CELOTNI POGOJI PROMOCIJE
Natančno preberite te pogoje (v nadaljevanju »pogoji«). S svojo prijavo na to promocijo (v nadaljevanju »promocija«) se strinjate, da vas zavezujejo ti pogoji. Prav tako preberite naš pravilnik o zasebnosti na spletnem mestu www.monsterenergy.com, ki pojasnjuje, kako bomo uporabljali podatke, ki nam jih posredujete ob prijavi na to promocijo.
1.    Promocijo organizira in vodi družba Monster Energy Europe Limited s sedežem na naslovu Monster House, 7 Cowley Business Park, High Street, Uxbridge, UB8 2AD, Združeno kraljestvo (v nadaljevanju »Monster Energy«).
2.    V promociji lahko sodelujejo vse osebe, starejše od osemnajst (18) let, s prebivališčem v Sloveniji. Nobenemu zaposlenemu ali družinskemu članu zaposlenega v družbi Monster Energy ali v katerem koli od njenih povezanih družb, podizvajalcih, pri zastopnikih ali pooblaščencih oziroma pri komer koli, ki je poklicno povezan s to promocijo, ni dovoljena prijava na promocijo.
3.    Promocija poteka na spletnem mestu www.monsterenergy.com/yamaha_SI (v nadaljevanju »spletno mesto«) in se promovira s pomočjo promocijskega gradiva na izbranih lokacijah trgovin »Mercator« v Sloveniji.
4.    S prijavo na to promocijo skladno s temi pogoji se mora vsak udeleženec (v nadaljevanju »vi«, »vaš« in »udeleženec«) strinjati s tem, da ga zavezujejo ti pogoji in vse odločitve družbe Monster Energy, ki bodo veljale kot dokončne, glede vsega, kar je povezano s promocijo. Družba Monster Energy o tem ne bo nadalje komunicirala z nikomer.
5.    Vsi časi in datumi, določeni v teh pogojih, pomenijo čase in datume v Sloveniji. V primeru kakršnega koli spora glede ure ali datuma glasovanja prejete prijave bo odločitev družbe Monster Energy veljala za dokončno.
6.    Za sodelovanje v tej promociji ni potreben nakup nobenega izdelka.

Prijava

7.    Datum začetka promocije je ob 00:01 dne 24. 7. 2023 (v nadaljevanju »datum začetka«), datum zaključka promocije pa ob 23:59 dne 23. 8. 2023 (v nadaljevanju »datum zaključka«). 
8.    Udeleženci se lahko na promocijo prijavijo tako, da: 
a.    ravnajo skladno s temi pogoji; 
b.    posredujejo svoje podatke v skladu z navodili na spletnem mestu (ime in priimek, naslov prebivališča, telefonska številka, datum rojstva in e-poštni naslov); in
c.    odgovorijo na naslednje vprašanje v 30 besedah ali manj: »Zakaj si zaslužite motocikel Yamaha®?« (v nadaljevanju »odgovor«). 
Nagrada in zahteve

9.    Vsak udeleženec, ki pošlje veljavno prijavo, kot je določeno zgoraj (v nadaljevanju »veljavna prijava«), bo skupaj z ostalimi veljavnimi prijavami dodan v skupino prijav. Žirija, sestavljena iz dveh (2) predstavnikov družbe Monster Energy in enega (1) neodvisnega sodnika (v nadaljevanju »žirija«), bo skupaj v štirinajstih (14) dneh po datumu zaključka izbrala enega (1) uradnega zmagovalca (v nadaljevanju »zmagovalec«) in dobitnika nagrade (kot je opredeljena v nadaljevanju), čigar odgovor bo odražal največjo mero ustvarjalnosti, izvirnosti, domiselnosti in najboljše razumevanje Yamahe in blagovne znamke Monster Energy® ter najboljše besedišče in slog pisanja (v nadaljevanju »merila za izbor«).
10.    Žirija bo preverila, ali so prijave veljavne in v skladu s temi pogoji, primerjala veljavne prijave glede na merila za izbor ter podelila nagrado zmagovalcu (v nadaljevanju »izbirni postopek«). 
11.    Zmagovalec prejme en (1) 125-kubični motocikel Yamaha® YZF-R125, kot to povsem po lastni presoji določi družba Monster Energy (v nadaljevanju »nagrada«). Približna maloprodajna vrednost nagrade je pet tisoč in 00/100 evrov (5.000,00 EUR). 
12.    Preden je lahko razglašen za zmagovalca in prejme svojo nagrado, bo potencialni zmagovalec morda moral dokazati upravičenost, vključno in ne omejeno na vozniško dovoljenje, dokazila o starosti, bivališču, identiteti, kar lahko vključuje, vendar ni omejeno na kopijo vozniškega dovoljenja, dokazila o bivališču, potni list in/ali podoben identifikacijski dokument, ki ga je izdal pristojni državni organ. Če zmagovalec družbi Monster Energy teh podatkov ne predloži v razumnem roku, ki ga določi družba Monster Energy, lahko pomeni, da mu bo nagrada odvzeta, družba Monster Energy pa bo takoj po tem, ko bo to razumno mogoče, izbrala drugo veljavno prijavo.
13.    Zmagovalec bo moral podpisati izjavo, ki jo povsem po lastni presoji pripravi družba Monster Energy in se nanaša na nagrado, s čimer potrdi, da izjavo razume, jo bo upošteval in jo sprejema. Kopije potrdila in izjave so na zahtevo na voljo na www.monsterenergy.com/contact-us.
14.    Da se izognemo dvomu – vse druge stroške, povezane z nagrado, kar ni izrecno vključeno in navedeno v opredelitvi nagrade zgoraj, vključno in ne omejeno na cestno takso, varnostno opremo, vozniško dovoljenje in ustrezno zavarovanje, nosi izključno zmagovalec.

