BY SUBMITTING AN ENTRY TO THIS SWEEPSTAKES DURING THE SWEEPSTAKES ENTRY PERIOD, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT.  SO READ THEM CAREFULLY BEFORE ENTERING.  AMONG OTHER THINGS, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU TO THE SWEEPSTAKES ENTITIES (DEFINED BELOW) AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN A PRIZE. Monster Energy Company (“Monster”) is offering the “Monster Energy^® Chance to Win a VIP UFC Experience in Las Vegas Sweepstakes” (the “Sweepstakes”).  The Sweepstakes is subject to these official rules (the “Official Rules”), and by entering, entrant (“Entrant”) agrees to be bound by them and the decisions of Monster, which are final and binding in all respects.  This Sweepstakes begins at 12:01 AM, May 1, 2018, US Pacific Time and ends November 30, 2018 at 11:59 PM, US Pacific Time (the “Entry Period”).  Monster’s computer is the official timekeeping device for entry in the Sweepstakes.  All entries must be received by 11:59 PM Pacific Time on December 1, 2018.  

 

1.  Eligibility:  The Sweepstakes is open to legal residents of, and physically located within, the fifty (50) United States or the District of Columbia who are at least eighteen (18) years of age or the age of majority in his/her state of residency, whichever is older.  VOID WHERE PROHIBITED. Employees, officers and representatives and members of the immediate families (i.e., parents, spouses, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of Monster, Orbit Sales & Marketing LLC (the “Administrator”), Zuffa, LLC, and Izigg, Inc. (“Izigg”), and their respective affiliated companies, parent companies, subsidiaries, participating promotional partners, retailers, distributors, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution, production, or fulfillment of the Sweepstakes (the “Sweepstakes Entities”) are not eligible.  All entries submitted in compliance with these Official Rules and not disqualified or void are considered “Eligible Entries.”  All entries are the property of Monster.

 

2. How To Enter: There are two (2) methods of entry for this Sweepstakes –

 

• Entry by Purchase:  purchase any Monster Energy® energy drink product during the Entry Period and save your purchase receipt.  Visit www.monsterenergy.com/vegas, upload a photo of your receipt and complete the official online entry form during the Entry Period. Limit one (1) entry per person, per day. Please save the hard copy of your entry receipt.

• Non-Purchase Entry Method:  Visit www.monsterenergy.com/altvegas and complete the official online entry form beginning on 5/1/2018 at 12:01 AM US Pacific Time, through 11/30/2018 at 11:59 PM US Pacific Time. Limit one (1) entry per person per day.

 

General Entry Terms and Conditions. Excepting the limit of one (1) entry per person, per day, there is no limit on the number of Eligible Entries submitted by an Entrant during the Entry Period, regardless of entry method.  For purposes of this Sweepstakes, a “day” begins at 12:01 a.m. US Pacific Time and ends at 11:59 p.m. US Pacific Time.  Entries that are incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Monster’s sole and absolute discretion. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified.  Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information or otherwise may be disqualified.  The Sweepstakes Entities are not responsible for technical failures of any kind, including, but not limited to, the malfunctioning of any wireless network, telephone, computer, computer network, hardware or software or the unavailability or inaccessibility of any service.  The Sweepstakes Entities are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's handset to receive messages.  Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of Monster may be disqualified. All materials submitted become the property of Monster and will not be returned.  Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Normal time rates, if any, charged by the Entrants’ Internet service or mobile provider will apply.  

 

The odds of winning depend on the total number of Eligible Entries received within the Entry Period.

 

3.  Prizes: One hundred and one (101) prizes are available to be won. 

 

Grand Prize:  One (1) “Grand Prize” available. Grand Prize includes: (a) round-trip airfare for the Grand Prize Winner and his/her one (1) guest to Las Vegas, Nevada; (b) one (1) hotel room stay for four (4) nights; (c) VIP admittance for two (2) to the UFC Fight in Las Vegas, Nevada on December 29, 2018; and (d) one thousand dollars ($1,000) spending money. The Grand Prize’s (ARV) is:  $6,000. Total ARV of all Grand Prizes is $6,000. Prize ARV’s are subject to change based upon current market conditions at the time of prize fulfillment. Any difference between the ARV and the actual value, if any, will not be awarded. No Entrant may win more than one (1) prize.

 

The ARV of the Grand Prize may vary depending on the Grand Prize Winner's residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Monster is not responsible for, and the Grand Prize Winner will not receive, the difference between the actual value of the Grand Prize at the time of award and the stated ARV in these Official Rules or in any Sweepstakes-related correspondence or materials. Failure to complete and component of any Grand Prize does not relieve the Grand Prize Winner of his/her tax obligations associated with winning such Grand Prize. Specific travel arrangements and all prize details not specified herein will be made and determined in Monster’s sole discretion. Travel must originate from and end at the same airport and Grand Prize Winner and his/her one (1) guest must travel on the same itinerary. It is the Grand Prize Winner’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification (including photograph) at the time of travel. Flight schedules are subject to change without notice. Monster is not liable for any missed prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Grand Prize Winner may be required to provide a credit card at time of accommodation check-in to cover incidentals.

 

First Prize: One Hundred (100) “First Prizes” available.  Each First Prize is one (1) UFC.tv Pay-Per-View pass code; ARV is $50.  Total ARV of all First Prizes is $5,000.

