Šioje akcijoje („Akcija“) gali dalyvauti visi 18 (aštuoniolikos) metų sulaukę asmenys, gyvenantys Estijoje, Latvijoje ar Lietuvoje (kartu – „Baltijos valstybės“). Akcijoje negali dalyvauti Monster Energy, arba susijusių įmonių, subrangovų, atstovų ar įgaliotinių darbuotojai bei jų šeimos nariai ar bet kurie kiti su Akcija profesiniais ryšiais susiję asmenys.
Akcija organizuojama interneto svetainėje adresu [www.monsterenergy.com/motogp_lt(„Svetainė“) ir reklamuojama per dalyvaujančių Monster Energy® produkcijos platintojų reklaminę medžiagą nurodytose parduotuvėse vienoje ar daugiau Baltijos šalių.
Sutikdamas dalyvauti šioje Akcijoje pagal šias Sąlygas kiekvienas dalyvis („jūs“, „jūsų“, „dalyvis“) sutinka laikytis šių Sąlygų ir su Akcija susijusio (-ių) Monster Energy sprendimo (-ų). Monster Energy sprendimai dėl visų su Akcija susijusių klausimų yra galutiniai. Monster Energy nevykdys jokio susirašinėjimo.
Visi laikai ir datos, nustatyti šiose Sąlygose, reiškia Baltijos valstybių laiką ir datas. Kilus bet kokiam ginčui dėl laiko ar datos, susijusios su dalyvio anketos pateikimu, Monster Energy sprendimas yra galutinis.
Norint dalyvauti Akcijoje nebūtina įsigyti jokių produktų.
Anketos pateikimas
Akcijos pradžia yra 2023-05-20 00:01 („Pradžios data“), akcijos pabaiga yra 2023-07-12 23:59 („Pabaigos data“).
Dalyviai gali pradėti dalyvauti Akcijoje:
a) laikydamiesi šių Sąlygų; ir
b)pateikdami savo duomenis (vardą ir pavardę, gyvenamosios vietos adresą, gimimo datą, telefono numerį ir el. pašto adresą), kaip nurodyta Svetainėje).
Prizas ir reikalavimai
Kiekvienas dalyvis, teisingai pateikęs savo anketą pagal nurodytus reikalavimus (kiekviena atskirai – „Galiojanti anketa“), dalyvaus prizų traukime, kuris bus surengtas per 3 (tris) dienas nuo Pabaigos datos („Traukimas“).
1 (vienas) oficialus laimėtojas, Traukimo metu pasirinktas atsitiktine tvarka („Pagrindinis laimėtojas“), laimės 3 (trijų) naktų kelionę 2 (dviem) asmenims į „MotoGP Silverstone“ Jungtinėje Karalystėje nuo 2023-08-04 iki 2023-08-07 („Kelionė“ ir „Pagrindinis prizas“), kurią sudaro:
2 (du) bilietai į „MotoGP Silverstone“ lenktynes 2023-08-05 ir 2023-08-06 („Renginys“); kiekvienas bilietas suteikia jo turėtojui: teisę įeiti į Renginį ir galimybę naudotis visomis viešosiomis erdvėmis Renginio darbo valandomis;
3 (trys) nakvynės 2 (dviem) asmenims dviejų lovų kambaryje viešbutyje, turinčiame ne mažiau kaip 3 (trijų) žvaigždučių įvertinimą. Viešbutį savo nuožiūra ir priklausomai nuo galimybių parenka Monster Energy („Viešbutis“);
2 (du) ekonominės klasės lėktuvo bilietai į abi puses iš oro uosto Baltijos šalyse į oro uostą Anglijoje, savo nuožiūra pasirinktą Monster Energy („Galutinis taškas“). Oro uostus, skrydžių datas ir laiką savo nuožiūra ir priklausomai nuo galimybių atrinks Monster Energy;
pervežimas ekonomine klase 2 (dviem) žmonėms iš Galutinio taško į Viešbutį, pagal Monster Energy nuožiūrą; pervežimo laiką ir būdus savo nuožiūra ir priklausomai nuo galimybių nustato Monster Energy.