Obveščanje in predaja nagrade

15.    Zmagovalec bo obveščen po elektronski pošti in/ali na telefonsko številko, ki jo je navedel ob prijavi na promocijo, v sedmih (7) dneh po izbirnem postopku (v nadaljevanju »obvestilo«). Neuspešni udeleženci ne bodo obveščeni. 
16.    Podrobnosti o predaji nagrade povsem po lastni presoji določi družba Monster Energy. Zmagovalec bo s podrobnostmi o predaji nagrade (vključno z, vendar ne omejeno na čas, datum in lokacijo predaje) seznanjen ob prejemu obvestila.
17.    V primeru, da družba Monster Energy ne bo mogla stopiti v stik s potencialnim zmagovalcem v treh (3) dneh po posredovanem obvestilu ali da potencialni zmagovalec ni na voljo za prevzem nagrade, bo njegova prijava razveljavljena, družba Monster Energy pa bo izbrala drugo veljavno prijavo, takoj ko bo to razumno mogoče in v skladu z izbirnim postopkom. 
Splošni pogoji

18.    Vsak udeleženec lahko posreduje samo eno (1) prijavo in ne sme posredovati ali poskušati posredovati več kot ene (1) prijave. Družba Monster Energy si pridržuje pravico zavrniti prijavo posameznika, ki posreduje ali poskusi posredovati več kot eno (1) prijavo za sodelovanje v promociji.
19.    Spletni vnosi, izvedeni s pomočjo skriptov, makrov ali s samodejnimi napravami, niso dovoljeni. Družba Monster Energy si pridržuje pravico do preverjanja prijav in njihove izključitve, če so te bile po njenem mnenju izvedene s kakršnimi koli avtomatiziranimi tehnikami.
20.    Da se izognemo dvomu – za prijavo na to promocijo potrebujete računalnik ali drugo napravo, ki omogoča povezavo z internetom, in dostop do interneta. Dolžnost udeležencev je, da si priskrbijo dovoljenje lastnika računalnika in posameznika, ki plačuje internetne storitve. Za stroške, povezane z internetno povezavo za potrebe sodelovanja v promociji, ni mogoče zahtevati kakršnega koli nadomestila.
21.    Vse prijave se štejejo kot prejete v času vnosa v zbirko podatkov družbe Monster Energy in ne v času, ko je udeleženec prijavo oddal na spletnem mestu. 
22.    V primeru kakršnega koli spora glede identitete zmagovalca bo odločitev družbe Monster Energy veljala za dokončno.
23.    Predložitev spletnega prijavnega obrazca ali kakršno koli dokazilo o predložitvi spletnega prijavnega obrazca ne velja kot dokazilo o prejemu vaše prijave. Družba Monster Energy ne sprejema nikakršne odgovornost za prijave, ki so nepravilno izpolnjene, izgubljene, zapoznele ali ki niso bile prejete iz kakršnega koli razloga. 
24.    Nagrada je takšna, kot je opisana, in ni prenosljiva, zamenljiva in zanjo ne ponujamo nobenega denarnega nadomestila v primeru, da je zmagovalec iz kakršnega koli razloga ne more prevzeti. V primeru nepredvidenih okoliščin ali v primeru, da družba Monster Energy nagrade zaradi virusa COVID-19 ne more zagotoviti, si družba Monster Energy pridržuje pravico, da celotno nagrado ali dele nagrade nadomesti z nagrado enake ali večje vrednosti.
25.    Zmagovalec se strinja s sodelovanjem v razumni publiciteti, povezani s promocijo, če to zahteva družba Monster Energy, in potrjuje, da lahko družba Monster Energy uporabi njegovo ime, fotografijo in zvočne posnetke in/ali videoposnetke pri vsakršni publiciteti, povezani s promocijo.