 

4.  Winner Selection and Notification:  On or about December 3, 2018, the potential “Winners” will be determined via a random drawing, from all Eligible Entries received. Each potential Winner will be notified within three (3) business days of the drawing.  Each potential Winner will be notified by email (at the email address provided with the entry), and will be required to confirm his/her e-mail address. Potential Winners who entered through the entry by purchase method must provide a hard copy of the winning purchase receipt. A prize won by an Entrant will be awarded to the authorized account holder of the e-mail address or phone number submitted with the entry regardless of the individual who submitted the winning entry.   If a potential Winner cannot be reached after a reasonable effort has been exerted or fails to respond within seven (7) days of the date of notification, the potential Winner forfeits the prize, and an alternate potential Winner will be randomly drawn from all remaining Eligible Entries.  If the alternate potential Winner is unable to accept the prize, the prize is forfeited and another alternate potential Winner will be randomly drawn from all remaining Eligible Entries.  This Winner selection and notification process shall be continued until a Winner is confirmed for each prize.  If a prize or a prize notification is returned as undeliverable, the prize will be forfeited and an alternate potential Winner will be randomly drawn.  The Grand Prize will be awarded if it is properly claimed before December 28, 2018; after this date, alternative Winner(s) will not be selected and each unclaimed Grand Prize will not be awarded.    

 

5.  Winner Verification:  Within three (3) days of being notified of being a potential Winner, each potential Winner may be required complete, sign, and return documentation required by Monster — including a notarized Affidavit of Eligibility, release of liability, and a publicity release form (except where prohibited).  Provided that a potential Winner is in compliance with the Official Rules and after having successfully proven eligibility and provided any documentation required by Monster, the potential Winner will be determined to be a Winner.  Monster expressly reserves the right to delay the announcement of the Winners for any reason it deems necessary.  In addition, Monster reserves the right to select alternate Winners in the event that any potential Winner fails to comply with these Official Rules.  

 

If, for any reason, more bona fide winners come forward seeking to claim a prize in excess of the one hundred and one (101) prizes available as set forth in these Official Rules, the Winner of the prize(s) available may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances.  The Sweepstakes Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected or unsuccessful efforts to notify the potential Winners.

 

6.  Liability Release and Indemnity:  By entering the Sweepstakes, Entrant agrees that Monster, any other Sweepstakes Entities, and each of their respective parents, subsidiaries, affiliated companies, employees, officers, directors, shareholders, agents, retailers, distributors and representatives are indemnified, released and will be held harmless by Entrant from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of a prize.  Each prize is offered and provided “as is” with no warranty or guarantee by Monster, either express or implied.  Any and all warranties and/or guarantees on the prizes (if any) are subject to the manufacturer’s terms therefore, and winner agrees to look solely to such manufacturer(s) for any such warranty and/or guarantee.  By participating in the Sweepstakes, each Winner acknowledges that the Sweepstakes Entities have not and will not obtain or provide insurance of any kind relating to the prizes.

 

Entrants agree to indemnify, defend, and hold harmless the Sweepstakes Entities from any and all liability arising out of or relating in any way to Entrant’s participation in the Sweepstakes and to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities arising out of participation in the Sweepstakes, use of the Sweepstakes website(s), or receipt or use of any prize, including but not limited to:  (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property (including to any computer systems resulting from participation in or accessing or downloading information in connection with the Sweepstakes), which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use of any prize.  Entrants assume all liability for an injury or damage caused, or claimed to be caused, by participation in this Sweepstakes, the use of any Sweepstake website(s), or the acceptance, receipt, or use of any prize or prize component.  Entrants further agree that in any cause of action, the Sweepstakes Entities’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Entities be liable for attorney’s fees. 

 

The Sweepstakes Entities assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, altered, tampered with, unauthorized, fraudulent, damaged, destroyed, delayed, misdirected, not delivered, not received, or that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in Sweepstakes, or by any human, mechanical or electronic error that may occur in the processing of the entries in Sweepstakes, or other errors appearing within the Official Rules or in any Sweepstakes related advertisements. The Sweepstakes Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Sweepstakes, errors in processing entries, identifying the Winners, in the announcement of the prizes and Winners, the delivery of the prizes, any problems or technical malfunction of any telephone network or lines, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any website, or any combination thereof, including, without limitation, any injury or damage to Entrant’s or any other person’s computer system or software related to or resulting from participation in, uploading any materials or downloading any materials in the Sweepstakes.  Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void.  Monster reserves the right in its sole discretion to disqualify any person it suspects or finds: (i) to have tampered with the entry process or the operation of the Sweepstakes; (ii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iii) to display behavior that will bring such Winner or the Sweepstakes Entities into disgrace (e.g., including but not limited to, a person committing acts of moral turpitude, and/or allegations or convictions of any crime); (iv) to have provided inaccurate information on any legal documents submitted in connection with the Sweepstakes; or (v) to be acting in violation of these Official Rules. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED. 