Kiekvienas iš 20 (dvidešimties) oficialių antros vietos laimėtojų, atsitiktine tvarka išrinktų Traukimo metu (kartu vadinamų „Antros vietos laimėtojai“, o atskirai – „Antros vietos laimėtojas“) laimės toliau nurodytą Antros vietos laimėtojo prizą, kurį sudaro:
Kiekvienas iš Antros vietos laimėtojų laimės 1 „Yamaha®“ prekės ženklo kepurę, kurios tikslų dydį ir modelį savo išskirtine nuožiūra nustato Monster Energy („Antros vietos laimėtojo prizas“).
Tik Pagrindinis laimėtojas ir 1 (vienas) jo atrinktas asmuo („Atrinktas asmuo“) gali naudotis Pagrindinio prizo teikiamais privalumais. Monster Energy turi patvirtinti kiekvieną Atrinktą asmenį, tokiam asmeniui turi būti ne mažiau kaip 18 (aštuoniolika) metų, ir jis turi būti Baltijos valstybių gyventojas. Kad atgautų Pagrindinį prizą, Pagrindinis laimėtojas ir Atrinktas asmuo privalo turėti galiojančius pasus, kurių galiojimas nesibaigia anksčiau nei 2024-02-28.
Siekiant išvengti abejonių, Pagrindinis prizas ir Antros vietos laimėtojo prizas kartu vadinami „Prizai“, o kiekvienas atskirai – „Prizas“.

Prieš paskelbiant Pagrindinį laimėtoją ir įteikiant Pagrindinį prizą, kiekvieno galimo Pagrindinio laimėtojo ir Atrinkto asmens bus pareikalauta:
15.1. įrodyti, kad jis atitinka keliamus reikalavimus, įskaitant, bet neapsiribojant, patvirtinti amžių, gyvenamąją vietą ir asmens tapatybę. Tam gali būti pareikalauta pateikti gyvenamąją vietą patvirtinančio dokumento, paso ir (ar) tapataus valstybės išduoto asmens tapatybės dokumento kopiją;
15.2. pasirašyti Monster Energy nuožiūra parengtą ir konkrečiam Pagrindiniam prizui taikomą atsisakymo dokumentą, patvirtinantį, kad jie supranta ir sutinka su atsisakymo dokumentu. Atitinkamo patvirtinimo ir atsisakymo kopijas galima gauti adresu https://www.monsterenergy.com/contact.
Nepateikus Monster Energy šios informacijos per protingą Monster Energy nustatytą laiką Pagrindinis laimėtojas gali netekti Pagrindinio prizo, o Monster Energy per trumpiausią įmanomą laiką išrinks kitą kriterijus atitinkančią anketą.
Aiškumo tikslais pažymėtina, kad už visas išlaidas, susijusias su Pagrindiniu prizu, įskaitant, bet neapsiribojant, mokesčius, galiojantį sveikatos draudimą kelionei, kelionės vizą (jei taikoma), transportavimo (įskaitant tarp Pagrindinio laimėtojo ir Atrinkto asmens namų ir oro uosto), apgyvendinimo, įrangos, pragyvenimo išlaidas, ir bet kokias su Pagrindiniu prizu susijusias pramogas, neįtrauktas ir nenumatytas šio Pagrindinio prizo sąlygų, yra atsakingas tik Pagrindinis laimėtojas. Į Pagrindinio prizo apgyvendinimo išlaidas įtraukta tik kambario kaina, o Pagrindinis laimėtojas bei jo Atrinktas asmuo yra patys atsakingi už išlaidas, susijusias su Viešbutyje ir bet kur kitur suvartotais maisto produktais ir gėrimais, kurie nėra įtraukti ir nurodyti Pagrindinio prizo aprašyme, bei papildomais kambario mokesčiais. Šiuo dokumentu Pagrindinis laimėtojas sutinka pasirašyti ir vykdyti visas atitinkamų paslaugų teikėjų pateiktas sąlygas dėl Pagrindinio prizo.