26.    Če družba Monster Energy teh pogojev ne izpolni, je odgovorna za izgubo ali škodo, povzročeno udeležencu, ki je posledica predvidljive kršitve teh pogojev s strani družbe Monster Energy oziroma malomarnosti, ni pa odgovorna za izgubo ali škodo, ki je ni mogoče predvideti. Izguba ali škoda je predvidljiva, če je iz očitnih razlogov nastala kot posledica kršitve s strani družbe Monster Energy ali če sta jo udeleženec in družba Monster Energy predvidela v času udeleženčeve prijave na promocijo. Ob odgovornosti družbe Monster Energy za predvidljivo izgubo ali škodo, družba Monster Energy in/ali vse njene podružnice, zaposleni, direktorji, predstavniki ali podizvajalci zavračajo vsakršno in vso odgovornost v največjem mogočem obsegu, ki ga dopušča zakonodaja. 
27.    Pride lahko do dogodkov, ki onemogočijo samo promocijo ali podelitev katere koli nagrade iz razlogov, ki jih družba Monster Energy ne more nadzorovati in ki bi lahko, po izključni presoji družbe Monster Energy, spremenili promocijo; udeleženec soglaša, da zato od družbe Monster Energy ne bo terjal nikakršne odgovornosti.
28.    Družba Monster Energy si pridržuje pravico, da: (a) spremeni obliko promocije in/ali prestavi ali odloži čas izvedbe promocije ali katere koli faze oziroma faz, v celoti ali deloma iz razlogov, ki so zunaj njenega razumnega nadzora, ne da bi za to bila odgovorna udeležencu; in/ali da (b) zavrne sodelovanje katerega koli posameznika v promociji ali prihodnjih promocijah, ki jih organizira družba Monster Energy: (i) če družba Monster Energy razumno verjame, da je nagrada bila deloma ali v celoti prenesena na tretjo osebo; (ii) če je bil udeleženec diskvalificiran v katerem koli tekmovanju družbe Monster Energy ali promociji v dvanajstih (12) mesecih od datuma začetka; (iii) če družba Monster Energy iz razumnih razlogov verjame, da posameznik ni izpolnjeval teh pogojev; in/ali (iv) če je takšen posameznik neupravičen do udeležbe v tej promociji (ali bi mu bilo treba udeležbo v tej promociji iz kakršnega koli razloga zavrniti).
29.    Družba Monster Energy zavrača odgovornost za vsakršne stroške, ki so morda bili povzročeni kateremu koli udeležencu, razen za tiste, ki so izrecno navedeni v teh pogojih. Zmagovalec odgovarja za vsakršno plačilo davkov, ki bi veljali za nagrado. 
30.    Svetujemo, da si vsi udeleženci izvod teh pogojev shranijo za rabo v prihodnje.
31.    Soglašate, da je v primeru, da ste razglašeni za zmagovalca, vaše ime dovoljeno javno objaviti. Ime zmagovalca je mogoče pridobiti s kontaktiranjem družbe Monster Energy prek spletnega mesta www.monsterenergy.com/contact-us v 90 dneh po datumu zaključka. 
32.    Za promocijo in te pogoje velja zakonodaja Anglije in Walesa v skladu z obveznimi določbami lokalnega potrošniškega prava, ki po samem zakonu morda velja v vašo korist, in nič v tej promociji in teh pogojih ne vpliva na vašo pravico, ki jo imate kot potrošnik, da se zanašate na tovrstne obvezne določbe lokalnega prava.
33.    Za vse spore (pogodbene ali nepogodbene), ki izhajajo iz ali v povezavi s to promocijo ali temi pogoji, imajo neizključno pristojnost sodišča Anglije in Walesa. Toda to ne omejuje pravic potrošnikov, ki jih imajo v okviru veljavne zakonodaje o varstvu potrošnikov.

