PROMOTION TERMS & CONDITIONS

Please read these terms & conditions (“Terms”) carefully.  By entering the Promotion (as defined below), you are agreeing to be bound by these Terms.  You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering this Promotion.

1. Subject to the provisions of paragraph 4 below, this promotion (“Promotion") is open to all persons aged eighteen (18) years of age or over who are resident in Lithuania.
2. This Promotion is being organised by Monster Energy Europe Limited of Unit 51 Metropolitan Park, Bristol Road, Greenford Middlesex UB6 8UP  (“Monster Energy”).
3. The Promotion is being conducted through the website at www.monsterenergy.com/motogp_lt (the “Website”) and through promotional material within selected stores (or chains of stores) throughout Lithuania.
4. No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion.
5. By entering this Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy in relation to all matters relating to the Promotion, whose decision shall be final.  No further correspondence will be entered into by Monster Energy.
6. All times and dates set out in these Terms refer to the times and dates of Lithuania.  In the event of any dispute over the time or date of any entry submitted, the decision of Monster Energy shall be final.

Entry

7. The commencement date of the promotion is 00:01 on 02 January 2017 (“Commencement Date”) and the closing date for the promotion is 23:59 on 28 February 2017 (“Closing Date”). 
8. Entrants may enter by:
   1. acting in accordance with these Terms; and
   2. submitting their details (being full name, date of birth, telephone number, email address and full resident address) as directed on the Website.
9. No purchase of any product or other form of payment is required to enter this Promotion.
10. Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.

Draw and Prize

11. Each entrant that validly submits their entry in accordance with paragraph 8 (each a “Valid Entry”) will be entered into the prize draw, to be held within seven (7) days of the Closing Date (“Draw”), where the first randomly drawn Valid Entry to be pulled from the Draw (“Winner”) shall win the Prize (defined below.  
12. The Winner shall win a five (5) days trip for two (2) people from 08 June 2017 to 12 June 2017 to Catalunya, Spain (“Prize”) worth the approximate retail value of three thousand Euros (€3,000.00) which shall consist on the following:
    1. two (2) general access passes for entrance and access to all public areas within the MotoGP™, Catalunya, Spain (“Event”) during the opening hours of the Event on each of 10 and 11 June 2017;
    2. four (4) night stay for two (2) people in twin room accommodation of no less than a three (3) star rating hotel to be selected by Monster Energy in its absolute discretion, subject to availability (“Hotel”);
    3. two (2) economy flight return tickets for two (2) people from an airport in Lithuania to an airport in Catalunya, Spain (“Destination Airport”). The airport locations, dates and times of the flights shall be determined by Monster Energy in its complete discretion, subject to availability;
    4. return economy transfers from Destination Airport to Hotel and from Hotel to each day of the Event at the times, dates and mode of transport to be  determined by Monster Energy in its absolute discretion, subject to availability;
    5. selected meals as determined by Monster Energy in its absolute discretion throughout the dates of the Prize; and
    6. the opportunity to have a photographer take a photo of the Winner and the Elected Person (defined below) with one (1) or more Monster Girls to create a poster.  The date, time and other details of the shoot shall be determined by Monster Energy in its complete discretion, subject to availability. 
13. Only the Winner and its Elected Person may enjoy the benefits of the Prize.  The Elected Person must be approved by Monster Energy, be aged eighteen (18) years of age or older and be resident in Lithuania. 
14. Subject to paragraph 17, the potential winner and their Elected Person will be required to
    1. sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Prize confirming understanding, compliance with and acceptance of the waiver.  Copies of the applicable confirmation and waiver can be obtained upon request to [email protected] before being declared the Main Winner and receiving the Main Prize.

Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the potential winner forfeiting their right to receive the Prize and Monster Energy drawing another qualifying entry as soon as reasonably possible thereafter.

