Lūdzu, uzmanīgi izlasiet šos noteikumus ("Noteikumi").  Piedaloties akcijā (“Akcija” jūs piekrītat ievērot Noteikumus. Jums vajadzētu izlasīt arī mūsu privātuma politiku vietnē www.monsterenergy.com, kurā izskaidrots, kā mēs izmantosim datus, ko jūs sniedzat, piesakoties Akcijai.

1. Akciju organizē Monster Energy Europe Limited, Unit 51 Metropolitan Park, Bristol Road, Greenford Middlesex UB6 8UP, AK (“Monster Energy”).
2. Akcijā var piedalīties personas, kas ir vecākas par 18 gadiem un pastāvīgi dzīvo Igaunijā, Latvijā vai Lietuvā (kopā "Baltijas valstis"). Monster Energy vai saistīto uzņēmumu, apakšuzņēmēju, aģentu vai tiesību pārņēmēju darbinieki vai darbinieku ģimenes locekļi vai citas ar Akciju profesionāli saistītas personas nedrīkst piedalīties Akcijā. 
3. Akcija notiek tīmekļa vietnē [www.monsterenergy.com/motogp_lt] (“Tīmekļa vietne”), un to ar veicināšanas materiāliem atbalsta atsevišķi Monster Energy® produkcijas mazumtirgotāji vienā vai vairākās Baltijas valstīs.
4. Piedaloties Akcijā saskaņā ar Noteikumiem, katrs dalībnieks (“jūs”, “dalībnieks”) piekrīt ievērot Noteikumus un Monster Energy lēmumus attiecībā uz visiem jautājumiem par Akciju, un Monster Energy lēmumi ir noteicoši. Monster Energy neiesaistīsies nekāda veida sarakstē.
5. Visi Noteikumos norādītie datumi un laiks ir vietējie datumi un laiks Baltijas valstīs. Ja radīsies strīds par kāda pieteikuma iesniegšanas datumu vai laiku, noteicošs būs Monster Energy lēmums.
6. Lai piedalītos Akcijā, nav nepieciešams iegādāties kādu produktu. 

Pieteikšanās

1. Akcija sāksies 20.05.2023. plkst. 00.01 (“Sākuma datums”) un noslēgsies 12.07.2023. plkst. 23.59 (“Noslēguma datums”).  
2. Dalībnieki var pieteikties akcijai šādi: 

(a) rīkojoties saskaņā ar šiem Noteikumiem  un

(b) iesniedzot informāciju par sevi (vārdu, uzvārdu, dzīvesvietas adresi, dzimšanas datumu, tālruņa numuru un e-pasta adresi), kā norādīts Tīmekļa vietnē.