 

7.  Prize Terms: Total ARV of all prizes offered in the Sweepstakes will not exceed $11,000 U.S.D. The ARV is subject to change based upon current market conditions at the time of prize fulfillment. Any difference between the ARV and the actual value, if any, will not be awarded. All prize details not specified in these Official Rules will be determined in Monster’s sole discretion. The date for fulfillment of the Grand Prize and First Prizes is anticipated to be sometime on or about December 28, 2018; but all subject to change in Monster’s sole discretion.  If for any reason a prize is unavailable or any prize or related event is delayed, cancelled or postponed, or for any other reason, Monster reserves the right to modify the Sweepstakes in its sole discretion and award a substitute prize, or portion of a prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of a prize, or any portion thereof, is permitted by a Winner.  The Sweepstakes Entities shall have no responsibility or obligation to a Winner who is unable or unavailable to, or who does not for any reason, accept or utilize a prize. In the event a potential Winner cannot accept a prize, an alternate Winner will be randomly drawn from all remaining Eligible Entries.  Each prize is provided “as is”.  Entrants acknowledge that the Sweepstakes Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including any express warranties provided by any prize supplier that are sent along with a prize and any implied warranty of merchantability of fitness for a particular purpose.  Any prize pictured in online, television and print advertising, promotional packaging and other Sweepstakes materials are for illustrative purposes only.

 

The value of a prize will be taxable to the Winner as income.   An IRS Form 1099 and W9 will be issued in the name of the Winner for the actual value of the prize awarded.  All U.S. federal, state and local tax liability, and any other costs and expenses associated with acceptance or use of a prize not specifically provided for in these Official Rules are solely the Winner’s responsibility. 

 

8.  Grant of Rights.  By entering, Entrant irrevocably consents to the use of his or her name, image, photograph, likeness, biographical information, and any video footage related to the prize, for Monster’s advertising, promotional or other commercial purposes in all media now or hereafter known, worldwide and in perpetuity without additional compensation, unless prohibited by law.

 

9.  General Terms.    By entering the Sweepstakes,  Entrants:  (a) agree to be bound by these Official Rules and by the interpretation of these Official Rules by Monster and by the decisions of Monster, which are final and binding in all respects; (b) acknowledge compliance with these Official Rules; (c) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (d) agree to release and hold harmless the Sweepstakes Entities from and against any claims, injury or damages arising out of or relating to participation in the Sweepstakes and/or the use, misuse or redemption of a prize, and for any claim including claims based upon defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property-related cause of action arising from or related to the Sweepstakes, the prizes, or Monster’s  advertising and marketing related to the Sweepstakes, Entrants or the Winners.  Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

The Sweepstakes Entities are not responsible if the Sweepstakes cannot take place, or if any prize cannot be awarded due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of the Sweepstakes Entities.  If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sweepstakes Entities, which, in Monster’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Monster reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes or any part of the Sweepstakes. If the Sweepstakes or any part of the Sweepstakes is terminated or modified prior to the closing date of the Sweepstakes, notice will be posted on www.monsterenergy.com if time permits and the prizes will be awarded to a potential Winners to be selected in a random drawing from among all of the remaining uncorrupted Eligible Entries received prior to any such event outside of the reasonable control of Monster.  Monster reserves the right to modify and amend these Official Rules from time to time during the Sweepstakes for clarification purposes.

 

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, MONSTER RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

 

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Monster’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on a website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Monster’s sole and absolute discretion.

 

10.  Privacy: All information submitted by Entrants and collected by Monster in connection with Entrant’s entry will be subject to and will be treated in a manner consistent with Monster’s web site Terms of Use accessible at: https://www.monsterenergy.com/terms-of-use and Monster’s privacy policy available at:  https://www.monsterenergy.com/privacy-policy. By participating in the Sweepstakes, Entrants hereby agree that Monster may collect and use their personal information submitted with the entry.  Among other things, the information you provide may be used to send you company updates and announcements from Monster concerning the company and its products.    

 

 

11.  Binding Arbitration:  Except where prohibited by law, Entrant agrees: (1) any dispute, controversy or claim arising out of or relating to the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any dispute, controversy or claim arising out of or relating to the Sweepstakes or any prize awarded shall be resolved by binding arbitration conducted by JAMS in accordance with JAMS Comprehensive Arbitration Rules and Procedures (the “JAMS Rules”); (3) any arbitration shall be heard by one arbitrator to be selected in accordance with the JAMS Rules, in Orange County, California; (4) judgment upon any award rendered may be entered in any court having jurisdiction thereof; and (5) any award or judgment shall be subject to all limitations and releases set forth in these Official Rules and be limited to actual out of pocket damages, and shall not, in any event, include any punitive, exemplary, consequential or incidental damages, attorneys’ fees or costs of bringing a claim, or any injunctive or other equitable relief.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 

 

12.  Governing Law:  All federal, state and local laws and regulations apply.  Void where prohibited by law.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Monster in connection with the Sweepstakes, shall be governed by, and construed in accordance with, California law without giving effect to any choice of law or conflict of laws rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California. 

 

13.  Request for Names of Winners and Official Rules:  All requests for a copy of the Official Rules and for the name of the Winner must be made by November 30, 2018.  For the name of the Winner and/or Official Rules:  (i) send a self-addressed, stamped envelope postmarked to Monster Energy® Chance to Win a VIP UFC Experience in Las Vegas, PO Box 290904, Nashville, TN 37229; and (ii) write “Winners Names” and/or “Official Rules” on the lower left hand corner of the envelope.

