TERMS AND CONDITIONS OF ENTRY

 

PROMOTION

 

  1. Coca-Cola Amatil NZ Limited, The Oasis, 19 Carbine Road, Mt Wellington, Auckland, is the Promoter of this Promotion (Promoter).

 

  1. Monster Energy AU Pty Ltd. is not a promoter of this Promotion. The Monster Energy brand names, logos and/or materials are used for the purposes of promotion and/or prize descriptions only and such use is not intended to suggest or imply Monster Energy AU Pty Ltd.’s sponsorship of this Promotion.

 

  1. Information regarding prizes and how to enter the Promotion form part of these terms and conditions of entry (Terms and Conditions). Entry into the Promotion is deemed as acceptance of the Terms and Conditions.

 

  1. You must be living in New Zealand and aged 18 years or older to enter.

 

  1. Employees of the Promoter, Night ‘n Day and any agency associated with the Promotion, and the immediate families of such employees, are ineligible to enter.

 

  1. To be eligible to receive a Prize (defined below), a winner must:
  1. not be a person who is excluded from the Promotion under these Terms and Conditions; and
  2. comply with these Terms and Conditions; and
  3. consent to the Promoter’s use of their name and image for publicity and promotional purposes and make him or herself available for publicity photographs, without any additional compensation.

 

 

HOW TO ENTER

 

  1. The Promotion begins at 12.01am (NZST) on 27 September 2021 and ends at 11:59pm (NZDT) on 24 October 2021 (Promotion Period). No entries will be accepted outside the Promotion Period.
  2. Purchase any two 500ml Monster Energy cans (all flavours included) (excluding online and vending machine purchases) in a single transaction during the Promotion Period at any participating Night ‘n Day store (Participating Store), as identified by the display of in-store promotional material (see https://www.nightnday.co.nz/stores for a full list of stores) (Qualifying Purchase), to receive one entry form. To enter the Promotion, fill in all the required details in the entry form and drop it into the entry box in the Participating Store. Entries must be submitted in the entry box at the same Participating Store where the Qualifying Purchase is made. Failure to provide all relevant details may result in the entry being declared invalid. You must retain your itemized receipt as proof of purchase.
  3. For the avoidance of doubt, one entry form will be provided by the Participating Store cashier per Qualifying Purchase. For example, if 4 products are purchased in a single transaction = 2 entry forms will be given, 6 products are purchased in a single transaction = 3 entry forms will be given and so on. The entry forms can only be obtained at the checkout at the time a Qualifying Purchase is made. Each entry form can only be used once.

PRIZE DETAILS

  1. There will be one (1) winner per Participating Store. Each winner will receive a Monster Energy Branded Rolling Cooler (Prize), with an estimated value of NZ$180. Prize colours and sizes are final.
  2. There are 51 Prizes in total and the estimated total prize pool value is NZ$9180. The Prize is not available for purchase in any store, so this value is an estimate only.
  3. Prizes will be drawn by each Participating Store by 8 November 2021 by random selection from all valid entries received during the Promotion Period. The first eligible entry drawn at each Participating Store will win the Prize.
  4. Each Prize must be collected from the Participating Store where the winning entry was submitted.
  5. The winner will be notified via the e-mail address or phone number supplied on the drawn entry within 48 hours of the winning entry being drawn. If a winner cannot be contacted within 10 working days after the first attempted contact, his/her Prize will be redrawn, and a new winner will be determined from the remaining valid entries. The Promoter is not responsible for any incorrect or inaccurate information submitted on the entry form.
  6. A person may enter as many times as they wish but can only win one Prize, regardless of how many entries that person submits, even if at different Participating Stores. If a person who has already won a Prize is drawn as a winner in connection with another Participating Store, the relevant Prize draw will be redrawn, and a new winner will be determined from the remaining valid entries.

 

GENERAL

  1. The winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill. These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties.
  2. The Prize is not exchangeable and cannot be redeemed for cash.
  3. If the Prize is unavailable for any reason, the Promoter reserves the right to substitute the Prize in whole (or any of its components), with a substitute prize of equal or greater value.
  4. The winner may be required to show proof of age and purchase to verify eligibility.
  5. The Promoter and the agencies and companies associated with this Promotion are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, or damage suffered in connection with this Promotion or the Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  6. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  7. The Promoter’s decision in connection with all aspects of this Promotion is final and no correspondence will be entered into.
  8. Entrants must comply with all requirements of the Promoter including requirements specified in the Terms and Conditions. If an entrant enters or attempts to enter the Promotion in a manner, which in the Promoter’s opinion, is contrary to these Terms and Conditions or is fraudulent or unjust to other entrants (such as hacking, cheating, deception, or any other unfair playing practices), the entry may be rejected at the Promoter’s sole and absolute discretion. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:

 

  1. fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction;
  2. tampers with or benefits from any tampering with the entry process or the operation of the Promotion;
  3. submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions;
  4. acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person;
  5. in the opinion of Promoter, engages in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter;
  6. breaches any law; or
  7. behaves in a way that is otherwise inappropriate.
  1. The Promoter collects entrants’ personal information in order to conduct the Promotion. Entry is conditional on providing this information. By entering this Promotion, unless otherwise advised, each entrant agrees that the Promoter may use the entrant’s personal information to conduct the Promotion in accordance with these Terms and Conditions (including to send electronic messages or telephone the entrant in relation to the Promotion).
  2. The Promoter may disclose such information to third parties, including but not limited to agents, contractors, service providers and other suppliers for the purpose of conducting the Promotion. The details of winners will be held in accordance with the Promoter’s Privacy Policy that can be accessed at https://www.ccamatil.com/nz/privacy-policy. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the New Zealand Information Privacy Principles or any other applicable law and how those complaints will be dealt with. Winners should direct any request to access, update or correct information to the Promoter at the postal address provided in clause 1 above. All information provided by participants will become property of the Promoter. All information submitted will remain anonymous.
  3. Each winner consents to and waives all rights (including copyright and moral rights), in connection with, the use of their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media without remuneration for the purpose of promoting this Promotion and promoting any products manufactured, distributed and/or supplied by the Promoter.
  4. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, acts or omissions of third parties, technical failures, governmental restraint, order or regulation or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion.   1. The Promoter is not responsible for any tax implications arising from the winner winning the Prize. Winners should seek independent financial advice.