LONG FORM PROMOTION TERMS & CONDITIONS
Please read these terms & conditions (“Terms”) carefully.  By entering this promotion (the “Promotion”), you are agreeing to be bound by these Terms. You should also read our privacy policy at www.monsterenergy.com which explains how we will use the data you provide us with when entering the Promotion.
1.    The Promotion is being organised and operated by Monster Energy Europe Limited of Monster House, 7 Cowley Business Park, High Street, Uxbridge, UB8 2AD, United Kingdom (“Monster Energy”).
2.    The Promotion is open to all persons over eighteen (18) years of age and who are resident in Slovenia. No employee or family member of an employee of Monster Energy or its affiliated companies, subcontractors, agents or assigns or anyone else professionally connected with the Promotion is permitted to enter the Promotion. 
3.    The Promotion is being conducted through the website at [INSERT WEBSITE URL] (the “Website”) and promoted through promotional material within selected participating “Mercator” locations in Slovenia.
4.    By entering the Promotion pursuant to these Terms, each entrant (“you”, “your”, “entrant”) agrees to be bound by these Terms and by the decision(s) of Monster Energy, whose decision shall be final, in relation to all matters relating to the Promotion.  No further correspondence will be entered into by Monster Energy.
5.    All times and dates set out in these Terms refer to the times and dates in Slovenia.  In the event of any dispute over the time or date of any entry submitted the decision of Monster Energy shall be final.
6.    No purchase of any product is required to enter the Promotion.

Entry

7.    The commencement date of the Promotion is 00:01 on 24.07.2023 (“Commencement Date”) and the closing date for the Promotion is 23:59 on 23.08.2023 (“Closing Date”).  
8.    Entrants may enter the Promotion by: 
a.    acting in accordance with these Terms; 
b.    submitting their details as directed on the Website (being full name, residential address, telephone number, date of birth and email address); and
c.    answering the following question (in 30 words or less): “Why should you win a Yamaha® motorcycle?” (“Answer”). 
Prize & Requirements

9.    Each entrant that validly submits their entry as set out above (each a “Valid Entry”) shall be entered into a pool of entries with every other Valid Entry. A panel consisting of two (2) Monster Energy representatives and one (1) independent judge (which makes up the “Panel”) will collaborate and within fourteen (14) days of the Closing Date choose one (1) official winner (the “Winner”) of the Prize (as defined below) whose Answer demonstrates the most creative and original response, ingenuity, the best understanding of Yamaha and Monster Energy®, and the best use of vocabulary and writing style (“Selection Criteria”)
10.    The Panel shall ensure that the entries are valid in accordance with these Terms, judge the Valid Entries on the Selection Criteria, and assign the Prize to the Winner (the “Selection Process”).  
11.    The Winner shall win one (1) Yamaha® 125cc YZF-R125 motorcycle, as determined by Monster Energy in its complete discretion (“Prize”). The approximate retail value of the Prize is five thousand and 00/100 Euros (€5,000.00).   
12.    Before being declared the Winner and receiving their Prize, the potential Winner may be required to prove eligibility, including, without limitation, driver’s license, proof of age, residence, identity, which may include but is not limited to a copy of driver’s license, proof of residence, passport and/or similar government issued identification. Failure to provide Monster Energy with this information within the reasonable timeframe set by Monster Energy may result in the Winner forfeiting their Prize and Monster Energy selecting another Valid Entry as soon as reasonably possible thereafter.
13.    The Winner will be required to sign a waiver prepared by Monster Energy, in its complete discretion, specific to the Prize confirming understanding, compliance with and acceptance of the waiver.  Copies of the applicable confirmation and waiver can be obtained upon request from www.monsterenergy.com/contact-us.
14.    For the avoidance of doubt, all other costs associated with the Prize not specifically included and outlined in the definition of the Prize above, including without limitation, road tax, safety equipment, driving license and relevant insurance, will be borne solely by the Winner.