Balva un prasības 

1. Katrs dalībnieks, kurš iesniedz derīgu pieteikumu, kā norādīts iepriekš (“Derīgs pieteikums”), varēs piedalīties balvas izlozē, kas notiks 3 (trīs) dienu laikā pēc Noslēguma datuma (“Izloze”). 
2. 1 (viens) oficiālais uzvarētājs, kas tiks noteikts izlozē (“Galvenais uzvarētājs”), laimēs 3 (trīs) nakšu ceļojumu 2 (divām) personām uz sacensībām MotoGP Silverstone Apvienotajā Karalistē no 04.08.2023 līdz 07.08.2023 (“Ceļojums” un “Galvenā balva”), kas ietvers tālāk norādīto:
   1. 2 (divas) biļetes uz MotoGP Silverstone sacensībām 05.08.2023. and 06.08.2023. (“Pasākums”); katram biļetes īpašniekam būs iespēja apmeklēt Pasākumu; piekļūt visām publiskajām Pasākuma vietām Pasākuma darba laikā;
   2. divvietīgu viesnīcas numuru 2 (divām) personām uz 3 (trim) naktīm vismaz 3 (trīs) zvaigžņu viesnīcā, ko atkarībā no pieejamības pēc saviem ieskatiem izvēlēsies Monster Energy (“Viesnīca”);
   3. ekonomiskās klases turp un atpakaļ aviobiļetes 2 (divām) personām) no Monster Energy izvēlētas lidostas Baltijas valstīs līdz lidostai Anglijā (“Galamērķa lidosta”); lidostu atrašanās vietu, reisu datumus un laiku noteiks Monster Energy pēc saviem ieskatiem un
   4. pēc Monster Energy ieskatiem noteiktus ekonomiskās klases pārbraucienus 2 (divām) personām no Galamērķa lidostas līdz Viesnīcai un atpakaļ; izmantotā transporta veidu, laiku un datumu pēc saviem ieskatiem noteiks Monster Energy atkarībā no pieejamības.
3. 20 (divdesmit) oficiālie otrās vietas ieguvēji, kas tiks noteikti izlozē (kopā saukti par “Otrās vietas ieguvējiem” un katrs atsevišķi par “Otrās vietas ieguvēju”), iegūs Otrās vietas ieguvēju balvu (kā definēts tālāk), kas ietvers:
   1. katrs Otrās vietas ieguvējs laimēs 1 (vienu) Yamaha® zīmola cepuri; kuru izmēru un dizainu noteiks Monster Energy pēc saviem ieskatiem (“Otrās vietas ieguvēja balva”).
4. Balvu var izmantot tikai Galvenais uzvarētājs un 1 (viena) Galvenā uzvarētāja izvēlēta persona ("Izvēlētā persona"). Izvēlētajai personai jāsaņem Monster Energy apstiprinājums, jābūt vismaz 18 (astoņpadsmit) gadus vecai un jābūt kādas Baltijas valsts pastāvīgajam iedzīvotājam. Galvenajam uzvarētājam un Izvēlētajai personai jābūt derīgām pasēm, kuru derīguma termiņš nebeidzas pirms 2024. gada 28. februāra.
5. Lai nerastos neskaidrības – Galvenā balva un Otrās vietas ieguvēja balva kopā tiek sauktas par "Balvām" un katra atsevišķi par "Balvu". 
6. Lai nerastos neskaidrības – Galveno uzvarētāju un Otrās vietas ieguvējus kopā sauc par “Uzvarētājiem” un katru atsevišķi par “Uzvarētāju”. 
7. Pirms Galvenā uzvarētāja paziņošanas un Galvenās balvas saņemšanas potenciālajam galvenajam uzvarētājam un tā Izvēlētajai personai vajadzēs:
   1. pierādīt savu atbilstību, tostarp vecumu, dzīvesvietu, identitāti, kas var ietver (bet ne tikai) dzīvesvietas apliecinājumu, pases un/vai līdzīga personu apliecinoša dokumenta uzrādīšanu un
   2. parakstīt pēc Monster Energy ieskatiem sagatavotu dokumentu par atteikšanos no pretenzijām attiecībā uz Galveno balvu, apliecinot, ka uzvarētājs saprot, pieņem un pildīs attiecīgajā dokumentā minēto. Attiecīgā apliecinājuma un dokumenta par attiekšanos no pretenzijām eksemplāru var saņemt, nosūtot pieprasījumu https://www.monsterenergy.com/contact.

Ja Monster Energy nesaņems šo informāciju saprātīgā laikā, ko noteicis Monster Energy, Galvenais uzvarētājs var nesaņemt Galveno balvu un Monster Energy veiks jaunu derīga pieteikuma izlozi, tiklīdz tas būs iespējams.