(el “período de inscripción”).  La computadora de Monster es el dispositivo de registro del tiempo oficial para la inscripción en el sorteo.  Todas las inscripciones deben recibirse antes de las 11:59 p. m., hora del Pacífico de EE. UU., del 1 de diciembre de 2018.  

 

1.  Elegibilidad:  El sorteo está abierto para residentes legales que estén ubicados físicamente dentro de los cincuenta (50) Estados Unidos o el Distrito de Columbia, que tengan 18 años o más, o bien la mayoría de edad en su estado de residencia, la edad que sea mayor.  ESTE SORTEO ES NULO DONDE ESTÉ PROHIBIDO. Los empleados, funcionarios y representantes y los miembros de las familias inmediatas (es decir, padres, cónyuges, hermanos, hijos, abuelos, padrastros, hijastros y hermanastros y sus respectivos cónyuges y aquellas personas que vivan en el mismo hogar, ya sea que tengan algún parentesco o no) de Monster, Orbit Sales and Marketing, LLC (el “Administrador”), Zuffa, LLC, e Izigg, Inc. (“Izigg”), y sus respectivas empresas asociadas, sociedades matrices, filiales, socios promocionales que participen, minoristas, distribuidores, agencias de publicidad y promoción, administradores de sitios web y cualquier empresa involucrada en la creación, diseño, ejecución, producción o cumplimiento del sorteo (las “entidades del sorteo”) no son elegibles.  Todas las inscripciones entregadas de conformidad con estas reglas oficiales y que no sean descalificadas ni carezcan de validez se consideran “inscripciones elegibles”.  Todas las inscripciones son propiedad de Monster.

Límite de una (1) inscripción por persona por día. Conserve la copia en papel del recibo de inscripción.

• Método de inscripción sin necesidad de realizar una compra:  Visite www.monsterenergy.com/altvegas y complete el formulario de inscripción oficial en línea desde las 12:01 a. m. del 1 de mayo de 2018, hora del Pacífico de EE. UU., y finaliza el 30 de noviembre de 2018 a las 11:59 p. m., hora del Pacífico, EE. UU. Límite de una (1) inscripción por persona por día.

 

Términos y condiciones generales de participación A excepción del límite de una (1) inscripción por persona por día, no existe un límite para la cantidad de inscripciones elegibles enviadas por un participante durante el período de inscripción, independientemente del método de inscripción.  A los efectos de este sorteo, un “día” comienza a las 12:01 a. m., hora del Pacífico de EE. UU., y termina a las 11:59 p. m., hora del Pacífico de EE. UU.  Las inscripciones que estén incompletas, alteradas, dañadas, destruidas o falsificadas; que sean ilegibles, falsas o engañosas; que se hayan perdido, retrasado o enviado a la dirección incorrecta o bien que incumplan de otro modo las reglas oficiales podrán ser descalificadas del sorteo a criterio exclusivo y absoluto de Monster. Las inscripciones generadas por un guion, programas de computadora u otros medios macro, programados, robóticos o automatizados son inválidas y pueden ser descalificadas.  Los intentos posteriores realizados por el mismo individuo a fin de entregar varias inscripciones mediante el uso de información de contacto falsa, múltiples identidades o de otro tipo podrán ser descalificados.  Las entidades del sorteo no son responsables de las fallas técnicas de ningún tipo, incluido, sin limitación, el funcionamiento incorrecto de cualquier red inalámbrica, teléfono, computadora, red informática, equipos o programas informáticos o la falta de disponibilidad o inaccesibilidad de cualquier servicio.  Las entidades del sorteo no son responsables de las comunicaciones electrónicas que no se entreguen como consecuencia de cualquier forma de filtro activo o pasivo de cualquier tipo o espacio insuficiente en el teléfono del participante para recibir mensajes.  Aquellos participantes que no sigan todas las instrucciones, no proporcionen la información solicitada en el formulario de participación ni respeten estas reglas oficiales u otras instrucciones de Monster podrán ser descalificados. Todos los materiales enviados se convierten en propiedad de Monster y no se devolverán.  Las inscripciones ilegibles o incompletas y las enviadas por participantes que no cumplan con los requisitos de elegibilidad (incluidos todos los requisitos con respecto a la edad y residencia) se consideran nulas. Se aplicarán las tarifas de tiempo normales, si las hubiera, que cobre el proveedor móvil o de servicio de Internet de los participantes.

 

Las probabilidades de ganar dependen de la cantidad total de inscripciones elegibles recibidas durante el período de inscripción.

 

3.  Premios: Hay ciento un (101) premios disponibles. 

Premio mayor:  Un (1) “premio mayor” disponible. El “premio mayor” incluye: (a) un billete de avión de ida y vuelta para el ganador del premio mayor y un (1) acompañante a Las Vegas, Nevada; (b) una (1) estadía de cuatro (4) noches en un hotel; (c) acceso VIP para dos (2) a la lucha UFC el 29 de diciembre de 2018; y (d) $1,000 en efectivo para gastos. El valor aproximado de venta al público (ARV) del premio mayor es de $6,000. El valor aproximado de venta al público (ARV) de todos los premios mayores es de $6,000. El ARV del premio está sujeto a cambios en función de las condiciones de mercado presentes al momento de la entrega del premio. Cualquier diferencia entre el ARV y el valor real, si la hubiera, no se otorgará. Ningún participante puede ganar más de un (1) premio.

