Terms and Conditions

Who is running the competition?

When will the competition start and end?

The Competition starts at 12.01am (NZST) on 15/04/2019 and ends at 11.59pm (NZST) on 12/05/2019 (the Competition Period).

Who can enter?

Entry is only open to New Zealand residents who are aged 18 years and over excluding:

(a) management, employees, directors and contractors of the Promoter, Coca Cola Amatil New Zealand, Zuffa, LLC, its related bodies corporate, the participating stores and other agencies, firms or companies associated with the Competition (including suppliers of prizes);

(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph (a) above;

(c) persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any competition or promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Competition Period;

(d) persons who have used or attempted to use any more than one name in order to qualify to win a competition or promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and

(e) persons who have breached the terms and conditions of any competition or promotion run by or on behalf of the Promoter.

(f) the promoter reserves the right, at any time, to request proof of your eligibility in the event that there is a doubt over your eligibility for the Competition.

The persons referred to in paragraph (b) above include natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an eligible entrant in its absolute discretion.     

Where will the competition run?

The Competition will run in participating BP, FIX, Z and Red Circle Retail Program stores (Stores) in New Zealand.

Do I need to buy anything to enter?

Yes. During the Competition Period, you need to buy, in one transaction, any 2 (two) x 500ml Monster Energy® energy drink cans (all variants) (excluding online and vending machine purchases) (Qualifying Purchase) from a participating Store and retain your receipt as proof of purchase.

Your purchase receipt must clearly identify the Store of purchase, the product/s purchased (which must comprise a Qualifying Purchase) and the date of purchase (which must be during the Competition Period and before you submitted your entry).

Entry Instructions

At the time of making a Qualifying Purchase, you must receive an entry card with your unique code from the Store cashier and text the entry code to 381 to be in the draw for a chance to win.

How many winners will there be and how will they be chosen?

There will be 1 winner determined in respect of this Competition.

The draw will be held at 12pm (NZST) on May 15, 2019 at Farrimond, 5 Eglon Street, Parnell, 1052, Auckland.

The first valid entry drawn randomly from the entries received during the Competition Period will win the Prize.

The Promoter may draw additional reserve entries and record them in order, in case the winning entry/entrant is deemed invalid (Reserve Entrants).

What can I win?

The Prize is a trip for 2 adults (the winner and one companion) to USA for a Monster Energy VIP UFC experience.

The travel details and dates of the Prize will be determined by the Promoter before 30/08/2019  based on final UFC schedule for 2019 which was not finalised at the start of the Competition. However, the Promoter confirms that the Prize will be fulfilled sometime in the period between 01/09/2019 2019 to 30/11/2019 subject to availability.

See paragraph 5 for further details.

Total prize pool

The total Prize experience value is up to $20,000 NZD depending on the winner’s point of departure.

How many times can I enter?

One entry per Qualifying Purchase. Each entry must be submitted separately in accordance with these Terms and Conditions. Purchase 2 (two) x 500ml Monster Energy® and gain one entry to the draw, purchase 4 (four) x 500ml Monster Energy® cans and gain 2 (two) entries and so forth. Maximum 3 entries per day.

How and when will the winner be informed?

The winning entry will be drawn at random on 15/05/2019. If you are the winner, you will be informed by phone or text on the number from which the entry text was sent within two days of winning entry being drawn.

Must I keep anything to verify my entry?

You must keep the original itemised purchase receipt(s) for all entries as proof of purchase. If you don't produce the proof of purchase for all entries when asked, the Promoter may disqualify all of your entries and you will lose any right to the Prize. If, in the Promoter's opinion, you have shared any receipt(s) with another person, your entries will be invalid and you will lose any right to the Prize.

If I win, when must I claim my prize?

You must claim the Prize and comply with any eligibility requirements (including providing proof of purchase if requested) by 5pm (NZST) on 24/05/2019

What if I don't claim my prize on time?

If the Prize has not been accepted or claimed by 5pm (NZST) on 24/05/2019  or if, after making all reasonable attempts, the Promoter can't contact a drawn winner (or a drawn winner does not contact the Promoter) by this time and date, the relevant entry will be discarded and the Promoter will re-award the Prize to the Reserve Entrant/s and/or by carrying out an unclaimed prize draw at 12pm (NZST) on 27/05/2019 at the same location as the original draw to distribute the Prize.