15. For the avoidance of doubt, all other costs associated with the Prize, including without limitation, tax, valid health insurance for travel, a valid travel visa (if applicable), transportation, equipment, sustenance, any entertainment and anything related to the Prize not specifically included and outlined in the definition of the Prize at paragraph 12 above will be borne solely by the Winner.  Accommodation is on a room only basis and the Winner and the Elected Person will be responsible for all food and beverage consumed elsewhere and all additional room charges. The Winner and Elected Person must hold a valid passport or an officially issued personal identity card. The Winner hereby agrees to sign and comply with any terms and conditions provided by the relevant service providers for the services set out in paragraph 12.
16. It is the responsibility of the Winner the Elected Person to be available for the dates of the Prize and to provide any required documentation and any other legal requirements for the Prize and/or documentation required by Monster Energy.
17. Before being declared a Winner and receiving their Prize, the potential winner will be required to prove eligibility, including, without limitation, proof of age, residence, identity, which may include but is not limited to a copy of proof of residence, passport and/ or similar government issued identification.  Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the potential winner forfeiting their right to receive a Prize and Monster Energy drawing another qualifying entry as soon as reasonably possible thereafter.

Notification and Prize Delivery

18. The potential Winner will be notified telephonically and/or by email via the telephone number and/or email address provided to enter the Promotion within seven (7) days after the Draw (“Notification”). 
19. Unsuccessful entrants will not be notified.
20. Details of delivery shall be provided to the potential Winner at Notification.
21. In the event that the Monster Energy cannot contact the potential winners within twenty (20) days of Notification or the potential winners are unavailable to collect and/or attend their Prize for any reason whatsoever, such entry will be deemed null and void and Monster Energy shall draw another qualifying entry as soon as reasonably possible thereafter.

General Terms

22. No entry shall be able to provide alternative contact information to that provided to enter the Promotion for any reason.
23. For the avoidance of doubt a computer and internet access is required to enter this Promotion.  It is the responsibility of the entrant to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider.  No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in this Promotion.
24. Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques. 
25. If there is any dispute as to the identity of a Winner, the decision of Monster Energy shall be final.
26. All entries are deemed to have been received at the time of entry into the Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant.  Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received. Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason. 
27. The Prizes are as described and is not transferable, not exchangeable and no cash alternative will be offered in the event that a potential winner is unable to claim the Prize for any reason whatsoever.  In the event of unforeseen circumstances, Monster Energy reserves the right to replace an entire Prize or prize components with prizes of equal or greater value.
28. The Winners agree to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winners consent to Monster Energy using their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion.
29. The Winners’ names will be available on written request for two months after the Closing Date.
30. Neither Monster Energy nor any of its affiliate companies, employees, directors, agents, assigns or sub-contractors accepts any responsibility or liability for any damage, loss, injury or disappointment suffered by any entrant accessing the Website, entering the Promotion competition or as a result of accepting any Prize.  Proof of sending is not accepted as proof of receipt.  Monster Energy is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any delay or failure of any postal or equivalent delivery service, or any combination thereof, including any injury or damage to the entrant´s or any other person´s computer or mobile telephone related to or resulting from participation in the Promotion.  
31. Nothing shall exclude Monster Energy’s liability for fraudulent misrepresentation, death or personal injury as a result of such entity’s negligence or any other liability that cannot be excluded or restricted by law.
32. Events may occur that render the Promotion itself or the awarding of any Prize impossible due to reasons which Monster Energy could not foresee and which are beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
33. Monster Energy reserves the right to:
    1. change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and
    2. refuse entry of any individual to the Promotion or future events organised by Monster Energy:
       1. where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part;
       2. where an entrant has been disqualified from any Monster Energy competition or promotion within twelve (12) months of the Commencement Date;
       3. where Monster Energy reasonably believes such individual has not complied with these Terms; and/or
       4. where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
34. Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant.   The Winner will be liable for any tax chargeable in relation to their Prize. 
35. It is advised that all entrants retain a copy of these Terms for future reference.
36. The Promotion and these Terms are governed by the laws of England and Wales and any disputes (contractual or non-contractual) arising under or in connection with the Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in England and Wales.
