s) (incluida la muerte) o propiedad que se deriven de forma directa o indirecta de la aceptación, posesión, uso indebido o uso de un premio. Monster ofrece y proporciona todos los premios «tal cual» sin ninguna garantía, tanto implícita como explícita. Todas las garantías sobre los premios (si las hay) están sujetas a las condiciones del fabricante de estos y el ganador acepta dirigirse únicamente a dicho(s) fabricante(s) para tales garantías. Al participar en el Sorteo, cada Ganador acepta que las Entidades del sorteo no tienen y no obtendrán ni ofrecerán seguro alguno de cualquier tipo relativo a los premios.

Los participantes aceptan indemnizar, defender y exonerar a las Entidades del sorteo de toda responsabilidad que se derive o esté vinculada de algún modo con la participación del participante en el Sorteo y ceder todos los derechos a presentar una reclamación o demanda contra las Entidades del sorteo derivada de la participación en el Sorteo, el uso del sitio web del Sorteo o la recepción o uso de cualquier premio, entre otros: (a) la intervención humana no autorizada en el Sorteo; (b) los errores técnicos relacionados con las computadoras, servidores, proveedores o líneas de teléfono o red; (c) los errores de impresión; (d) el correo perdido, retrasado, el franqueo debido, el correo enviado a la dirección errónea o que no puede entregarse; (e) los errores en la administración del Sorteo o el procesamiento de las inscripciones o (f) la lesión o daño a las personas o la propiedad (incluidos los sistemas informáticos derivados de la participación o el acceso o descarga de información relativa al Sorteo), que podría estar provocado, directa o indirectamente, en su totalidad o en parte, por la participación del participante en el Sorteo o la recepción o uso de cualquier premio. Los participantes asumen toda la responsabilidad por los daños o lesiones provocados, o supuestamente provocados, por la participación en este sorteo, el uso del / de los sitio(s) web del sorteo o la aceptación, recepción o el uso de cualquier premio o componente del premio. Los participantes también aceptan que en cualquier demanda, la responsabilidad de las Entidades del sorteo estaría limitada al costo de la inscripción y participación en el Sorteo y, en ningún caso, serán responsables las Entidades del sorteo de los honorarios de los abogados.

Las Entidades del sorteo no aceptan ninguna responsabilidad y descalificarán las inscripciones que sean robadas, lleguen tarde, se hayan perdido, sean ilegibles, estén incompletas, no sean válidas, sean ininteligibles, estén modificadas, manipuladas, no estén autorizadas, sean fraudulentas, se hayan destruido, retrasado o enviado a la dirección errónea, no se hayan enviado, no se hayan recibido o contengan información incorrecta o inexacta, tanto si esto se debe a cualquier equipo o a la programación asociada con o usada en el Sorteo, como por cualquier error humano, mecánico o electrónico, u otros errores que aparezcan en las Normas oficiales o en cualquier anuncio relativo al Sorteo. Las Entidades del sorteo no se responsabilizan de ningún error tipográfico o de otro tipo en la impresión de la oferta, la administración del Sorteo, los errores en el procesamiento de las inscripciones, la identificación de los Ganadores, el anuncio de los premios y los Ganadores, la entrega de los premios, los problemas o mal funcionamiento técnico de la red o líneas telefónicas, sistemas informáticos, sistemas en línea, servidores o proveedores, equipos informáticos, software, los fallos del correo electrónico o reproductor debidos a problemas técnicos o congestión de tráfico en Internet o en algún sitio web o cualquier combinación de los anteriores, incluidos, entre otros, los daños o lesiones al sistema informático o software de los participantes o cualquier otra persona vinculados con o derivados de la participación, la carga de materiales o la descarga de materiales en el Sorteo. Está prohibido el uso de cualquier dispositivo para automatizar o sabotear la inscripción y toda inscripción que se reciba por tal medio será nula. Monster se reserva el derecho a su entera discreción a descalificar a toda persona que sospeche o piense que: (I) haya manipulado el proceso de inscripción o el funcionamiento del Sorteo; (ii) actúe de forma perjudicial o con la intención de molestar, abusar, amenazar u hostigar a cualquier persona; (iii) muestre tal comportamiento que haga que las Entidades del sorteo caigan en desgracia (p. ej.: la comisión de actos de vileza moral y las acusaciones o condenas por cualquier delito, entre otros); (iv) haya proporcionado información incorrecta en alguno de los documentos legales presentados en relación con el Sorteo o (v) haya incumplido estas Normas oficiales. EL INCUMPLIMIENTO DE ESTAS NORMAS OFICIALES POR PARTE DE UN GANADOR TENDRÁ COMO CONSECUENCIA LA DESCALIFICACIÓN DE TAL PERSONA COMO GANADOR DEL SORTEO Y SE RESCINDIRÁN TODOS LOS PRIVILEGIOS COMO GANADOR.