 

El ARV del premio mayor puede variar según la residencia del ganador del premio mayor, las condiciones del mercado, los cambios en el valor de los componentes (p. ej., transporte aéreo y tarifas de hotel) y otros motivos. Monster no es responsable de la diferencia entre el valor real del premio mayor en el momento de otorgamiento y el ARV establecido en estas reglas oficiales o en cualquier correspondencia o materiales relacionados con este sorteo, y el ganador del premio mayor no recibirá dicha diferencia. El incumplimiento de la compleción de cualquier componente de cualquier premio mayor no exime al ganador del premio mayor de sus obligaciones tributarias asociadas con ganar dicho premio mayor. Los preparativos del viaje específicos y todos los aspectos del premio que no se especifiquen en este documento se determinarán y aplicarán a criterio exclusivo de Monster. El viaje debe iniciar y finalizar en el mismo aeropuerto, y el ganador del premio mayor y su único acompañante deben viajar con el mismo itinerario. Es exclusiva responsabilidad del ganador del premio mayor cumplir con todos los requisitos del viaje, que pueden incluir, entre otros, la presentación de la identificación necesaria (incluida una con fotografía) al momento del viaje. Los cronogramas de vuelo están sujetos a cambios sin previo aviso. Monster no es responsable de cualquier evento u oportunidad perdidos relacionados con el premio o gastos incurridos como consecuencia de la cancelación o atraso de un vuelo o demora en el transporte terrestre. El ganador del premio mayor posiblemente deba proporcionar una tarjeta de crédito al momento del registro en el hospedaje para cubrir gastos imprevistos.

 

Primer premio: Cien (100) “primeros premios” disponibles.  Cada primer premio consiste en un (1) código de acceso en modalidad pago por visión en UFC.tv; el ARV es de $50.  El ARV de todos los primeros premios es de $5,000.

 

4.  Selección del ganador y notificación:  El 3 de diciembre de 2018, se elegirá a los “ganadores” potenciales mediante un sorteo al azar entre todas las inscripciones elegibles recibidas. Se notificará a cada ganador potencial dentro de los tres (3) días hábiles posteriores al sorteo.  Cada ganador potencial recibirá una notificación por correo electrónico (a la dirección de correo electrónico proporcionada con la inscripción) y deberá confirmar su dirección de correo electrónico. Los ganadores potenciales que se hayan inscripto con el método mediante compra deberán entregar una copia en papel del recibo de compra ganador. El premio que gane un participante se otorgará al titular de cuenta autorizado del número de teléfono o de la dirección de correo electrónico enviada con la inscripción, independientemente de la persona que haya enviado la inscripción ganadora.   Si no es posible contactar al ganador potencial luego de realizar un esfuerzo razonable o si el ganador no responde dentro de los siete (7) días luego de la fecha de notificación, el ganador potencial perderá el premio y se elegirá a un ganador potencial alternativo mediante un sorteo al azar entre todas las inscripciones elegibles restantes.  Si el ganador potencial alternativo no puede aceptar el premio, perderá el premio y se elegirá a otro ganador potencial alternativo mediante un sorteo al azar entre todas las inscripciones elegibles restantes.  Este proceso de selección del ganador y notificación continuará hasta que se confirme un ganador de cada premio.  Si un premio o una notificación de un premio se devuelven porque no se pudo realizar la entrega, el premio se perderá y se elegirá a un ganador potencial alternativo mediante un sorteo al azar.  El premio mayor se otorgará, si se reclama adecuadamente, antes del 28 de diciembre del 2018; después de esta fecha, no se seleccionará un ganador alternativo y no se otorgará el premio mayor si nadie lo reclama.    

 

5.  Verificación del ganador:  Dentro de los tres (3) días luego de haber sido notificado como ganador potencial, es posible que cada ganador potencial deba completar, firmar y devolver la documentación solicitada por Monster, lo que incluye una declaración jurada de elegibilidad certificada, una exención de responsabilidad y un formulario de divulgación de publicidad (excepto donde esté prohibido).  Si el ganador potencial cumple con las reglas oficiales, una vez que haya comprobado su elegibilidad satisfactoriamente y haya entregado la documentación solicitada por Monster, se determinará que el ganador potencial es el ganador.  Monster se reserva expresamente el derecho de demorar el anuncio del ganador por cualquier motivo que considere necesario.  Adicionalmente, Monster se reserva el derecho de seleccionar ganadores alternativos en el caso de que un ganador potencial no cumpla con estas reglas oficiales.  

 

Si, por algún motivo, más ganadores de buena fe reclaman un premio que exceda los ciento un (101) premios disponibles según lo establecido en estas reglas oficiales, se elegirá al ganador del premio disponible en un sorteo al azar entre todas las personas que realicen reclamos supuestamente válidos de dicho premio.  En tales circunstancias, la inclusión en el sorteo será la medida de reparación única y exclusiva de cada participante.  Las entidades del sorteo no se hacen responsables de los retrasos, las pérdidas, los daños, las interceptaciones, el uso de direcciones equivocadas o de cualquier fallo en la notificación a los posibles ganadores.