1. Lai nerastos neskaidrības – visas ar Galveno balvu saistītās izmaksas, ieskaitot (bet ne tikai) nodokļus, derīgu veselības apdrošināšanu ceļojuma laikā, ceļošanas vīzu (ja piemēro), transportu (ieskaitot transportu starp Uzvarētāja un Izvēlētās personas mājām un lidostu), naktsmītnes, aprīkojumu, uzturlīdzekļus un izklaides un jebkādus citus ar Galveno balvu saistītus izdevumus, kas nav ietverti un aprakstīti Galvenās balvas definīcijā, sedz vienīgi Galvenais uzvarētājs. Galvenajā balvā ietvertās naktsmītnes izmaksas ietver tikai numura izmaksas, un Galvenajam uzvarētājam un Izvēlētajai personai jāsedz visas izmaksas par Viesnīcā un citur patērētajiem ēdieniem un dzērieniem un papildu numura izmaksām, kas nav iekļautas Galvenās balvas definīcijā. Galvenais uzvarētājs piekrīt ievērot pakalpojumu sniedzēju noteikumus, kuri attiecas uz Galvenās balvas sakarā sniegtajiem pakalpojumiem.
2. Galvenajam uzvarētājam jāiesniedz nepieciešamie dokumenti un jāizpilda citas juridiskās prasības attiecībā uz Galveno balvu vai un/vai likumā noteiktajiem un/vai Monster Energy pieprasītajiem dokumentiem.

Paziņošana un balvas piegāde

1. Uzvarētājiem paziņos par balvu 3 (trīs) dienu laikā pēc Izlozes (“Paziņošana”), izmantojot e-pasta adresi un/vai tālruņa numuru, kas norādīts, piesakoties Akcijai. Dalībniekiem, kas nav ieguvuši balvu, paziņojums netiks sniegts.
2. Informāciju par Balvas piegādi noteiks Monster Energy pēc saviem ieskatiem.  Informācija par Balvas piegādi (tostarp laiku, datumu un vietu) Uzvarētājiem tiks sniegta Paziņojuma laikā.
3. Pieteikums zaudēs spēku un Monster Energy izlozēs citu Derīgu pieteikumu iespējami drīzā laikā, ja: (i) Monster Energy 7 (septiņu) dienu laikā pēc Paziņošanas nevarēs sazināties ar potenciālo Galveno uzvarētāju; (ii) potenciālais Galvenais uzvarētājs nevar apmeklēt Pasākumu; un/vai (iii) potenciālais uzvarētājs nevar saņemt Balvu jebkāda cita iemesla dēļ. 