Notification and Prize Delivery

15.    The Winner will be notified by email and/or by telephone via the email address and/or telephone number provided to enter the Promotion within seven (7) days of the Selection Process (“Notification”). Unsuccessful entrants will not be notified. 
16.    The delivery details of the Prize shall be determined by Monster Energy in its complete discretion. Details of delivery of the Prize (including but not limited to the time, date and location of delivery) shall be provided to the Winner at Notification.
17.    In the event that Monster Energy cannot contact the potential winner within three (3) days of the Notification or the potential Winner is unavailable to retrieve the Prize, such entry will be deemed null and void and Monster Energy shall select another Valid Entry as soon as reasonably possible thereafter in accordance with the Selection Process. 
General Terms

18.    Entrants are limited to one (1) entry per person and each entrant shall not submit or attempt to submit more than one (1) entry.  Monster Energy reserves the right to refuse entry of any individual to the Promotion who submits or attempts to submit more than one (1) entry.
19.    Entries will not be valid where they are made online using methods generated by a script, macro or the use of automated devices.  Monster Energy reserves the right to verify the validity of entries and to exclude entries it believes have been made using any automated entry techniques.
20.    For the avoidance of doubt a computer or another internet ready device and internet access is required to enter the Promotion. It is the responsibility of the entrants to ensure permission is gained from the owner of the computer and the individual who pays for the internet service provider. No refund may be claimed for expenses related to the use of an internet connection for the purpose of participating in the Promotion.
21.    All entries are deemed to have been received at the time of entry into Monster Energy’s database and not at the time when the entry is sent to the Website by the entrant. 
22.    If there is any dispute as to the identity of the Winner, the decision of Monster Energy shall be final.
23.    Submitting the online entry form or any other form of evidence of submitting the online entry form is not proof that your entry has been received.  Monster Energy accepts no responsibility for entries that are incorrectly completed, lost, delayed or which are not received for any reason.  
24.    The Prize is as described and is not transferable, not exchangeable and no cash alternative will be offered in the event that the Winner is unable to claim their Prize for any reason whatsoever.  In the event of unforeseen circumstances or Monster Energy being unable to deliver the Prize due to COVID-19, Monster Energy reserves the right to replace the entire Prize or prize components with a prize of equal or greater value.
25.    The Winner agrees to participate in reasonable publicity resulting from the Promotion if requested to do so by Monster Energy and the Winner acknowledges that Monster Energy can use their name, photograph and audio and/or visual recordings of them in any publicity relating to the Promotion as described in Monster Energy’s privacy policy.
26.    If Monster Energy fails to comply with these Terms, it is responsible for loss or damage an entrant suffers that is a foreseeable result of Monster Energy's breach of these Terms or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Monster Energy's breach or if they were contemplated by the entrant and Monster Energy at the time that the entrant entered the Promotion. Besides Monster Energy's liability for foreseeable loss or damage, Monster Energy and/or any of their affiliate companies, employees, directors, agents, assigns or sub-contractors disclaims any and all liability to the fullest extent permissible by law.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                           
27.    Events may occur that render the Promotion itself or the awarding of the Prize impossible due to reasons beyond the control of Monster Energy and accordingly Monster Energy may, at its absolute discretion, vary or amend the Promotion and the entrant agrees that no liability shall attach to Monster Energy as a result thereof.
28.    Monster Energy reserves the right to: (a) change the format of the Promotion and/or delay or postpone the Promotion or any stage(s), in whole or in part due to reasons beyond its reasonable control, without liability to the entrant; and/or (b) refuse entry of any individual to the Promotion or future promotions organised by Monster Energy: (i) where Monster Energy reasonably believes that the Prize has been transferred to a third party in whole or in part; (ii) where an entrant has been disqualified from any Monster Energy competition or promotion in the twelve (12) months prior to the Commencement Date; (iii) where Monster Energy reasonably believe such individual has not complied with these Terms; and/or (iv) where such individual is ineligible to participate in the Promotion (or if participation in the Promotion should have been refused for any reason whatsoever).
29.    Save as expressly set out in these Terms, Monster Energy has no liability for any costs or expenses that may be incurred by any entrant. The Winner will be liable for any tax chargeable in relation to the Prize.  
30.    It is advised that all entrants retain a copy of these Terms for future reference.
31.    You accept that your name may be made available to the public if you are the Winner. The Winner’s name is available by contacting Monster Energy at www.monsterenergy.com/contact-us within 90 days of the Closing Date.   
32.    The Promotion and these Terms are governed by the laws of England and Wales subject to mandatory provisions of local consumer law that may apply for your benefit by operation of law and nothing in the Promotion and these Terms affect your rights as a consumer to rely on such mandatory provisions of local law.
33.    Any disputes (contractual or non-contractual) arising under or in connection with this Promotion or these Terms are subject to the non-exclusive jurisdiction of the Courts in England and Wales. However, this shall not limit consumers' mandatory rights under the applicable consumer protection legislation.