 

6.  Exención de responsabilidad y exoneración:  Al inscribirse en este sorteo, el participante acepta exonerar, eximir y liberar de toda responsabilidad a Monster, cualquier otra entidad del sorteo y cada una de sus respectivas sociedades matrices, filiales, empresas asociadas, empleados, funcionarios, directores, accionistas, representantes, minoristas, distribuidores y representantes, por cualquier daño, lesión o pérdida de cualquier tipo que afecte a una o más personas, incluida la muerte, o sus bienes, y que surja directa o indirectamente de la aceptación, la posesión, el uso incorrecto o la utilización de un premio.  Cada premio se ofrece y se proporciona “tal cual es” sin ninguna garantía contractual ni accesoria de Monster, ni explícita ni implícita.  Todas las garantías contractuales o accesorias de los premios (si las hubiera) están sujetas a las condiciones del fabricante; por ende, el ganador acepta dirigirse únicamente a dicho fabricante por tales garantías.   Al participar en el sorteo, cada ganador reconoce que las entidades del sorteo no han obtenido ni obtendrán, ni proporcionarán ningún tipo de seguro en relación con los premios.

 

Los participantes aceptan exonerar, defender y eximir a las entidades del sorteo de toda responsabilidad que surja como resultado de la participación de los participantes o que esté relacionada de cualquier manera con dicha participación en el Sorteo, como también aceptan renunciar a todos los derechos de iniciar cualquier demanda, acción o procedimiento contra las entidades del sorteo que surja de la participación en el sorteo, el uso del sitio web del sorteo, o bien de la recepción o utilización de cualquier premio, lo que incluye, por ejemplo, lo siguiente: (a) intervención humana no autorizada en el sorteo; (b) errores técnicos relacionados con computadoras, servidores, proveedores o líneas telefónicas o de red; (c) errores de impresión; (d) envíos de correo perdidos, retrasados, con franqueo a pagar, remitidos a direcciones equivocadas o no entregados; (e) errores en la administración del sorteo o en el procesamiento de las inscripciones; o (f) lesiones o daños a personas o bienes (incluido cualquier daño a sistemas de computación como resultado de la participación o el acceso a o la descarga de información en relación con el sorteo) que puedan haberse generado, directa o indirectamente, en parte o en su totalidad, por la participación del participante en el sorteo o por la recepción o utilización de cualquier premio.  Los participantes asumen toda responsabilidad por lesiones o daños causados, o supuestamente causados, por la participación en este sorteo, el uso de cualquier sitio web del sorteo o la aceptación, recepción o uso de cualquier premio o componente de un premio.  Además, los participantes aceptan que, en cualquier causa de demanda, la responsabilidad de las entidades del sorteo se limitará al costo de ingresar y participar en el sorteo y en ningún caso dichas entidades se responsabilizarán de los honorarios de los abogados. 

 

Las entidades del sorteo no asumen responsabilidad y descalificarán a las inscripciones que reúnan las siguientes características: robadas, perdidas, ilegibles, incompletas, inválidas, incomprensibles, alteradas, manipuladas, no autorizadas, fraudulentas, dañadas, destruidas, atrasadas, enviadas a la dirección incorrecta, no entregadas, no recibidas o que tengan información de inscripción incorrecta o imprecisa, ya sea que la causa de dicha característica sea por cualquier equipo o programación asociados con el sorteo o utilizados en este, o por cualquier error humano, mecánico o electrónico que pueda producirse en el procesamiento de las inscripciones del sorteo u otros errores que aparezcan en las reglas oficiales o en cualquier publicidad relacionada con el sorteo. Las entidades del sorteo no asumen la responsabilidad por errores tipográficos ni cualquier otro error en la impresión de la oferta o la administración del sorteo; errores en el procesamiento de inscripciones, la identificación de los ganadores, el anuncio de los premios y ganadores, o la entrega de los premios; cualquier problema o avería técnica de cualquier línea de teléfono o red, sistemas informáticos, sistemas en línea, servidores o proveedores, equipos de computación y programas informáticos; falla de cualquier correo electrónico o reproductores por problemas técnicos o congestión de tráfico en Internet o cualquier sitio web, o cualquier combinación de estos problemas, incluida, a mero título enunciativo, cualquier lesión o daño al sistema o a los programas informáticos del participante o cualquier otra persona, que estén relacionados o surjan como resultado de la participación en este sorteo o la carga o descarga de materiales.  Se prohíbe el uso de cualquier dispositivo para automatizar o manipular las inscripciones y se anulará cualquier participación que se reciba de esta manera.  Monster se reserva el derecho, a su exclusivo criterio, a descalificar a toda persona de la que se compruebe o se sospeche que (i) altera el proceso de solicitud de participación o la operación del sorteo; (ii) actúa de manera perjudicial o con la intención de fastidiar, abusar, amenazar o acosar a cualquier otra persona; (iii) muestra un comportamiento que avergüence a dicho ganador o a las entidades del sorteo (por ejemplo, entre otros casos, una persona que cometa actos de inmoralidad o acusaciones o condenas por un crimen); (iv) proporciona información inexacta en cualquier documento legal entregado en conexión con el Sorteo; o (v) actúa en violación de estas reglas oficiales. CUALQUIER VIOLACIÓN DE ESTAS REGLAS OFICIALES POR PARTE DE UN GANADOR DARÁ COMO RESULTADO LA DESCALIFICACIÓN DE DICHO GANADOR COMO GANADOR DEL SORTEO Y TODOS LOS PRIVILEGIOS DE ESE TÍTULO SE TERMINARÁN INMEDIATAMENTE. 