Any such winner will be informed by phone within two days of determination.

These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about the Prize and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions. Entry

1 Your entry must be received during the Competition Period. Your entry is deemed to be received only when received by the Promoter’s database. You will receive a return text message confirming your entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases you may be disqualified.

2 Buy any 2 (two) 500mL cans of Monster Energy® in one transaction from any participating Stores in New Zealand during the Competition Period and receive an entry card containing a unique code from the store cashier (while stocks last). To enter, text your unique code to ‘381’.

3 Texts to {381} will incur a standard message cost to the entrant. Costs of these texts will not be included as part of any text plan packages – check with your telecommunications provider. All text costs are at the expense of the entrant.

4 No entries will be accepted outside the Competition Period.


5 If you are the Prize winner, your Prize will be a trip for you and 1 (one) adult companion (18 years or over) to USA for a Monster Energy UFC experience. The specific location will be determined by Monster Energy before 30 August 2019 based on the UFC which is yet to be finalised. The trip will take place sometime between the period of 01 September, 2019 and 30 November 2019

6 The Prize comprises:

  1. Return economy airfares (including airfare taxes) for you and your companion from either Auckland, Christchurch, Wellington, or Queenstown airport to USA;
  2. Twin Share accommodation (as determined by the Promoter) for the duration of time away for you and your companion (up to a maximum of four [4] nights);
  3. Premium tickets to a UFC fight, attendance at the weigh-in and a meet and greet with selected fighters;
  4. Return airport transfers between airport and hotel; and
  5. $1,000 NZD spending money (for the winner only).

Accommodation, activities and flights are subject to availability. The Prize must be taken between 01 September 2019 to 30 November 2019 in accordance with the UFC schedule dates selected by the Promoter. The winner accepts and understands that they may be informed of the specific dates of the trip at short notice. Travel must be booked and completed in the time frame specified by the travel supplier. You and your companion are responsible for all other costs related to the Prize, including meals, additional transfer costs, insurance (including excesses,) in-room charges and additional taxes. All persons taking the Prize must depart and return at the same time. The Prize is subject to any additional conditions of third party suppliers including travel supplier/s and any conditions of entry into the event/s (including behavior requirements and applicable dress code), conditions of ticket validity, and any restrictions on ticket on-sale or transfer. Costs for changes made by you (and your companion) to the Prize after it has been booked must be paid by you and your companion as applicable. You will be required to present a valid credit card when checking in to the accommodation.

6 If the winner or their companion are unable to take the ‘UFC VIP Experience Prize’, due to any illness or personal circumstances beyond the winner’s or companion’s control, the winner must immediately notify the Promoter. The Promoter may, at its sole discretion, allow the winner to nominate another person to whom the ‘UFC VIP Experience Prize’ can be transferred and the Promoter will use all reasonable endeavors to transfer the Prize accordingly. The Promoter will not be liable if any part of the ‘UFC Experience’ Prize is unable to be transferred to the person nominated by the winner.


7 The winner and their companion take the Prize entirely at their own risk and will be responsible for complying with all laws and requirements relating to use of the Prize, including obtaining all necessary travel documentation (such as holding a valid passport, obtaining entry visas or permits as required) and complying with local driver’s license requirements. The Promoter accepts no responsibility if the winner and their companion are unable to participate in any part of the Prize due to local age requirements or any other local laws.


8 Prior to being awarded the Prize, the winner of the ‘UFC VIP Experience’ Prize and their companion will be required to:

· Show proof of identity with a copy of passports; and

  • Sign a “Participation Agreement” in the form required by the Promoter, confirming acceptance of these Terms and Conditions relating to the ‘UFC VIP Experience’ Prize, releasing the Promoter, its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies from any and all liability in connection with this Competition to the fullest extent permitted by law.

· If the Participating Agreements are not signed by the winner and their companion and returned to the Promoter within 5 (five) business days of receiving the Participating Agreement documents, the Prize will be forfeited.


9  Any failure by you or your companion to comply with any conditions imposed by the Prize supplier(s) may result in the Prize being cancelled or withdrawn without liability for the Promoter or the Prize supplier(s). 