Pagrindinis laimėtojas yra atsakingas pateikti bet kokius būtinus dokumentus ir vykdyti bet kokius teisėtus reikalavimus, susijusius su Pagrindiniu prizu, ir (arba) pateikti bet kokius įstatymų ir (arba) Monster Energy reikalaujamus dokumentus.
Informavimas ir Prizo pristatymas
Laimėtojai informuojami el. paštu ir (ar) telefonu, kuriuos nurodė pildydamas Akcijos dalyvio anketą, per 3 (tris) darbo dienas nuo Traukimo datos („Pranešimas“). Nelaimėjusieji dalyviai neinformuojami.
Prizų pristatymo duomenis nustato Monster Energy savo nuožiūra. Prizų pristatymo duomenys (įskaitant, bet neapsiribojant, pristatymo laiką, datą ir vietą) bus pateikti Laimėtojams Pranešime.
Tuo atveju, jei (i) Monster Energy negalės susisiekti su galimu Laimėtoju per 7 (septynias) dienas nuo Pranešimo dienos; (ii) galimas Pagrindinis laimėtojas negalės dalyvauti Renginyje; ir (ar) (iii) galimas Pagrindinis laimėtojas negalės atsiimti Prizo dėl bet kokios priežasties, tokia dalyvio anketa bus laikoma negaliojančia, ir Monster Energy galės ištraukti kitą reikalavimus atitinkančią Galiojančią anketą, kai tik bus tokia galimybė.
Bendrosios sąlygos
Dalyvių skaičius ribojamas 1 (viena) anketa žmogui, ir joks dalyvis negali pateikti daugiau nei 1 (vieną) dalyvio anketą. Monster Energy pasilieka teisę uždrausti Akcijoje dalyvauti asmeniui, kuris pateikia ar bando pateikti daugiau nei 1 (vieną) dalyvio anketą.
Dalyvių anketos, pateiktos naudojantis būdais, kuriuos generuoja script programa, makroprograma ar kita automatinė įranga, bus laikomos negaliojančiomis. Monster Energy pasilieka teisę patikrinti dalyvių anketų galiojimą ir atmesti tas anketas, kurios, Monster Energy nuomone, buvo pateiktos naudojantis automatizuota pateikimo technika.
Aiškumo tikslais pažymėtina, kad norint dalyvauti Akcijoje reikalingas kompiuteris ir prieiga prie interneto. Dalyvis privalo pasirūpinti, kad būtų gautas kompiuterio savininko ir asmens, mokančio už interneto ryšį, sutikimas. Išlaidos, susijusios su interneto naudojimusi siekiant dalyvauti Akcijoje, yra neatlyginamos.
Visos anketos yra laikomos gautomis nuo tada, kai jos patenka į Monster Energy duomenų bazę, o ne nuo tada, kai dalyvis anketą išsiunčia į Svetainę.
Kilus bet kokiam ginčui dėl Laimėtojo tapatybės, Monster Energy sprendimas yra lemiamas.
Anketos užpildymas internete ar bet koks kitas įrodymas, kad anketa buvo užpildyta internete, neįrodo, kad jūsų anketa buvo gauta. Monster Energy neatsako už dalyvių anketas, kurios yra užpildytos neteisingai, yra prarastos, pateiktos pavėluotai, ar kurios dėl bet kokios priežasties nebuvo gautos.
Prizai yra tokie, kokie yra nurodyti, ir negali būti perleisti, pakeisti, taip pat juos nėra siūloma pakeisti pinigine išraiška, jei Laimėtojas dėl bet kokios priežasties negali atsiimti bet kokio Prizo. Nepaisant to, kas išdėstyta pirmiau, kilus nenumatytoms aplinkybėms ar Monster Energy negalint pristatyti Prizo dėl COVID-19 pandemijos ar bet kokios kitos priežasties, Monster Energy pasilieka teisę pakeisti visą tokį Prizą arba Prizo dalis kitu tokią pačią ar didesnę vertę turinčiu prizu.