 

7.  Condiciones del premio: El ARV total de todos los premios ofrecidos en el sorteo no deberá exceder $11,000. El ARV está sujeto a cambios en función de las condiciones de mercado actuales en el momento de la entrega del premio. Cualquier diferencia entre el ARV y el valor real, si la hubiera, no se otorgará. Todos los aspectos del premio que no se especifiquen en estas reglas oficiales se determinarán a criterio exclusivo de Monster. La fecha de entrega del premio mayor y los primeros premios está prevista aproximadamente para el 28 de diciembre de 2018; no obstante, todo queda sujeto a cambio a criterio exclusivo de Monster.  Si, por cualquier motivo, un premio no está disponible o cualquier premio o evento relacionado se demora, cancela o pospone o por cualquier otra razón, Monster se reserva el derecho de modificar el sorteo a su exclusivo criterio y de otorgar un premio sustituto, o parte de un premio, de valor equivalente o mayor según lo establecido en estas reglas oficiales. No se le permite al ganador ninguna sustitución, transferencia, asignación o equivalente en efectivo de un premio o cualquier parte de este.  Las entidades del sorteo no tendrán ninguna responsabilidad ni obligación ante un ganador que sea incapaz o no esté disponible, o por cualquier motivo, de aceptar o utilizar un premio. En el caso de que un ganador potencial no pueda aceptar un premio, se sorteará al azar un ganador alternativo a partir de todas las inscripciones elegibles restantes.  Cada premio se proporciona “tal cual es”.  Los participantes reconocen que las entidades del Sorteo no han sido ni son responsables en ningún modo de ninguna garantía contractual, accesoria o declaración, expresa o implícita, de hecho o de derecho, relacionada con el premio, incluidas las garantías expresas proporcionadas por un proveedor del premio, que puedan enviarse junto con el premio, y cualquier garantía implícita de comercialización y adecuación para un fin particular.  Cualquier premio que aparezca en materiales en línea, televisión o publicidades impresas, paquetes promocionales u otros materiales del sorteo tiene un fin meramente ilustrativo.

 

El valor de un premio será gravable a los ganadores como ingresos.   Se emitirán los formularios 1099 y W9 del IRS en nombre del ganador por el valor real del premio otorgado.  Toda carga tributaria local, estatal o federal estadounidense y cualquier otro costo o gasto asociados con la aceptación o uso de un premio no contemplados específicamente en estas reglas oficiales son responsabilidad exclusiva de los ganadores. 

 

8.  Concesión de derechos.  Al inscribirse, el participante otorga su consentimiento de forma irrevocable para el uso de su nombre, imagen, fotografía, figura, información biográfica y cualquier material de video relacionado con el premio, para fines de publicidad, promoción u otros fines comerciales de Monster en todos los medios conocidos actualmente o que se conozcan de aquí en adelante, en todo el mundo y a perpetuidad, sin compensación adicional, salvo que esté prohibido por la ley.

 

9.  Condiciones generales.    Al inscribirse en este sorteo, los participantes: (a) aceptan estar sujetos a estas reglas oficiales, a la interpretación de dichas reglas oficiales por parte de Monster y a las decisiones de Monster, las cuales son finales y vinculantes en todos los aspectos; (b) reconocen el cumplimiento de las reglas oficiales; (c) aceptan cumplir con todas las leyes, normas y regulaciones locales, estatales y federales pertinentes; y (d) aceptan liberar de toda responsabilidad a las entidades del sorteo de cualquier reclamo, lesión o daños que surjan o estén relacionados con el sorteo o el uso, mal uso o reembolso de un premio, y para cualquier demanda, incluidas aquellas basadas en difamación, derechos de publicidad, invasión de la privacidad, violación de derechos de autor, violación de marcas registradas o cualquier otra demanda relacionada con la propiedad intelectual que surja o esté relacionada con el sorteo, los premios o la publicidad y comercialización de Monster en conexión con el sorteo, los participantes o los ganadores.  La adjudicación de premios está supeditada al cumplimiento de todos los requisitos establecidos en el presente documento.

 

Las entidades del sorteo no se responsabilizan si el sorteo no puede llevarse a cabo o si cualquier premio no puede otorgarse debido a demoras, interrupciones o fallas por casos fortuitos, guerras, desastres naturales, factores climáticos, actos o amenazas de terrorismo, huelgas, cierres patronales, disputas laborales, interrupción de trabajo, incendios, actos de gobierno u otros eventos fuera del control razonable de las entidades del sorteo.  Si por algún motivo este sorteo no puede llevarse a cabo de la manera prevista debido a un virus informático, defecto informático, alteración, intervención no autorizada, fraude, fallas técnicas o cualquier otra causa que esté fuera del control razonable de las entidades del sorteo y que, a discreción exclusiva de Monster, pueda corromper o afectar la administración, seguridad, equidad, integridad o la correcta realización de este sorteo, Monster se reserva el derecho, a criterio exclusivo, de cancelar, finalizar, modificar o suspender el sorteo o cualquier parte de este. Si el sorteo o cualquier parte de este finaliza o se modifica antes de su fecha de cierre, se publicará un aviso en www.monsterenergy.com si el tiempo lo permite, y los premios se otorgarán a los Ganadores potenciales, los cuales se seleccionarán en un sorteo al azar a partir de todas las inscripciones elegibles restantes no corruptas que se hayan recibido antes de dicho evento fuera del control razonable de Monster.  Monster se reserva el derecho a modificar y corregir estas reglas oficiales ocasionalmente durante el sorteo, a efectos de clarificación.