7. Condiciones del premio: El PVP aproximado total de todos los premios que se ofrecen en el Sorteo no será superior a 1,780.00 $ USD. El PVP aproximado está sujeto a cambios según las condiciones actuales del mercado en el momento de la entrega del premio. No se otorgará ninguna diferencia entre el PVP y el valor real, si la hay. Limitado a un (1) premio por Ganador. Todos los datos del premio no especificados en estas Normas oficiales los determinará Monster a su entera discreción. Se prevé que la fecha de la entrega de los premios será el o alrededor del 30 de junio de 2023. No obstante, está sujeta a cambios a entera discreción de Monster. Si un premio no está disponible por cualquier motivo o se retrasa, cancela o pospone, o por cualquier otro motivo, Monster se reserva el derecho de modificar el Sorteo a su entera discreción y otorgar otro premio suplente, parte de un premio de valor comparable o superior, según lo establecido en estas Normas oficiales. Un Ganador no puede obtener ningún reemplazo, transferencia, cesión o equivalente en efectivo de un premio, ni una parte de este. Las Entidades del sorteo no tendrán ninguna responsabilidad ni obligación ante un Ganador que no pueda o no esté disponible para aceptar o utilizar un premio, o que no lo acepte o utilice por cualquier motivo. En caso de que un posible Ganador no acepte un premio, se elegirá aleatoriamente otro Ganador alternativo de entre todas las demás Inscripciones que cumplan los requisitos. Todos los premios se ofrecen «tal cual». Los participantes aceptan que las Entidades del sorteo no han hecho ni son responsables de ningún modo de ninguna garantía, declaración o afirmación, explícita o implícita, de hecho o de derecho, relativa a un premio, incluidas las garantías expresas proporcionadas por el proveedor de cualquier premio que se envíen junto con un premio y cualquier garantía implícita de comerciabilidad o idoneidad para un fin concreto. Las imágenes de todo premio que se muestren en línea, en televisión y en publicidad impresa, embalaje promocional y otros materiales del Sorteo son únicamente para fines ilustrativos.

El valor de un premio estará sujeto a impuestos para el Ganador en concepto de ingresos. Se emitirá un formulario IRS 1099 y W9 a nombre del Ganador por el valor real del premio otorgado. 8. Concesión de derechos. Mediante su participación, el participante da su consentimiento irrevocable al uso de su nombre, imagen, fotografía, información biográfica y cualquier grabación de vídeo relativa al premio por parte de Monster para fines publicitarios, promocionales u otros fines comerciales en todos los medios cuya existencia se conozca actualmente o en el futuro, en todo el mundo y de forma perpetua sin compensación adicional, a menos que esté prohibido por ley.

9. Condiciones generales. Al participar en el Sorteo, los participantes: (a) aceptan quedar vinculados por estas Normas oficiales, por la interpretación de estas Normas oficiales por parte de Monster y por las decisiones de Monster, que son finales y vinculantes en todos los aspectos; (b) confirman el cumplimiento de estas Normas oficiales; (c) aceptan cumplir con toda ley, norma y normativa federal, estatal y local vigente; y (d) aceptan liberar y exonerar a las Entidades del sorteo de toda responsabilidad relativa a demandas, daños o lesiones derivadas de o relativas a la participación en el Sorteo o el uso, uso indebido o el canje de un premio y de toda demanda, incluidas las demandas por difamación, derechos de publicidad, invasión de la privacidad, violación de derechos de autor, violación de marca comercial o cualquier otra acción relativa a propiedad intelectual que se derive de o esté relacionada con el Sorteo, los premios o la publicidad y marketing de Monster sobre el Sorteo, los Participantes o Ganadores. Para ganar un premio es necesario cumplir todos los requisitos establecidos en las presentes condiciones.