Pagrindinis laimėtojas sutinka Monster Energy reikalavimu dalyvauti ir užtikrinti, kad Atrinktas asmuo sutiktų dalyvauti pagrįstoje reklaminėje medžiagoje, susijusioje su Akcija, ir Pagrindinis laimėtojas (ir Atrinktas asmuo) patvirtina, kad Monster Energy gali naudoti jų vardą, nuotraukas, garso ir (ar) vaizdo įrašus bet kokioje viešoje ar reklaminėje medžiagoje, susijusioje su Akcija, kaip numatyta Monster Energy privatumo politikoje.
Tuo atveju, jei Monster Energy nevykdo šių Sąlygų nustatytų įsipareigojimų, ji yra atsakinga už numanomą žalą ir nuostolius, kuriuos dalyvis patyrė Monster Energy pažeidus šias Sąlygas ar jų nesilaikant, tačiau ji nėra atsakinga už bet kokią nenumanomą žalą ar nuostolius. Laikoma, kad žala ar nuostoliai yra numanomi, jei jie yra sukelti Monster Energy tiesiogiai pažeidus sąlygas arba jei jie buvo apsvarstyti dalyvio ir Monster Energy dalyviui pradedant dalyvauti Akcijoje. Be Monster Energy atsakomybės už numanomą žalą ar nuostolius, Monster Energy ir (ar) susijusios įmonės, darbdaviai, direktoriai, darbuotojai, atstovai, teisių perėmėjai ar subrangovai atsisako bet kokios atsakomybės visais įstatymų nustatytais atvejais.
Dėl įvykių, kurių priežasčių Monster Energy negali numatyti ir kontroliuoti, Akcija arba Prizo įteikimas gali tapti neįmanomu, todėl Monster Energy gali savo nuožiūra pakeisti Akciją, o dalyvis sutinka, kad Monster Energy dėl to nebus atsakinga.
Monster Energy pasilieka teisę:
(a) pakeisti Akcijos formatą ir (ar) sustabdyti ar atidėti visą Akciją ar bet kurią jos dalį dėl priežasčių, kurių ji nekontroliuoja, ir už tai nebūti atsakinga dalyviui, ir (ar)
(b) uždrausti bet kuriam asmeniui dalyvauti Akcijoje arba kituose Monster Energy renginiuose ateityje: (i) kai Monster Energy turi pagrindo manyti, kad Prizas buvo dalinai arba visiškai perleistas trečiajam asmeniui; (ii) kai dalyvis buvo diskvalifikuotas iš bet kurio Monster Energy žaidimo / akcijos ar kito prizų traukimo per 12 (dvylikos) mėnesių laikotarpį nuo Akcijos pradžios datos; (iii) kai Monster Energy turi pagrindo manyti, kad toks asmuo neatitinka šių Sąlygų reikalavimų; ir (ar) (iv) kai toks asmuo neatitinka reikalavimų, keliamų šios Akcijos dalyviui (ar jei dalyvauti Akcijoje turėjo būti uždrausta dėl bet kokios kitos priežasties).
Išskyrus atvejus, aiškiai įvardytus šiose Sąlygose, Monster Energy neatsako už jokias išlaidas, kurias gali patirti bet kuris dalyvis. Pagrindinis laimėtojas bus atsakingas už bet kokius mokesčius, kuriuos reikės sumokėti už Pagrindinį prizą.
Visiems dalyviams rekomenduojama išsaugoti šių Sąlygų kopiją, kad prireikus jas vėliau būtų galima peržiūrėti.
