Monster Energy Road to Snow Promotion (Promotion) Terms and Conditions Who is running the Promotion? The Promoter of this Promotion is Coca-Cola Europacific Partners New Zealand Limited, The Oasis, Mt Wellington, Auckland (“CCEP”) (Promoter). Monster Energy AU Pty Ltd. is not the promoter of the Promotion. The Monster Energy brand names, logos and/or materials are used for the purposes of promotion and/or prize descriptions only and such use is not intended to suggest or imply Monster Energy AU Pty Ltd.’s sponsorship of this Promotion. The Promotion is being conducted within selected stores in New Zealand. Information regarding participating stores, prizes and how to enter forms part of these conditions. By entering this prize draw you accept these terms and conditions. When will the Promotion start and end? The Promotion starts at 12.00am (NZST) on 19/06/2023 and ends at 11.59pm (NZST) on 27/08/2023 (the Promotion Period). Who can enter? Entry is only open to New Zealand residents who are aged 18 years and over excluding: (a) management, employees, directors and contractors of the Promoter, its related bodies corporate, the participating stores and other agencies, firms or companies associated with the Promotion (including suppliers of prizes); (b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph (a) above; (c) persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any competition or promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period; (d) persons who have used or attempted to use any more than one name in order to qualify to win a competition or promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and (e) persons who have breached the terms and conditions of any competition or promotion run by or on behalf of the Promoter. The Promoter reserves the right, at any time, to request proof of your eligibility in the event that there is doubt over your eligibility to enter the Promotion. The persons referred to in paragraph (b) above include natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an eligible entrant in its absolute discretion. Where will the Promotion run? The Promotion will be run in participating stores in New Zealand as identified by the display of in-store promotional material (Participating Stores). Participating Stores are listed on www.monsterenergy.com. Do I need to buy anything for a chance to win? Yes. During the Promotion Period, you need to buy, in one transaction, 2 (two) Monster Energy® 500ml products (all variants but excluding online and vending machine purchases) from a Participating Store during the Promotion Period (Qualifying Purchase) and retain your receipt as proof of purchase. Entry Instructions At the time of making a Qualifying Purchase, you will receive an entry form from the store cashier (while stocks last). For example, if 2 products are purchased in a single transaction = 1 entry form, 4 products are purchased in a single transaction = 2 entry forms, 6 products are purchased in a single transaction = 3 entry forms and so on. Each entry form provides you with one entry into the prize draw. The entry forms can only be obtained at the checkout at the time a Qualifying Purchase is made. Each entry form can only be used once. To enter the Promotion, fill in all the required details in the entry form and drop it into the entry box. Entries must be submitted in the same Participating Store where the Qualifying Purchase is made. Incomplete or invalid entries or those not submitted in accordance with these Terms and Conditions will not be accepted. The Promoter accepts no responsibility for late or lost entries. Entries will not be accepted outside of the Promotion Period. How many Prize Winners will there be and how will they be chosen? All entries received during the Promotion Period will be entered into the draw. The first valid entry drawn from the pool of entries received for each Participating Store, during the Promotion Period, will win the Prize (as defined below) for that Participating Store (each, a Prize Winner). There will be one (1) Prize Winner per Participating Store. The prize draw will take place by the 10th of September 2023 in the Participating Store. The Participating Store may draw additional entries and record them in the order in which they are drawn, in case any drawn entry/entrant is deemed invalid (Reserve Entrants). What can I win? There is one prize of a Monster Energy branded Black Edition 156 Snowboard (excluding bindings) with an estimated value of $1,000NZD (Prize) to be won in every Participating Store. The Prize is unavailable for purchase in any store so this value is an estimate only. The Prize comprises the snowboard only. Colours and sizes are final and cannot be exchanged. Prizes illustrated on the point of sale and social images are not indicative of the exact Prizes. Prizes are not transferable, exchangeable, or redeemable for cash. How many times can I enter? Multiple entries are permitted but there is a limit of one entry per Qualifying Purchase. Each entry must be submitted separately in accordance with these Terms and Conditions. Purchase, in one transaction, any 2 x 500ml Monster Energy drink products (all variants, but excluding Monster Energy Import 550ml, online and vending machine purchases) and receive one entry form. Although the number of entries that can be submitted per person is not limited, a person may only win one Prize. If an entrant is drawn as a Prize Winner for a second time at a different Participating Store, that Prize will be awarded to a Reserve Entrant. How and when will the Prize Winners be informed? Prize Winners will be notified via the e-mail address or mobile number supplied on the drawn entry form within 5 working days of the Prize draw taking place. If a winner cannot be contacted within 10 working days, their Prize will be awarded to a Reserve Entrant in accordance with these Terms and Conditions. The Promoter is not responsible for any incorrect or inaccurate information submitted on the entry form. If I win, when must I claim my Prize? To claim the Prize, you must provide any relevant details (such as and not limited to age, I.D., name and address, proof of purchase,) required to comply with any eligibility requirements by 5pm (NZDT) on 25th September 2023 What if I don't claim my Prize on time? If a Prize has not been accepted or claimed by 5pm (NZDT) 25th September 2023 or if, after making all reasonable attempts, the Promoter can't contact a Prize Winner (or a Prize Winner does not contact the Promoter) by this time and date, the relevant entry will be discarded and the Promoter will re-award the Prize to a Reserve Entrant/s and/or by carrying out an unclaimed prize draw on 25th September 2023 at the same location as the original draw, to distribute the Prize. Any such new winner will be informed by phone within two working days of determination. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about the Prize/s and how to enter the Promotion forms part of these Terms and Conditions. By participating in the Promotion, you accept these Terms and Conditions. Participation 1. To qualify to enter the Promotion, customers must purchase any two (2) 500mL Monster Energy products (all variants, but excluding online and vending machine purchases) in a single transaction during the Promotion Period at any Participating Store. 2. Prizes are not transferable, exchangeable, or redeemable for cash. 10. All Prizes will be delivered to each Prize Winner within 21 working days of receipt of a delivery address from the Prize Winner. The Promoter cannot guarantee desired delivery times or days. 11. The Promoter is not liable if the Prize Winner moves to a new address, or misspells or provides the wrong address to the Promoter. If Prizes are returned after reasonable carrier attempts to deliver the Prize to the Prize Winner, the Promoter will not be liable for resending the Prize. 12. You must, if required by the Promoter, and to the fullest extent permitted by law, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the Prize. If you do not sign these documents, your entry will be deemed invalid and you will lose any entitlement to the Prize. You will be given a reasonable opportunity to review and consider these documents before signing. General 13. Entrants into the Promotion must be aged 18 years or older. 14. The Promoter’s decisions and the draw results are final and not subject to appeal. 15. If this Promotion cannot run as planned for any reason beyond the Promoter’s reasonable control, for example due to software, hardware or communication issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change or suspend the Promotion or disqualify affected entries/entrants, subject to any applicable law. Any termination, amendment, suspension or cancellation of the Promotion will be notified on the Promoter’s website www.monsterenergy.com. 16. For reasons beyond the Promoter’s reasonable control, it may be necessary for the Promoter to amend these Terms and Conditions. Wherever possible, such amended terms and conditions will be displayed at Participating Stores and notified on the Promoter’s website www.monsterenergy.com. 17. Although the number of entries that can be submitted per person is not limited, a person may only win one Prize. If an entrant is drawn as a Prize Winner for a second time, that Prize will be awarded to a Reserve Entrant. 18. The Promoter and the agencies and companies associated with the Promotion are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Promotion or any Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law). Prize Winners have rights under the New Zealand Consumer Guarantees Act 1993 which cannot be excluded or limited by the Promoter. These rights include statutory guarantees that any goods provided by the Promoter will be of acceptable quality and fit for purpose. These terms and conditions do not, and do not intend to, exclude or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter makes no representations or warranties, express or implied, under laws other than the New Zealand Consumer Guarantees Act 1993 regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties. 19. If a Prize Winner is deemed by the Promoter to be in breach of these Terms and Conditions, that Prize Winner’s applicable entry (or at the Promoter’s reasonable discretion, all of the Prize Winner’s entries) may be discarded. The Promoter may, at any time, require a Prize Winner to produce documentation to establish to the Promoter’s satisfaction the validity of their entry (including documentation establishing the Prize Winner’s identity, age, place of residence and, to the extent necessary, place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights. 20. You must not: (a) tamper with the entry process; (b) engage in any conduct that may jeopardise the fair and proper conduct of the Promotion; (c) act in a disruptive, annoying, threatening, abusive or harassing manner towards the Promoter or any of its related entities or the agencies or parties associated with this Promotion; (d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Promotion; (e) breach any law or regulation of New Zealand; or (f) behave in a way that is otherwise inappropriate. 19. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted. 21. Prizes cannot be transferred or exchanged nor redeemed for cash. The estimated Prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in value. You agree that if the Prize is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any applicable law. 22. 23. By accepting or participating in any Prize, you accept these Terms and Conditions. 24. Any person suspected of cheating (in the opinion of the Promoter) through the manipulation of entry, creation or use of software to aid in multiple entries and otherwise fraudulently falsifying data or acting in any way fraudulent, in the opinion of the Promoter, will be removed from this Promotion and damages may be sought. Liability 25. The Promoter and the agencies and companies associated with this Promotion are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Promotion or the Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law). 26. The Promoter may communicate or advertise this Promotion using Facebook or Instagram. However, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability in connection with this Promotion. Collection and use of your personal information 27. The Promoter collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, or Prize suppliers. Entry is conditional on providing this PI. The Promoter will also use, and handle PI in accordance with the Privacy Act 2020 and as set out in its Privacy Policy, which can be viewed at www.ccamatil.com/nz/Privacy-policy. The Promoter will take reasonable steps to ensure that the third parties to whom the Promoter discloses PI are bound to protect the privacy of that PI. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the New Zealand Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. All entry information will be deleted within 3 months post-Promotion conclusion. 28.