Las Entidades del sorteo no se responsabilizan si el sorteo no puede tener lugar o se retrasa o si algún Premio no se puede otorgar por retrasos, interrupciones o fallos debidos a cuestiones de fuerza mayor, desastres naturales, pandemia del coronavirus (COVID-19), otras epidemias o emergencias médicas, confinamientos exigidos por el gobierno, la situación climatológica, actos o amenazas terroristas, huelgas, bloqueos, disputas laborales, ceses del trabajo, incendios, actos del gobierno, otros sucesos de fuerza mayor u otros sucesos que queden fuera del control razonable de las Entidades del sorteo. Si, por cualquier motivo, el Sorteo no puede celebrarse según lo previsto, incluidos entre otros, la pandemia del coronavirus (COVID-19), otras epidemias o emergencias médicas, infección de un virus informático, virus, manipulación, intervención no autorizada, fraude, fallos técnicos o cualquier otra causa que quede fuera del control razonable de las Entidades del sorteo que, en opinión de Monster, daña o afecta a la administración, seguridad, justicia, integridad o realización correcta de este Sorteo, Monster se reserva el derecho, a su entera discreción, de cancelar, rescindir, modificar o suspender el Sorteo o cualquier parte de este. Si se rescinde o modifica el Sorteo o alguna parte de este antes de la fecha de cierre, se publicará una notificación en www.monsterenergy.com si hay tiempo suficiente y se otorgarán los premios a los posibles Ganadores que se elegirán en un sorteo aleatorio de entre todas las Inscripciones restantes no dañadas que cumplan los requisitos recibidas antes de que se produjese tal evento fuera del control de Monster. Monster se reserva el derecho de modificar, retirar y reemplazar o modificar estas Normas oficiales de vez en cuando durante el Sorteo o posteriormente, incluido el derecho de modificar el Periodo de inscripción o la forma, el calendario y el número de sorteos.

El patrocinador y el administrador no serán responsables de la imposibilidad de recibir inscripciones debida a errores de transmisión o técnicos de cualquier tipo, incluidos, entre otros, el mal funcionamiento electrónico de cualquier red, hardware o software. El comprobante de envío no constituye comprobante de participación. El patrocinador y el administrador se reservan el derecho a su entera discreción de cancelar o suspender el Sorteo en caso de que virus u otras causas fuera de su control dañen la administración, seguridad o realización correcta del Sorteo. En caso de cancelación de cualquier Sorteo, los premios (o una pare de estos, determinada por Monster a su entera discreción) se otorgarán en un sorteo aleatorio de entre las inscripciones que cumplan los requisitos que se hayan recibido antes de la cancelación.

TODO INTENTO POR PARTE DE CUALQUIER PERSONA DE DAÑAR DE FORMA DELIBERADA O SOCAVAR EL FUNCIONAMIENTO LEGÍTIMO DEL SORTEO PODRÍA ESTAR INCUMPLIMIENDO LA LEGISLACIÓN DE DERECHO PENAL Y CIVIL Y, DE LLEVARSE A CABO ESTE INTENTO, MONSTER SE RESERVA EL DERECHO A EXIGIR INDEMNIZACIÓN POR DAÑOS Y PERJUICIOS (INCLUIDOS LOS HONORARIOS DE ABOGADOS) A TAL PERSONA EN LA MEDIDA MÁXIMA PERMITIDA POR LEY.