Jūs sutinkate, kad tuo atveju, jei tapsite Pagrindiniu laimėtoju, jūsų vardas ir pavardė būtų skelbiami viešai. Pagrindinio laimėtojo vardas ir pavardė skelbiami susisiekus su Monster Energy adresu www.monsterenergy.com/contact-us per 90 dienų nuo Pabaigos datos.
Akcijai ir šioms Sąlygoms yra taikoma Anglijos ir Velso teisė, išskyrus privalomas nacionalines vartotojų teisių apsaugos įstatymų nuostatas, kurios gali būti jums taikomos įstatymų nustatyta tvarka. Jokia šios Akcijos ir Sąlygų nuostata nepanaikina jūsų kaip vartotojo teisės pasikliauti tokiomis privalomomis nacionalinių įstatymų nuostatomis.
Bet kokie ginčai (susiję ir nesusiję su sutartimi), kylantys dėl šios sutarties ar susiję su šia Akcija ar šiomis Sąlygomis, sprendžiami Anglijos ir Velso teismuose, kurie turi neišimtinę jurisdikciją. Kita vertus, tuo nebus ribojamos vartotojų teisės, suteikiamos pagal taikomus vartotojų apsaugos įstatymus.

Please read these terms & conditions (“Terms”) carefully. By entering this promotion (the “Promotion”) you are agreeing to be bound by these Terms. You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering the Promotion.
The Promotion is being organised and operated by Monster Energy Europe Limited of Unit 51 Metropolitan Park, Bristol Road, Greenford, Middlesex UB6 8UP, UK (“Monster Energy”).
The Promotion is open to all persons over eighteen (18) years of age and who are resident in one of Estonia, Latvia or Lithuania (together the “Baltics”). No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion.
The Promotion is being conducted through the website at [INSERT WEBSITE URL] (the “Website”) and promoted through promotional material within selected retailers of the Monster Energy® product within one or more of the Baltics.
By entering the Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion. No further correspondence will be entered into by Monster Energy.
All times and dates set out in these Terms refer to the times and dates of the Baltics. In the event of any dispute over the time or date of any entry submitted, the decision of Monster Energy shall be final.
No purchase of any product is required to enter the Promotion.
Entry
The commencement date of the Promotion is 00:01 on 20.05.2023 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 12.07.2023 (“Closing Date”).
Entrants may enter the Promotion by:
(a) acting in accordance with these Terms; and
(b) submitting their details as directed on the Website (being full name, residential address, date of birth, phone number and email address).
Prize & Requirements
Each entrant that validly submits their entry as set out above (each a “Valid Entry”) will be entered into the prize draw to be held within three (3) days of the Closing Date (“Draw”).
One (1) official winner randomly selected from the Draw (the “MainWinner”) shall win a three (3) night trip for two (2) people to MotoGP Silverstone, United Kingdom from 04.08.2023 to 07.08.2023 (“Trip” and “Main Prize”), which shall consist of the following:
two (2) tickets to race days on the 05.08.2023 and 06.08.2023 at MotoGP Silverstone (“Event”); each ticket shall grant the holder: entrance to the Event and access to all public areas at the Event during the opening hours of the Event;
a three (3) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);
return economy flight tickets for two (2) people from an airport in the Baltics to an airport in England as selected by Monster Energy (“Destination Point”); the airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion; and
return economy transfers as determined by Monster Energy in its absolute discretion for two (2) people from Destination Point to the Hotel as determined by Monster Energy in its absolute discretion; the times and mode of transport to be determined by Monster Energy in its absolute discretion, subject to availability.
Twenty (20) official runners up randomly selected from the Draw (collectively referred to as the “Runners Up” and each a “Runner Up”) shall each win a Runner Up Prize (as defined below), which shall consist of the following:
The Runners Up shall each win one (1) Yamaha® branded cap, the exact size and design to be determined by Monster Energy in is complete discretion (“Runner Up Prize”).
Only the Main Winner and one (1) person, as chosen by the Main Winner, (“Elected Person”) may enjoy the benefits of the Main Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in the Baltics. The Main Winner and Elected Person must hold valid passports that do not expire before 28.02.2024 in order to redeem the Main Prize.