Vispārīgi noteikumi

1. Katrs dalībnieks var iesniegt tikai 1 (vienu) pieteikumu, un dalībnieks neiesniegs un necentīsies iesniegt vairāk par 1 (vienu) pieteikumu. Monster Energy saglabā tiesības nereģistrēt personu Akcijai, ja persona iesniedz vai mēģina iesniegt vairāk nekā 1 (vienu) pieteikumu.
2. Pieteikumi, kas iesniegti tiešsaistē, izmantojot skripta vai makro tehnoloģiju vai automātiskas ierīces, nebūs derīgi.  Monster Energy saglabā tiesības pārbaudīt pieteikumu derīgumu un izslēgt pieteikumus, kas pēc Monster Energy domām iesniegti, izmantojot automatizētas metodes.
3. Lai nerastos neskaidrības – lai piedalītos Akcijā, nepieciešama piekļuve datoram vai citai internetam pieslēdzamai ierīcei un internetam. Pieteikuma iesniedzējam ir jāsaņem datora īpašnieka un personas, kas maksā par interneta pakalpojumu sniedzēja pakalpojumiem, piekrišana. Pretenzijas par izdevumiem, kas saistīti ar interneta savienojuma izmantošanu ar mērķi piedalīties Akcijā, netiks ņemtas vērā.
4. Pieteikumu uzskata par saņemtu brīdī, kad tas ievadīts Monster Energy datu bāzē, nevis brīdī, kad dalībnieks nosūta pieteikumu Tīmekļa vietnei. 
5. Ja radīsies strīds par Uzvarētāja identitāti, Monster Energy lēmums būs noteicošs.
6. Tiešsaistes pieteikuma veidlapas iesniegšana vai cits pierādījums par tiešsaistes pieteikuma veidlapas iesniegšanu nepierāda, ka jūsu pieteikums ir saņemts. Monster Energy neatbild par nepareizi aizpildītiem, pazaudētiem, nokavētiem vai jebkādu citu iemeslu dēļ nesaņemtiem pieteikumiem. 
7. Balvas ir tādas, kā aprakstīts; tās nav nododama citām personām un samaināmas; ja Uzvarētājs jebkāda iemesla dēļ nevarēs izmantot Balvu, tās vietā netiks piedāvāta kompensācija naudā. Neskatoties uz iepriekšminēto, neparedzētu apstākļu gadījumā vai gadījumā, ja Monster Energy nespēs piegādāt Balvas COVID-19 pandēmijas dēļ vai kāda cita iemesla dēļ, Monster Energy patur tiesības nomainīt visu Balvu vai balvas komponentus ar vienādas vai lielākas vērtības balvu.
8. Galvenais uzvarētājs piekrīt un gādā par to, lai Izvēlētā persona piekrīt piedalīties saprātīgos publicitātes pasākumos saistībā ar Akciju, ja to lūgs Monster Energy, un Galvenais uzvarētājs (un Izvēlētā persona) atzīst, ka Monster Energy var izmantot viņu vārdu, foto, audio un/vai video ierakstus jebkurā publicitātes pasākumā saistībā ar Akciju, kā aprakstīts Monster Energy privātuma politikā.
9. Ja Monster Energy pārkāps Noteikumus, tas atbildēs par dalībnieka zaudējumiem, kas paredzami izrietēs no Monster Energy pārkāpuma vai nolaidības, bet neatbildēs par neparedzamiem zaudējumiem. Zaudējumi ir paredzami, ja tie acīmredzami izriet no Monster Energy pārkāpuma vai dalībnieks un Monster Energy apsvēra to iespējamību, kad dalībnieks pieteicās Akcijai. Izņemot Monster Energy atbildību par paredzamiem zaudējumiem, Monster Energy un/vai saistītie uzņēmumi, darbinieki, direktori, aģenti, tiesību pārņēmēji vai apakšuzņēmumi pilnībā noraida jebkādu atbildību likuma atļautajā apmērā.
10. Var rasties notikumi, kas padara Akciju vai Balvu piešķiršanu par neiespējamu tādu iemeslu dēļ, kurus Monster Energy nevar ietekmēt, un attiecīgi Monster Energy var pēc saviem ieskatiem mainīt vai grozīt Akciju, un dalībnieks piekrīt, ka tādēļ Monster Energy neradīsies nekāda atbildība.
11. Monster Energy saglabā tiesības:

(a) neuzņemoties atbildību pret dalībnieku, mainīt Akcijas formātu un/vai atlikt Akciju vai tās daļas, pavisam vai daļēji, tādu iemeslu dēļ, kurus Monster Energy nevar ietekmēt, un/vai

(b) noraidīt personas pieteikumu Akcijai vai turpmākām akcijām, ko organizēs Monster Energy: (i) ja Monster Energy ir pietiekams pamats uzskatīt, ka Balva daļēji vai pilnībā nodota kādai trešai pusei; (ii) ja dalībnieks diskvalificēts kādā citā Monster Energy rīkotā konkursā vai akcijā 12 (divpadsmit) mēnešu laikā no Sākuma datuma; (iii) ja Monster Energy ir pietiekams pamats uzskatīt, ka persona neievēro Noteikumus un/vai (iv) ja persona neatbilst Akcijas kritērijiem (vai ja dalība Akcijā ir jānoraida jebkādu citu iemeslu dēļ).

1. Izņemot kā nepārprotami norādīts Noteikumos, Monster Energy neatbild par izdevumiem vai izmaksām, kas var rasties dalībniekam. Galvenais Uzvarētājs atbild par nodokļiem, kas maksājami par Galveno balvu. 
2. Noteikumus ieteicams saglabāt, lai vēlāk tos varētu pārlasīt.
3. Jūs piekrītat, ka jūsu vārds var kļūt publiski pieejams, ja jūs kļūsiet par Galveno uzvarētāju. Galvenā uzvarētāja vārdu var uzzināt, sazinoties ar Monster Energy vietnē www.monsterenergy.com/contact-us 90 dienu laikā no Noslēguma datuma.
4. Akciju un Noteikumus regulē Anglijas un Velsas likumi, ievērojot obligātās vietējā patērētāju aizsardzības likuma normas, kas var attiekties uz jums, un nekas no Akcijā un Noteikumos minētā neietekmē jūsu patērētāja tiesības izmantot obligātās vietējā patērētāju aizsardzības likuma normas.
5. Strīdi (līgumiski vai nelīgumiski), kas rodas sakarā ar Akciju vai Noteikumiem vai no tiem izriet, tiks risināti neeksluzīvā Anglijas un Velsas tiesu jurisdikcijā. Tas neierobežo patērētāja obligātās tiesības, kas noteiktas attiecīgajos patērētāju tiesību aizsardzības likumos.