10  If, for any reason, the scheduled UFC event is called off, rescheduled or postponed for any reason outside the reasonable control of the Promoter such that you cannot take this element of the Prize on the selected date, subject to clause 22, you and your companion will not be given any cash or alternative tickets for the same UFC event as a substitute for attending the experience.

11 Subject to clause 22, the Promoter has no liability if for any reason outside of its reasonable control (a) any of the advertised fighters are not present at the UFC event, or (b) the scheduled UFC fight does not take place.

12 The winner has rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter.  These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose, and that any services provided by the Promoter will be rendered with due care and skill.  These Terms and Conditions do not, and do not intend to, exclude or limit those statutory rights in any way.  However, to the extent that is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Competition and will not be responsible for breach of such representations or warranties.  



13 If you are the Prize winner, you (and your companion) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You (and your companion) consent to the Promoter using your names and images in any promotional or advertising activity in perpetuity without compensation.

14 You and your companion accept that some aspects of the Prize are inherently risky and that the Prize involves dangerous activities.

15 You and your companion must, if required by the Promoter, and to the fullest extent permitted by law sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the Prize. If you or your companion do not sign these documents, your entry will be deemed invalid and you will lose any entitlement to the Prize. You and your companion will be given a reasonable opportunity to review and consider the documents before signing.

16 If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if you are unable to take the Prize on the selected dates chosen by the Promoter between 01 September 2019 to 30 November 2019, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

17 You must not:

(a) Tamper with the entry process;

(b) Engage in any conduct that may jeopardise the fair and proper conduct of the Competition;

(c) Act in a disruptive, annoying, threatening, abusive or harassing manner towards the the Promoter or any of its related entities or the agencies or parties associated with this Competition;

(d) Do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or parties associated with this Competition;

(e) Breach any law or regulation of New Zealand or any jurisdiction in which the Prize is fulfilled; or

(f) Behave in a way that is otherwise inappropriate. 

18  You are responsible for your companion and the Promoter may disqualify all entries from, and prohibit further participation in this Competition by, you or your companion if they breach these Terms and Conditions, whether or not legally bound by them.

19 If you (or your companion), in the opinion of the Promoter, are intoxicated, under the influence of alcohol or any other substance, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or parties associated with this Competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel or restrict you (and your companion) from participating in any elements of the Prize, at its discretion.

20 The Promoter is not liable for entries, Prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

21 The Promoter’s decision in connection with all aspects of this Competition is final.

22 The ‘UFC VIP EXPERIENCE’ Prize cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash.  Without limiting any other term of these Terms and Conditions, all elements of the Prize must be taken as and when specified, or will be forfeited with no replacement.  The Prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in Prize value.  You agree that if the Prize (or an element of the Prize) is unavailable for any reason the Promoter may, at its discretion, provide another item of equal or higher value, subject to any applicable law.

23  By entering, you request that your full address not be published.

24  By accepting or participating in the Prize, your companion accepts these Terms and Conditions. The Terms and Conditions applying to the winner will also apply to your companion as if reference to the winner in these Terms and Conditions were to the companion (unless indicated otherwise).


25 If this Competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the Competition or disqualify affected entries/entrants, subject to any applicable law.

26 The Promoter is not responsible for any tax implications arising from you winning the Prize.  You should seek independent financial advice.  If for GST purposes this Competition results in any supply being made for non-monetary consideration, you must follow the Inland Revenue’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.


27  The Promoter and the agencies and parties associated with this Competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Competition or any Prize, except for any liability which under law cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).  

28  The Promoter may communicate or advertise this Competition using Facebook or Instagram. However, the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any liability.

29 The Promoter collects entrants’ personal information in order to conduct the Competition. Entry is conditional on providing this information. By entering this Competition, unless otherwise advised, each entrant agrees that the Promoter may:

  1. use the entrant’s personal information to conduct the Competition in accordance with these Terms and Conditions (including to send electronic messages to the or telephone the entrant in relation to the Competition); and
  2. disclose the entrant’s personal information to third parties, including but not limited to agents, contractors, service providers, and Prize suppliers, for the purpose of conducting the Competition.

Entrants may access the personal information the Promoter holds about them, and should direct any request to access, update or correct information to the Promoter at [email protected] in these Terms and Conditions. Entrants can obtain a copy of the Promoter’s Privacy Policy at or by contacting the Promoter via the postal address provided above. All entries become the property of the Promoter.