For the avoidance of doubt, the Main Prize and Runner Up Prize together are referred to as the "Prizes" and each a “Prize”.
For the avoidance of doubt, the Main Winner and the Runners Up shall together be referred to as the “Winners” and each a “Winner”.
Before being declared the Main Winner and receiving the Main Prize, the potential Main Winner and Elected Person will be required to:
prove eligibility, including, without limitation, proof of age, residence, identity, which may include but is not limited to a copy of proof of residence, passport and/ or similar government issued identification; and
sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Main Prize confirming understanding, compliance with and acceptance of the waiver. Copies of the applicable confirmation and waiver can be obtained upon request to https://www.monsterenergy.com/contact.
Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Main Winner forfeiting the Main Prize and Monster Energy drawing another qualifying entry as soon as reasonably possible thereafter.
For the avoidance of doubt, all costs associated with the Main Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation (including transfers between the Main Winner and the Elected Person's home and the airport), accommodation, equipment, sustenance, any entertainment and anything related to the Main Prize not specifically included and outlined in the definition of the Main Prize above will be borne solely by the Main Winner. Accommodation for the Main Prize is on a room only basis and Main Winner and their Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Main Prize and all additional room charges. The Main Winner hereby agrees to sign and comply with any terms and conditions provided by the relevant service providers for the Main Prize.
It is the responsibility of the Main Winner to provide any required documentation and any other legal requirements for the Main Prize and/or documentation required by law and/or Monster Energy.
Notification and Prize Delivery
The Winners will be notified by email and/or by telephone via the email address and/or telephone number provided to enter the Promotion within three (3) days of the Draw (“Notification”). Unsuccessful entrants will not be notified.
The delivery details of the Prizes shall be determined by Monster Energy in its complete discretion. Details of delivery of the Prizes (including but not limited to the time, date and location of delivery) shall be provided to the Winners at Notification.
Entry will be deemed null and void and Monster Energy shall draw another Valid Entry as soon as reasonably possible thereafterin the event that: (i) Monster Energy cannot contact a potential Winner within seven (7) days of the Notification; (ii) a potential Main Winner is unavailable to attend the Event; and/or (iii) a potential Winner is unavailable to receive a Prize, for any reason whatsoever.
General Terms
Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry. Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.
Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices. Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
For the avoidance of doubt a computer or another internet-ready device and internet access is required to enter the Promotion. It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider. No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.
All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant.
If there is any dispute as to the identity of a Winner the decision of Monster Energy shall be final.
Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received. Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.
The Prizes are as described and not transferable, not exchangeable and no cash alternative will be offered in the event that a Winner is unable to claim any Prize for any reason whatsoever. Notwithstanding the foregoing, in the event of unforeseen circumstances or Monster Energy being unable to deliver a Prize due to the COVID-19 pandemic or for any other reason, Monster Energy reserves the right to replace such entire Prize or prize components with a prize of equal or greater value.
The Main Winner agrees to participate and shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Main Winner (and the Elected Person) acknowledge that Monster Energy can use their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion as described in Monster Energy’s privacy policy.
If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.
Events may occur that render the Promotion itself or the awarding of a Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
Monster Energy reserves the right to:
(a) change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or
(b) refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. The Main Winner will be liable for any tax chargeable in relation to the Main Prize.
It is advised that all entrants retain a copy of these Terms for future reference.
You accept that your name may be made available to the public if you are the Main Winner. The Main Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within 90 days of the Closing Date.
The Promotion and these Terms are governed by the laws of England and Wales subject to mandatory provisions of local consumer law that may apply for your benefit by operation of law and nothing in the Promotion and these Terms affect your rights as a consumer to rely on such mandatory provisions of local law.
Any disputes (contractual or non-contractual) arising under or in connection with this Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in England and Wales. However, this shall not limit consumers' mandatory rights under the applicable consumer protection legislation.