 

CUALQUIER INTENTO POR PARTE DE UNA PERSONA DE DAÑAR DELIBERADAMENTE O MENOSCABAR EL FUNCIONAMIENTO LEGÍTIMO DE ESTE SORTEO CONSTITUYE UNA VIOLACIÓN DE LAS LEYES CIVILES Y PENALES Y, EN CASO DE PRODUCIRSE TAL INTENTO, MONSTER SE RESERVA EL DERECHO A BUSCAR MEDIOS JUDICIALES E INDEMNIZACIÓN (INCLUIDOS LOS HONORARIOS DE LOS ABOGADOS) CONTRA TALES PERSONAS HASTA DONDE PERMITA LA LEY. 

 

La invalidez o la incapacidad de aplicar alguna disposición de estas reglas oficiales no afectarán la validez o aplicabilidad de cualquier otra disposición. En caso de que alguna disposición de las reglas oficiales se determine como no válida o si no se puede aplicar o es ilegal, las otras disposiciones permanecerán en vigencia y serán interpretadas de acuerdo con sus términos como si la disposición no válida o ilegal no formara parte del presente documento. El incumplimiento de Monster de imponer algún término de estas reglas oficiales no constituirá una renuncia de esa disposición. Los participantes aceptan renunciar a cualquier derecho a alegar ambigüedad de estas reglas oficiales. Los encabezados obedecen únicamente al propósito de facilitar la referencia y no afectarán de ninguna manera la interpretación o el propósito de los documentos o cualquiera de sus disposiciones. En el caso de que haya una discrepancia o inconsistencia entre las disposiciones u otras declaraciones contenidas en cualquier material relacionado con el sorteo, las políticas de privacidad o los términos de uso de un sitio web o los términos y condiciones de las reglas oficiales, las reglas oficiales prevalecerán, regirán y controlarán, y la discrepancia se resolverá a criterio exclusivo y absoluto de Monster.

 

10.  Privacidad: Toda la información enviada por los participantes y recopilada por Monster en relación con la participación de estos estará sujeta y se tratará de acuerdo con las condiciones de uso del sitio web de Monster, al que puede acceder en https://www.monsterenergy.com/terms-of-use y a la política de privacidad de Monster, disponible en https://www.monsterenergy.com/privacy-policy. Al participar en el sorteo, los participantes, mediante el presente, aceptan que Monster puede recopilar y usar su información personal enviada con la inscripción.  Entre otros propósitos, la información que usted proporciona puede utilizarse para enviarle actualizaciones y anuncios sobre Monster con respecto a la empresa y sus productos.  

  

11.  Arbitraje vinculante:  Excepto donde esté prohibido por la ley, el participante acepta lo siguiente: (1) todo litigio, controversia o reclamación que surja o se relacione con el presente sorteo o cualquier premio otorgado se resolverá individualmente, sin recurrir a ningún tipo de acción de clase; (2) todo litigio, controversia o reclamación que surja o se relacione con el sorteo o cualquier premio otorgado se resolverá por arbitraje vinculante realizado por los Servicios de Arbitraje y Mediación (JAMS) de acuerdo con las Reglas y Procedimientos Integrales de Arbitraje (las “reglas JAMS”); (3) cualquier arbitraje será llevado a cabo por un árbitro que se seleccionará de acuerdo con las reglas JAMS, en el condado de Orange, California; (4) las decisiones judiciales que se hagan sobre los fallos que surjan pueden ingresarse en cualquier corte que tenga jurisdicción; y (5) todos los fallos o decisiones judiciales estarán sujetos a todas las limitaciones y exenciones establecidas en estas reglas oficiales y estarán limitados a perjuicios por pérdidas efectivas y no incluirán, en ningún caso, daños punitivos, ejemplares, consecuentes o incidentales, honorarios de abogados o costos de presentar una demanda, o cualquier otra forma de resarcimiento judicial o equitativo.  ALGUNAS JURISDICCIONES NO PERMITEN LAS LIMITACIONES NI LA EXCLUSIÓN DE RESPONSABILIDAD DE DAÑOS INCIDENTALES O CONSECUENTES, POR LO QUE ES POSIBLE QUE LO MENCIONADO ANTERIORMENTE NO SE APLIQUE EN SU CASO. 

 

12.  Ley aplicable:  Se aplican todas las leyes y regulaciones locales, estatales y federales.  Este sorteo es nulo donde esté prohibido por la ley.  Todos los asuntos y las preguntas con respecto a la interpretación, validez y aplicabilidad de estas reglas oficiales, o de los derechos y las obligaciones del participante y Monster con respecto al sorteo, se regirán y se interpretarán de acuerdo con las leyes de California, sin dar efecto a cualquier elección de ley o conflicto de reglas de la ley (ya sea de California o cualquier otra jurisdicción), lo cual causaría la aplicación de las leyes de cualquier jurisdicción además de California.
