Promoters

1. Foodstuffs (N.Z.) Limited and Coca-Cola Amatil NZ Limited (CCA) are the joint Promoters of this promotion (together the Promoters).
2. Monster Energy AU Pty Ltd. is not a promoter of this promotion. The Monster Energy brand names, logos and/or materials are used for the purposes of promotion and/or prize descriptions only and such use is not intended to suggest or imply Monster Energy AU Pty Ltd.’s sponsorship of this promotion.
3. The promotion is being conducted throughout Four Square Stores in the South Island. Information regarding prizes and how to enter forms part of these conditions. By entering this prize draw you accept these terms and conditions.

Promotion Period

4. The promotion entry period will commence on Monday 10^th August 2020 and will run until 11.59pm (NZST) on Sunday 23^rd August 2020 (Promotion Period).

Method of Entry

5. To qualify to enter the promotion , customers must purchase any TWO 500mL Monster Energy Products (all variants) in a single transaction during the Promotion Period at any participating Four Square Store (Qualifying Purchase).

 

6. One entry form will be given per Qualifying Purchase made. For example if 2 products are purchased in a single transaction = 1 entry, 4 products are purchased in a single transaction = 2 entry forms, 6 products are purchased in a single transaction = 3 entry forms and so on and so forth. Each entry form provides you with one entry in to the prize draw. The entry forms can only be obtained at the checkout at the time a Qualifying Purchase is made. Each entry form can only be used once.

 

7. To enter the promotion fill in all the required details in the entry form and drop it into the entry box. Entries must be submitted in the same participating store where the Qualifying Purchase is made.

 

8. Incomplete or invalid entries or those not submitted in accordance with the entry instructions will not be accepted. The Promoters accept no responsibility for late or lost entries. Entries will not be accepted outside of the Promotion Period.

 

Prize

9. There is one prize of a Monster Gear Pack with an estimated value of $150NZD (Prize) to be won in every Four Square Store in the South island.

 

10. Each Prize consists of:

1. 1 X Monster Energy premium backpack;
2. 1 X Monster Energy Snapback black cap;
3. 1 X Monster Energy Sergeant t-shirt; and
4. 1 X Monster Energy socks.

 

11. There are 62 Monster Energy Gear Pack Prizes to be won in total. The estimated total prize pool is valued at NZD$9,300. The products within the Prize are unavailable for purchase in any store so this value is an estimate only.
12. Colours and sizes are final and cannot be exchanged. Prizes illustrated on the point of sale, social images are not indicative of the exact prizes.
13. All winners will be drawn by 13 September 2020, with one winner randomly selected for each participating Four Square South Island Store from all valid entries received (ie. completed and submitted entry forms) in that store during the Promotion Period.
14. Prizes are not transferable, exchangeable or redeemable for cash.

 

15. The winner will be notified via the e-mail address or mobile number supplied on the drawn entry form within 48 hours of the prize draw taking place. If a winner cannot be contacted within 10 working days, his/her Prize will be redrawn and awarded to another eligible entrant on the same terms and conditions as the original draw. The Promoters are not responsible for any incorrect or inaccurate information submitted on the entry form.

 

16. If the Prize is unavailable for any reason beyond the Promoters’ reasonable control, the Promoters reserve the right to substitute the Prize with a prize of equal or greater value.

 

Conditions

17. Entrants into the promotion must be aged 18 years or older.

 

18. The Promoters’ decisions and the draw results are final and not subject to appeal.

 

19. If this promotion cannot run as planned for any reason beyond the Promoters’ reasonable control, for example due to software, hardware or communication issues, unauthorised intervention, tampering, fraud or technical failure, the Promoters may end, change or suspend the promotion or disqualify affected entries/entrants, subject to any applicable law.

 

20. The Promoters may amend these terms and conditions at any time and wherever possible such amended terms and conditions will be displayed at participating Four Square Stores or online at www.monsterenergy.com

 

21. To the extent permitted by law, participants waive all claims they may have otherwise had against Foodstuffs North Island Limited, Foodstuffs South Island Limited, the Promoters or Four Square Stores in relation to this promotion.

 

22. Although the number of entries that can be submitted per person is not limited, a person may only win once regardless of how many entries that person submits based on Qualifying Purchases made at one or more Four Square Stores. If the same person is drawn as a winner more than once, the relevant prize draws will be redrawn and a new winner will be determined from the remaining valid entries.
23. The Promoters and the agencies and companies associated with the promotion are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this promotion or any prize, except for any liability under which statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
24. The winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoters. These rights include statutory guarantees that any goods provided by the Promoters will be of acceptable quality and fit for purpose. These terms and conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoters make no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the prize awarded as part of this promotion and will not be responsible for breach of such representations or warranties.

Eligibility

 

25. The Promoters reserve the right to require all winners provide proof of identity.

 

26. To be eligible to receive a prize a winner must:

1. not be a person who is excluded from the promotion under these terms and conditions; and
2. comply with these terms and conditions; and
3. consent to Foodstuffs’ use of their name and image for publicity and promotional purposes and make him or herself available for publicity photographs, without any additional compensation.

 

The Promoters’ decision as to eligibility will be final.

27. If you enter or attempt to enter the prize draw in a manner, which in the Promoters’ opinion, is contrary to these terms or is fraudulent or unjust to other entrants (such as hacking, cheating, deception, or any other unfair playing practices), your entry may be rejected at the Promoters’ sole and absolute discretion.

 

Privacy and Contact

28. The Promoters collect entrants’ personal information in order to conduct this promotion. Entry is conditional on providing this information. Entry details will be dealt with in accordance with the Privacy Act 1993 and these terms and conditions. Under the Privacy Act, you have the right to access and correct any personal information held by the Promoters in relation to this prize draw. Entrants can obtain a copy of the Promoters’ Privacy Policy at http://www.foursquare.co.nz/about/privacy-policy/ or by contacting the Promoters via the postal address provided below.