Si alguna de las disposiciones de estas Normas oficiales no fuese válida o no pudiese aplicarse, esto no afectaría a la validez o aplicabilidad de cualquier otra disposición. De determinarse que alguna disposición de las Normas oficiales no es válida o aplicable o es ilegal, se mantendrá la vigencia de las demás disposiciones y se interpretará de conformidad con sus condiciones como si la disposición no válida o ilegal no estuviera incluida en este documento. El hecho de que Monster no haga cumplir alguna de las condiciones de estas Normas oficiales no constituye una renuncia a dicha disposición. Los participantes aceptan renunciar a todo derecho a reclamar la ambigüedad de estas Normas oficiales. Los encabezados se usan únicamente por comodidad de referencia y no se considerará que afectan de ningún modo al significado o la intención de los documentos ni ninguna de las disposiciones que contienen. En caso de que haya una discrepancia o incoherencia entre las publicaciones u otras declaraciones incluidas en cualquier material relativo al Sorteo, la política de privacidad o las condiciones de uso en un sitio web o las condiciones generales de las Normas oficiales, prevalecerán, regularán y controlarán las Normas oficiales y la discrepancia se resolverá a entera y absoluta discreción de Monster.

10. Privacidad: toda la información presentada por los participantes y recopilada por Monster para la inscripción del participante estará sujeta a y se tratará de forma coherente con las Condiciones de uso del sitio web de Monster a las que se puede acceder en la dirección: https://www.monsterenergy.com/terms-of-use y la política de privacidad de Monster disponible en: https://www.monsterenergy.com/privacy-policy. Al participar en el Sorteo, los participantes aceptan por la presente que Monster puede recoger y usar sus datos personales proporcionados con la inscripción. ARBITRAJE VINCULANTE: EXCEPTO EN LA MEDIDA EN QUE ESTÉ PROHIBIDO POR LEY, EL PARTICIPANTE ACEPTA QUE: (1) TODA DISPUTA, CONFLICTO O DEMANDA DERIVADA O RELACIONADA CON EL SORTEO O CUALQUIER PREMIO OTORGADO SE RESOLVERÁ DE FORMA INDIVIDUAL, SIN RECURRIR A NINGUNA FORMA DE DEMANDA COLECTIVA; (2) TODA DISPUTA, CONFLICTO O DEMANDA DERIVADA O RELACIONADA CON EL SORTEO O CUALQUIER PREMIO OTORGADO SE RESOLVERÁ MEDIANTE ARBITRAJE VINCULANTE LLEVADO A CABO POR JAMS DE CONFORMIDAD CON LAS NORMAS EXHAUSTIVAS DE ARBITRAJE DE JAMS (LAS «NORMAS JAMS»); (3) TODO ARBITRAJE DEBE SER CONOCIDO POR UN ÁRBITRO QUE SE SELECCIONARÁ DE CONFORMIDAD CON LAS NORMAS JAMS, EN EL CONDADO DE ORANGE (CALIFORNIA); (4) EL LAUDO ARBITRAL PRONUNCIONADO PODRÁ REGISTRARSE EN CUALQUIER TRIBUNAL QUE TENGA JURISDICCIÓN DEL MISMO; Y (5) TODA RESOLUCIÓN O LAUDO ESTARÁ SUJETA A TODAS LAS LIMITACIONES Y DESCARGOS ESTABLECIDOS EN ESTAS NORMAS OFICIALES Y SE LIMITARÁ A LA INDEMNIZACIÓN POR LOS DAÑOS CORRIENTES REALES Y NO INCLUIRÁ, BAJO NINGÚN CONCEPTO, DAÑOS PUNITIVOS, EJEMPLARES, RESULTANTES O SECUNDARIOS, HONORARIOS DE ABOGADOS O LOS COSTOS DE INTERPOSIÓN DE UNA DEMANDA, ASÍ COMO NINGÚN RESARCIMIENTO JUDICIAL U OTRO TIPO DE REPARACIÓN EN EQUIDAD. ALGUNAS JURISDICCIONES NO PERMITEN LA LIMITACIÓN O EXCLUSIÓN DE RESPONSABILIDAD POR DAÑOS SECUNDARIOS O RESULTANTES. POR LO TANTO, ES POSIBLE QUE LA CLAÚSULA ANTERIOR NO SEA APLICABLE EN SU CASO.

12. Legislación aplicable: son aplicables todas las leyes y normativas federales, estatales y locales. No válida si esté prohibido por ley.