LONG FORM PROMOTION TERMS & CONDITIONS

Please read these terms & conditions (“Terms”) carefully.  By entering this promotion (the “Promotion”) you are agreeing to be bound by these Terms. You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering the Promotion.

1. The Promotion is being organised and operated by Monster Energy Europe Limited of Unit 51 Metropolitan Park, Bristol Road, Greenford, Middlesex UB6 8UP, UK (“Monster Energy”).
2. The Promotion is open to all persons over eighteen (18) years of age and who are resident in one of Estonia, Latvia or Lithuania (together the “Baltics”). No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion. 
3. The Promotion is being conducted through the website at [INSERT WEBSITE URL] (the “Website”) and promoted through promotional material within selected retailers of the Monster Energy® product within one or more of the Baltics.
4. By entering the Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.
5. All times and dates set out in these Terms refer to the times and dates of the Baltics. In the event of any dispute over the time or date of any entry submitted, the decision of Monster Energy shall be final.
6. No purchase of any product is required to enter the Promotion. 

Entry

1. The commencement date of the Promotion is 00:01 on 20.05.2023 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 12.07.2023 (“Closing Date”).  
2. Entrants may enter the Promotion by: 

(a) acting in accordance with these Terms; and

(b) submitting their details as directed on the Website (being full name, residential address, date of birth, phone number and email address).

Prize & Requirements 

1. Each entrant that validly submits their entry as set out above (each a “Valid Entry”) will be entered into the prize draw to be held within three (3) days of the Closing Date (“Draw”). 
2. One (1) official winner randomly selected from the Draw (the “Main Winner”) shall win a three (3) night trip for two (2) people to MotoGP Silverstone, United Kingdom from 04.08.2023 to 07.08.2023 (“Trip” and “Main Prize”), which shall consist of the following:
   1. two (2) tickets to race days on the 05.08.2023 and 06.08.2023 at MotoGP Silverstone (“Event”); each ticket shall grant the holder: entrance to the Event and access to all public areas at the Event during the opening hours of the Event;
   2. a three (3) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);
   3. return economy flight tickets for two (2) people from an airport in the Baltics to an airport in England as selected by Monster Energy (“Destination Point”); the airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion; and
   4. return economy transfers as determined by Monster Energy in its absolute discretion for two (2) people from Destination Point to the Hotel as determined by Monster Energy in its absolute discretion; the times and mode of transport to be determined by Monster Energy in its absolute discretion, subject to availability.
3. Twenty (20) official runners up randomly selected from the Draw (collectively referred to as the “Runners Up” and each a “Runner Up”) shall each win a Runner Up Prize (as defined below), which shall consist of the following:
   1. The Runners Up shall each win one (1) Yamaha® branded cap, the exact size and design to be determined by Monster Energy in is complete discretion (“Runner Up Prize”).
4. Only the Main Winner and one (1) person, as chosen by the Main Winner, (“Elected Person”) may enjoy the benefits of the Main Prize. The Elected Person must be approved by Monster Energy, be over the age of eighteen (18) years and be resident in the Baltics. The Main Winner and Elected Person must hold valid passports that do not expire before 28.02.2024 in order to redeem the Main Prize.
5. For the avoidance of doubt, the Main Prize and Runner Up Prize together are referred to as the "Prizes" and each a “Prize”. 
6. For the avoidance of doubt, the Main Winner and the Runners Up shall together be referred to as the “Winners” and each a “Winner”. 
7. Before being declared the Main Winner and receiving the Main Prize, the potential Main Winner and Elected Person will be required to:
   1. prove eligibility, including, without limitation, proof of age, residence, identity, which may include but is not limited to a copy of proof of residence, passport and/ or similar government issued identification; and
   2. sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Main Prize confirming understanding, compliance with and acceptance of the waiver. Copies of the applicable confirmation and waiver can be obtained upon request to https://www.monsterenergy.com/contact.

Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Main Winner forfeiting the Main Prize and Monster Energy drawing another qualifying entry as soon as reasonably possible thereafter.

1. For the avoidance of doubt, all costs associated with the Main Prize, including without limitation, tax, valid health insurance for travel, travel visa (if applicable), transportation (including transfers between the Main Winner and the Elected Person's home and the airport), accommodation, equipment, sustenance, any entertainment and anything related to the Main Prize not specifically included and outlined in the definition of the Main Prize above will be borne solely by the Main Winner. Accommodation for the Main Prize is on a room only basis and Main Winner and their Elected Person will be responsible for all food and beverage consumed at the Hotel and elsewhere which is not specifically included and outlined in the definition of the Main Prize and all additional room charges. The Main Winner hereby agrees to sign and comply with any terms and conditions provided by the relevant service providers for the Main Prize.
2. It is the responsibility of the Main Winner to provide any required documentation and any other legal requirements for the Main Prize and/or documentation required by law and/or Monster Energy.

Notification and Prize Delivery

1. The Winners will be notified by email and/or by telephone via the email address and/or telephone number provided to enter the Promotion within three (3) days of the Draw (“Notification”). Unsuccessful entrants will not be notified.
2. The delivery details of the Prizes shall be determined by Monster Energy in its complete discretion.  Details of delivery of the Prizes (including but not limited to the time, date and location of delivery) shall be provided to the Winners at Notification.
3. Entry will be deemed null and void and Monster Energy shall draw another Valid Entry as soon as reasonably possible thereafter in the event that: (i) Monster Energy cannot contact a potential Winner within seven (7) days of the Notification; (ii) a potential Main Winner is unavailable to attend the Event; and/or (iii) a potential Winner is unavailable to receive a Prize, for any reason whatsoever. 

General Terms

1. Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry. Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.
2. Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices. Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
3. For the avoidance of doubt a computer or another internet-ready device and internet access is required to enter the Promotion. It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider.  No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.
4. All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant. 
5. If there is any dispute as to the identity of a Winner the decision of Monster Energy shall be final.
6. Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received. Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason. 
7. The Prizes are as described and not transferable, not exchangeable and no cash alternative will be offered in the event that a Winner is unable to claim any Prize for any reason whatsoever. Notwithstanding the foregoing, in the event of unforeseen circumstances or Monster Energy being unable to deliver a Prize due to the COVID-19 pandemic or for any other reason, Monster Energy reserves the right to replace such entire Prize or prize components with a prize of equal or greater value.
8. The Main Winner agrees to participate and shall procure that the Elected Person agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Main Winner (and the Elected Person) acknowledge that Monster Energy can use their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion as described in Monster Energy’s privacy policy.
9. If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, employees, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.
10. Events may occur that render the Promotion itself or the awarding of a Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
11. Monster Energy reserves the right to:

(a) change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or

(b) refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).

1. Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. The Main Winner will be liable for any tax chargeable in relation to the Main Prize. 
2. It is advised that all entrants retain a copy of these Terms for future reference.
3. You accept that your name may be made available to the public if you are the Main Winner. The Main Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within 90 days of the Closing Date.
4. The Promotion and these Terms are governed by the laws of England and Wales subject to mandatory provisions of local consumer law that may apply for your benefit by operation of law and nothing in the Promotion and these Terms affect your rights as a consumer to rely on such mandatory provisions of local law.
5. Any disputes (contractual or non-contractual) arising under or in connection with this Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in England and Wales. However, this shall not limit consumers' mandatory rights under the applicable consumer protection legislation.
